CALL TO ORDER The Workshop of the City Commission was called to order by 1 in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, and Florida 32708). City Manager Requests the Commission Receive A Report on the Standstill Agreement Dated May 10, 1999 With Schrimsher Properties. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP-JULY 13, 1999 Page 2 of 3 Mickey Grindstaff, 20 North Orange Avenue, Suite 1000, Orlando, Florida 32801 as the Attorney for the Schrimsher organization, he spoke on some previous history regarding Ordinances, they were denied access to elected officials individually, a companion agreement. Letters from Dover Kohl Discussion on documents from past meetings and a discussion with a Mr. Snelling this meeting. Mayor Partyka said for the record," Let the record show one thing from my stand point I have talked to Schrimsher and I've talked to Mr. Joshi, a number of times, my interpretations is that I can do that and I've done it so let the record show that". Mr. Grindstaff further spoke on the companion agreement; making progress; quality development in the "core" of Winter Springs; and read from the companion agreement; Myths and realities; relocating the trail; dates; being dismissed; realigning the trail; utilities - can this be placed in writing for the users; There was discussion on utilities; related costs, and "gaps". Michael Schrimsher spoke on stubbing in utilities and building permits. Financial incentives; Manager McLemore said he would be willing to re-write this. The Commission was asked about their impressions of both standpoints, especially regarding utilities; and negotiations. Tape I/Side B Entering into an agreement to sit down and be a part of something; Where the burden falls; having the Schrimsher, come sit down and discuss this further And the full document of the Town Center - it needs to go back to staff little further - bring back the issue that truly need to be resolved. And put off the next reading of this on Monday evening; previous meetings; potential future meetings; Such as the City purchasing certain properties; agreements; the companion agreement; The Schrimshers as the developers; the meetings with staff; the meetings with the commission at commission meetings; Discussion on meeting with staff and the Schrimshers on this document previously before us; hours expended on this process; correcting the "lopsided agreement"; Mr. Schrimshers' mindset for developing this property; CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP-JULY 13, 1999 Page 3 of3 The commission was asked for their preference for future preferences - postponing the 2nd reading of this Ordinance; It was suggested that Mr. Joshi discuss his subject at the next City Commission meeting. Standstill agreement and postponing it for a future meeting. Deputy Mayor Gennell said, "I'd like to go on the record, as saying that I have in fact read this letter several times and I find sometimes that your comments are offensive and insulting and that does very little I think in a process like this where we are trying to look for goodwill and we are not finding it. With all due respect I mean I find some of your comments occasionanIy offensive and I don't know if any of us up here're illicit that kind of stuff but anyllIow, having said that let it go." Brief discussion. Some very innocuous things. To that extent I would support some agreement of intent, - to work together-I'm not committing on this. Deputy Mayor Gennell - no more workshops on this, and ok to have a mutual intent between the city and the Schrimshers; and other cities incentives; flexibility; an agreement of intent. Standstill agreement dates, and what the Commission wants to do Manager McLemore spoke of what he has been aware of regarding Development Agreements; and it can't be this document. Manager McLemore asked that the Commission let him draft an agreement that the Commission could commit to, without it being a burden for the taxpayers. Mayor Partyka spoke on the positions taken by both parties; and that we need to make a counter offer negotiations; no second reading until three weeks from now. - Planned for September 13th. Mike Schrimsher said for the record, No, I think we would have been better had we been able to get through as were proceeding with our presentation but I see the time is late and so we have to stop. ADJOURNMENT Mayor Partyka adjourned the Meeting at 11 :20 p.m.
