Bush at 6:31 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor John F. Bush, present Deputy Mayor Michael S. Blake, present Commissioner Robert S. Miller, absent Commissioner Donald A. Gilmore, present Commissioner Sally McGinnis, present Commissioner Joanne M. Krebs, present City Manager Ronald W. McLemore, absent City Attorney Anthony A. Garganese, arrived at 6:39 p.m. A moment of silence was followed by the Pledge of Allegiance. INFORMATIONAL AGENDA INFORMATIONAL 300. Office Of The City Manager Discussion Of One Cent Sales Tax Projects. Brief discussion. Mr. Kip Lockcuff, P.E., Director, Public WorkslUtility Department introduced the subject and Mr. Terry Zaudtke. Mr. Terry M Zaudtke, P.E., CPR Engineers, Inc., 1117 East Robinson Street, Orlando, Florida: distributed documents and addressed the City Commission. Brief discussion. City Attorney Anthony A. Garganese arrived at 6:39 p.m. Discussion ensued on the different kinds of roads in the local road system. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP - FEBRUARY 7, 2005 PAGE20F6 Commissioner Donald A. Gilmore said, "Tuscawilla Road is shown as a 'Municipal Collector'." Mr. Zaudtke stated, "It should be shown as a County [Road] on that little stretch - it needs to be a wider line. I will correct that." Mr. Lockcuff added, "South of [State Road] 434." Commissioner Gilmore said, "Yes." Mr. Lockcuff suggested, "You should just carry it all the way down." Discussion. Mr. Zaudtke noted, "I bring up [State Road] 419 because it's just something that's kind of sitting out there. If we have to lobby for additional funds from the State to do some further improvements, we need to start early. These things take a long time with the State." Commissioner Joanne M. Krebs asked, "When you say early - now?" Mr. Zaudtke remarked, "Now or whenever you make your decision to move forward on this area. " Levels of service was discussed next. Mr. Zaudtke then explained that "Down here on Bahama Road, we did not have a current count so it's shown as not applicable at this time - Bahama Road is one of the roads that we want to include in the Impact Fee for paving purposes." Discussion. Mr. Zaudtke noted, "Kip [Lockcuff] just corrected - under 'Segment' - add left turn lane - at Moss Road." Deputy Mayor Michael S. Blake pointed out, "You still show the North Moss Road build-out on that previous table." Mr. Zaudtke remarked, "I put down there, 'not required/deleted' - I just listed the same project and then put in parentheses." Deputy Mayor Blake said, "'TABLE 6', page 16". Mr. Zaudtke said, "Thank you." Transportation Impact Fees was the next topic of discussion. TapeI/Side B With discussion, Mr. Zaudtke remarked, "There's a couple of roads like Orange Avenue - if you decide to build Orange Avenue, make that a Collector Road, back through the Park and then back up to [State Road] 434. You can't have a Developer build that because it spans a much larger area - I would recommend that that would stay in an Impact Fee basis. " Mr. Lockcuff explained that "We're going to bring this back as an Ordinance, unless you some specific things you're not comfortable with - probably February 28th, [2005]." CITY OF WINTER SPRINGS, FWRIDA MINUTES CITY COMMISSION WORKSHOP - FEBRUARY 7, 2005 PAGE30F6 Deputy Mayor Blake said to Attorney Garganese, "In terms of Impact Fee litigation, are you familiar with any Case Law out there where - in the case of Transportation Impact Fees, where roads have been upgraded if you will, in order to make them now applicable to the higher Impact Fees, and what effect that might have had on property yet to be developed? Have there been any Lawsuits along those lines that you know of? In other words - do we have sort of a free legislative hand here to decide what kind of a road it is? Or do we have to meet certain criteria, either now or ultimately when it is built; and have there been any successful challenges on the upgrading of a road from a Local road to a Connector road?" Attorney Garganese stated, "I'd have to look into that to see if there's any Case Law regarding - the designation of the road." Attorney Garganese added, "But generally, regarding Impact Fees, the Commission does have a wide array of discretion in terms of establishing the methodology, the amount that is imposed based on your methodology." Furthermore, Attorney Garganese remarked, "It has to be logical. There needs to be some reasonable nexus between the funds that are received and the expenditure of those funds - to accommodate the growth; and - I'll look at it to see if there is any case regarding the designation of roadways." Additionally, Attorney Garganese noted, "I think a case could be made that over - a period of time traffic patterns change and the use of roadways change which require a City to consider re-designating the roadway." Deputy Mayor Blake said, "I appreciate that we need to do that and we should do that." Commissioner Gilmore stated, "Referring to this Report, 'TABLE 4 [PROJECTED DEVELOPMENT AND IMPACT FEE REVENUE],' unit costs, single family - what's that?" Mr. Zaudtke said, "It should be $1,550." Discussion. Mayor Bush said, "If the Commission didn't raise the Impact Fees, what would be the result? How would you pay for these roads?" Mr. Lockcuff said, "That's a good question." Brief discussion. With comments