CALL TO ORDER The Workshop of October 25, 1999 of the City Commission was called to order by Mayor Paul P. Partyka at 5:01 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor Paul P. Partyka, present Deputy Mayor Cindy Gennell, present Commissioner Robert S. Miller, present Commissioner Michael S. Blake, present Commissioner Edward Martinez, Jr., present Commissioner David W. McLeod, arrived at 5:03 p.m. City Manager Ronald W. McLemore, arrived at 5 :03 p.m. City Attorney Anthony Garganese, arrived at 5:02 p.m. Mayor Partyka and the Commission discussed what should be done, if portions of a meeting are not completed at adjournment. City Attorney Anthony Garganese, arrived at 5:02 p.m. Commissioner David W McLeod, arrived at 5:03 p.m. City Manager Ronald W McLemore, arrived at 5:03 p.m. The Commission discussed possible scenarios regarding what happens if portions of a meeting have not been discussed, and if the Mayor should be added to the rotating schedule. The Commission decided that if a meeting is adjourned with one (1) or more Agenda Items not discussed, then such items will be continued to the next meeting. If the Items not discussed are one (I) or more "Reports", then, the individual(s) who were not able to speak, will speak under their seat(s) at the next regular meeting. WORKSHOP AGENDA Discussion Of General Issues Pertaining To The Various Agenda Items Scheduled For The Regular Meeting Of October 25, 1999 Mr. Jim Lentz, Financial Advisor for the City of Winter Springs spoke to the Commission regarding current bond rates. Discussion. Mr. Mike Williams of Carlton Fields, as Bond Counsel to the City of Winter Springs addressed litigation issues; NationsBank; market changes; the complaint filed; that NationsBank will not buy the Notes; and related timelines in respect to the lawsuit filed. Mr. Ronald W. McLemore, City Manager spoke on increased construction costs; the potential costs of the validation hearing; the possibility of re-bidding this project; delays; the potential problems if we are forced to wait; the costs if we do or don't proceed; and litigation issues. The Commission then discussed the bond market; potential costs; the terms of the contract; litigation issues; the possibility of having to re-bid this contract; the time involved with the validation process; legal advice; the related timing of certain actions; and municipal obligations. Discussion ensued regarding the contractors' specified fees, mobilization costs; this being a risk management issue for the City; "build-out" time; protecting the dollars; the planned Oak Forest wall; the possibility of having to build other walls if necessary; increased costs; "People for Good Government" (Political Action Committee); the two (2) individuals which have petitioned the Courts"; "obstructionists" who are trying to "de- rail" the proposed district; related legal fees and costs; and the costs that have already been incurred. The Commission discussed if the City was abl~ to (legally) respond in writing, either via a flyer and/or a press release, under the Mayor's hand, to address any written propaganda such as the possible "petition". Members of the Commission discussed whether the Mayor should write a type of "press release" to inform the public. The Commission then discussed other projects that the City is working on, such as the "Village Walk; the "Quads"; parks; and the infrastructure of the planned Town Center. Tape l/Side B The Commission further discussed monies in relation to the lawsuit; and reserve funds. Manager McLemore suggested that an informative statement could be added to the City's Newsletter; to be followed by a more in-depth letter.
