CALL TO ORDER The Workshop of April 24, 2000 of the City Commission was called to order by Mayor Paul P. Partyka at 5:33 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor Paul P. Partyka, present Deputy Mayor Cindy Gennell, present Commissioner Robert S. Miller, absent Commissioner Michael S. Blake, arrived at 5:34 p.m. Commissioner Edward Martinez, Jr., present Commissioner David W. McLeod, present City Manager Ronald W. McLemore, absent Public WorkslUtility Department Director, Kipton D. Lockcuff, P.E. present City Attorney Anthony A. Garganese, arrived at 5:34 p.m. Commissioner Michael S. Blake arrived at 5:34 p.m. City Attorney Anthony A. Garganese arrived at 5:34 p.m. Mayor Partyka stated, "Let the record show that Commissioner Blake is here also - at the start of the meeting, and Anthony Garganese." II. WORKSHOP AGENDA Discussion Of General Issues Pertaining To The Various Agenda Items Scheduled For The Regular Meeting Of April 24, 2000. Mayor Partyka mentioned a letter that he had sent to the Commission regarding streamlining and/or improving the meeting. Mayor Partyka suggested that the Commission review this document, and that this be discussed at another Workshop or Meeting. .:. .:. AGENDA NOTE: THE FOLLOWING AGENDA ITEMS WERE DISCUSSED IN THE ORDER AS DOCUMENTED. .:. .:. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - APRIL 24, 2000 Page 2 of 5 REGULAR B. General Services Department Requests That The City Commission Designate A Time And Date For A Workshop To Evaluate And Discuss (A) Possible Changes To The Employee Pension Plan, And (B) The Contents Of A Salary Survey/Compensation Study. The consensus of the Commission was to hold this Workshop on Monday, May 15th, 2000, at 6:30 p.m. Deputy Mayor Cindy Gennell mentioned that she may be out of town, on that date. Discussion followed on what would be presented at this Workshop. Mr. Gene DeMarie stated that "We have had the salary survey done. In fact, the final details are going to be placed on it - are going to be worked out tomorrow morning, with Cody and Associates; our last meeting on it, and he will have a final product (he told me) by either this coming Friday, or next Monday - so that you will have it for review, a minimum of almost two weeks before that Workshop. Plus, we have potential changes to the Pension Plan - Employee Pension Plan that we are now finalizing. The Actuary is putting together the final cost analysis of that, and we will be meeting with the Pension Board, next Tuesday evening, and we will be putting information to you, after that Pension Board Meeting, so that you can see what the considerations are." Commissioner Edward Martinez, Jr. asked if it was possible to receive a document that shows "What the salaries were five years ago, as compared to the present salary schedule?" Commissioner Martinez added, "By departments - it's just for comparison purposes, to see where we are coming from, where we are today, and where it is that we want to go." Commissioner Martinez then stated, "A basic idea as to what the picture was five years ago, and what it is today." Discussion. Mr. DeMarie said, "Salary cost, by Department? Yes, we can do that." Commissioner Blake stated that his preference was "To know where we stand competitively, in the marketplace currently." And, "Not just where our ranges fall, versus other communities out there, but where our employees fall, within the ranges." Mr. DeMarie stated, "That's all part of the study." "That's what's called the 'Internal Equity' issue, and he's addressing that. It's all going to be a part of the study." Mr. DeMarie then said, "I will try to put something together for you, Mr. Martinez, but, a lot of questions that you may have, will be incorporated in the study." Members of the Commission asked that whatever information is provided, that it be "complete." CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - APRIL 24, 2000 Page 3 of 5 PUBLIC HEARINGS C. Community Development Department Requests The Commission Consider A Third Reading Of Ordinance 707 Adopting The Proposed Town Center District Boundary And Town Center District Code. Deputy Mayor Gennell began this discussion by stating, "It says here, Third Reading - and I could have sworn that we were passing it over for the Fourth Reading." Mayor Partyka asked, "Is that correct?" Discussion then ensued on the advertising of this Ordinance. Attorney Garganese stated, "It was advertised as an Adoption Hearing." Attorney Garganese added, "It is a Fourth Reading." Deputy Mayor Gennell then asked the following of the two Commissioners that attended the Negotiations Meeting, held at City Hall, on March 30, 2000 - "In Schrimsher's agreement, where they are referencing the parks, the four little parks - It says 'those parks will include all of the right-of-way, around those parks. ", Deputy Mayor Gennell inquired whether that was "Part of your deliberations with Schrimsher at that weekday meeting?" Commissioner David W. McLeod stated that right-of-ways were brought up, "Only on one particular area, and that particular area was the area, right there, shown as seventeen." Commissioner McLeod added, "That was Edge Drive where the Trail was to come up and come along that greenbelt." Commissioner Blake said, "I almost concur with Commissioner McLeod. I do recall a discussion of right-of-ways also around #5, park #5. And in there, I believe there is specific discussion that it would not include right-of-way." Commissioner Blake then asked Attorney Garganese, "When it says all of the right-of-way, does that mean all of the right-of-way available, up to and including across the street - is counted as park acreage? Or the sidewalk area that is typical of frontage along a big parcel?" Attorney Garganese replied, "If you refer to Exhibit 'A,' Park #1, #2, and #4 show either right-of-way