on increased costs to build roads, Mr. Zaudtke advised the City Commission that, "It would be prudent to reevaluate even if you didn't change." Deputy Mayor Blake said, "You say we would need to change our Impact Fee rate and schedule due to the increase cost due to the increased cost of materials." Further discussion on Impact Fees ensued. CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP - FEBRUARY 7, 2005 PAGE 4 OF 6 Deputy Mayor Blake said, "Kip [Lockcuff], when you bring this back, it might be interesting to see - from a City standpoint, overall where we were and where we would end up - what are the total Impact Fees..." Mr. Lockcuff remarked, ".. .Not just Transportation?" Deputy Mayor Blake then stated, "...Not just Transportation." Mr. Zaudtke asked, "Do you want to include the Schools too?" Deputy Mayor Blake said, "Yes. " Commissioner Gilmore said, "We've heard the arguments for the Impact Fees, if we had to build these Collector Roads for those developments, what are the arguments against the increase in it. Better yet - what arguments are we going to hear from the Developers as to why we should not have those Impact Fees? What is the other side of the argument?" Discussion. Mr. Lockcuff said, "We'll have the answers to how much we have to raise it to just meet the current scope ofthe projects that are currently approved - what that number is." Commissioner Krebs suggested, "When you bring this back to us, can you have just a spreadsheet with just - the Impact Fees that we just talked about - on a spreadsheet, hopefully what is being charged now, and any information of who is revisiting those - as we are doing also." Mr. Lockcuff asked, "For all Impact Fees, you're interested?" Commissioner Krebs noted, "Not necessarily." Mr. Zaudtke added, "We may not be able to tell you who is revisiting those." Commissioner Krebs said, "If you know." Mayor Bush suggested, "And also if the Commission decided not to raise them, what would be the consequence in the planned growth for the City. What impact would that have?" Commissioner Sally McGinnis added, "Particularly on our Downtown." Deputy Mayor Blake said, "In the bigger packet, in the first page of the 'APPENDIX,' here it talks about - this is development data by traffic zone', it lists several Subzones and Developments within them - single family units; these numbers aren't even close to being correct. Does that matter?" Mr. Zaudtke stated, "These numbers are from Plats and what we know." Deputy Mayor Blake mentioned the Chelsea Woods subdivision and said the number was low and specifically remarked, "I believe it is either 289 or 290." Mr. Lockcuffsaid, "We can look at it." A document entitled "Renewal Of The 1 ~ Local Option Sales Tax" was reviewed next. Discussion. Regarding Winter Springs Boulevard, Commissioner Gilmore asked Mr. Lockcuff, "What's the time line on that?" Mr. Lockcuffremarked, "For Winter Springs Boulevard? That's something we have to bring back to you." Commissioner Gilmore added, "There are sections of that that are just coming apart fast now." Mr. Lockcuff said, "Yes." CITY OF WINTER SPRINGS, FLORIDA MINUTES CITY COMMISSION WORKSHOP - FEBRUARY 7, 2005 PAGE50F6 Commissioner Krebs mentioned, "Is that also inclusive of that area that when it rains, it just floods, and then your road washes away - it is kind of near where the Golf Course is too." With further discussion, Commissioner Krebs explained, "Past the 7-11." Commissioner Krebs added, "It is near the Golf Course, but coming from Tuskawilla [Road] it is near the - first entrance to the Golf Course." Deputy Mayor Blake said, "Shouldn't Gary Hillary Drive be over in 'Desired Projects?' I don't remember the Commission passing that yet." Mr. Lockcuff said, "We can show it over in 'Desired [Projects]'." Discussion. Mr. Lockcuff said, "Moss Road is a 'Desired [Projects].' I would probably put that on the undesired project, although - that is your decision, not mine. I don't see any reason - we've taken it out of the Impact Fee not needed. I would recommend it's not a high priority project." With further discussion on Moss Road, Mr. Lockcuff said, "I just don't think it's a high priority." Commissioner McGinnis said, "I don't either." Discussion. Tape 2/Side A Further discussion. Commissioner Gilmore suggested to Mr. Lockcuff, "It would be nice to have a sales program on getting people to walk on the sidewalk, instead of the street." Discussion. Regarding Traffic Calming and how well it was working, Commissioner McGinnis mentioned, "I just wondered if there was any data that showing that they were effective?" Deputy Mayor Blake noted that regarding Traffic Calming, "Your issue about maintenance of them and how they look is a valid one and I think a concern that we should take up again." Deputy Mayor Blake added, "If they are not being kept up enough, for whatever reason, then we need to revisit that as well. I know we have a City Beautification Coordinator that may need something to do." Mr. Lockcuffnoted, "I will mention it to him." Much discussion. Mr. Lockcuff said to the City Commission, "Is there anything I need to do on this Gary Hillary Drive issue to bring it back before you?" Mr. Lockcuff added, "The design is complete, so - in fact the project will be coming on the 28th so maybe that is a good time to discuss that one."