or sidewalks, within the boundaries of the Small Neighborhood Parks. When the acreages were calculated some time ago, the acreages included the right-of- way, or the sidewalks." Discussion ensued on how it might affect residences. Deputy Mayor Gennell said, "If we can ask Staff - how this got to be here?" Mr. Kipton D. Lockcuff, P.E. Public WorkslUtility Department Director stated, "When we initially did the acreage, we did include the roads. So, the size of the parks - the actual green space as designated by Victor hasn't changed; but, when you look at the acreage and the tract sizes, you know, that's something we came up with - us and Terry." Deputy Mayor Gennell then elaborated, "On page 6 of 21, that very specifically says, 'It's outlined on the previous page, the minimum acreage which - as I recall those figures - .44, .42, .44, .45' - are they not the ones that we discussed at our last meeting?" "The next sentence is 'These minimum acreages include all right-of-way around a perimeter,' so that means CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - APRIL 24, 2000 Page 4 of 5 you're just shrinking it all down; that they are including in that full amount - that we thought we were getting a .44 park - we're getting a .20 park." Mr. Lockcuff elaborated, "But the .20 park is what Victor's original map represented. It wasn't a .44, so we expanded it to .44 by including the roadways; so the actual size of the parks represented on the maps have not changed. It's just that the black box - what does that black box around that acreage represent? The answer - it represents the roadways and the green space." Discussion. Mr. Lockcuff added, "The size of the boxes hasn't changed, and I think that's the clarification here." Commissioner Blake left the dais at 5:54 p.m. Commissioner Martinez said, "When we discussed this at the last meeting here, on the 10t\ it was supposed to be - the dimensions were supposed to be at the bottom of page 5, and all those dimensions were supposed to be green space. Suddenly, we find that those dimensions now - are not all green space." Commissioner Blake returned to the dais at 5:55 p.m. Attorney Garganese pointed out that "The roads that are depicted on Exhibit 'A,' may not come to fruition when a development permit is issued. There is a radius test; some of those parks could move up to 250 feet, and may not include the surrounding roadways." Deputy Mayor Gennell asked what the exact size of park #2 would be - in actual footage - for the green space. Discussion ensued on future negotiations with landowners. Commissioner Martinez stated, "The language has to concur with what was agreed upon, on April 1 ot\ and that was that .44 would be green space." Attorney Garganese mentioned that "The language is just a clarification of an exhibit that we've all been going by, for a couple of months." Commissioner McLeod asked about information being provided on exhibits, such as tract size, tract locations, and names of parks. Deputy Mayor Gennell asked Mr. Micky Grindstaff, Attorney for Schrimsher Properties, about the size of parks and right-of-ways. Mr. Micky Grindstaff, 20 North Orange Avenue, Suite 1001, Orlando, Florida: said, "If you'll notice - those roads around the park, they are single lane roads, they are not the double-wide roads. And if you put a scale to it, in the beginning, when these things came out, in the very beginning, as to the size of the parks - if you put a scale to it around the park, as well as around the single lane roads that go around the perimeter of the park, that's how those acreage numbers come up." Mr. Grindstaff added that according to Victor Dover, "That little green park area, together with the open space, that's surrounded CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - APRIL 24, 2000 Page 5 of 5 in the form of single-loaded roads, is what creates this sense of field, and this sense of place, and location and the square little community park." Mr. Grindstaff then stated, "We have, among ourselves, specifically discussed that and came to grips with the scale, and that the scale included the roads - and we discussed it with - I think it was Kip, and with Dover. And, that was what it was intended to do." Deputy Mayor Gennell mentioned that, "I specifically pointed out that I thought we needed still - a provision for a buffer or wall between a residential and commercial." Deputy Mayor Gennell added that this was not addressed, under Item 12, on page 11 of the agreement. Discussion followed about waivers, and that "Dumpster enclosures should be shielded," but that open space was very desirable. Mayor Partyka added that according to his notes, "That language is exactly what we've agreed to, subject to the new 'Wall' Ordinance." Deputy Mayor Gennell added, "The new 'Wall' Ordinance sets forth in there that you can get a waiver in the Town Center." Further discussion on intensity uses in the Town Center, and the new "Wall" Ordinance. CONSENT A. City Clerk's Office Approval Of The Minutes Of The Regular Meeting Of April 10, 2000. Commissioner Martinez stated that on page 19 of the April 10, 2000 City Commission Regular Minutes, that the time that Commissioner Miller left the dais was at 2:28 a.m., and not 2:28 p.m.; and again when he returned, it was at 2:32 a.m., and not 2:32 p.m.; and these times should be corrected. Mayor Partyka advised the Commission that he would like to use the Mayoral Fund to purchase casual (polo type) shirts for members of the Commission, and City Manager Ronald W. McLemore. Mayor Partyka asked that sizes be given to the City Clerk. The consensus of the Commission was to also include names on these shirts. Mayor Partyka also mentioned that on behalf of the Commission, he had sent a letter of sympathy to the family of Commissioner A.A. "Mac" McClanahan of Sanford. III.
