CALL TO ORDER The Workshop of the City Commission was called to order by Mayor Paul P. Partyka at 6:37 p.m. in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). ROLL CALL: Mayor Paul P. COMMUNITY DEVELOPMENT DEPARTMENT/CODE ENFORCEMENT DIVISION REQUESTS THE COMMISSION HOLD A WORKSHOP REGARDING THE COMMERCIAL VEHICLE ORDINANCE Mr. Charles C. Carrington, AlCP, Community Development Director, informed the Commission that he would speak on behalf of Ms. Jimette S. Cook, Code Enforcement Officer. Mr. Carrington stated that Section 20-431. had been revised to read, "No person owning, renting or leasing real property in a residentially zoned district shall cause or allow to be parked on any residential property a commercial vehicle as defined in Section 20-432.". Section 20-432. was more specific and would require input from the Commission. Mayor Partyka called a ten (10) minute recess. Mayor Partyka reconvened the Workshop. Mr. Carrington reviewed Section 20-432. of the draft Ordinance. He stated that Section 20-432. defined commercial vehicles and read the definition from the draft Ordinance. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - MARCH 15, 1999 Page 2 of 4 The Commission discussed descriptions of vehicles weighing over 10,000 pounds. Commissioner David W. McLeod provided those present with copies of photographs that depicted various commercial vehicles, along with those that are classified as commercial vehicles by the State of Florida. The photographs were helpful in terms of depicting weight and length criteria. There was discussion about changing the permitted length to twenty-two (22) feet instead of twenty-one (21) feet. The Commission then discussed the gross weight of vehicles; government standards; manufacturer ratings; and exempting pick-up trucks. At this point in the Workshop, the Commission reviewed the definitions in Section 20- 432.; and the Commission was asked to give direction to Staff, who would then prepare a model Ordinance and bring it back to the Commission. Mr. Ronald W. McLemore, City Manager, advised the Commission that the intent of this meeting was to see if Staff had accurately interpreted the Commission's direction. Tape I/Side B There was further discussion regarding the definitions in the draft Ordinance; the time frame for enforcement; carrying capacity; and the weight, length and height of pick-up trucks. Mayor Partyka called a ten (10) minute recess. The meeting was reconvened by Mayor Partyka. The Commission next discussed differentiating between commercial vehicles and non- commercial vehicles. Attorney Guthrie was asked if the rules of a Homeowners Association overrided an Ordinance, and if they are more stringent. Attorney Guthrie responded that they would indeed override an Ordinance in such a case. Tape 2/Side A The Commission offered suggestions on where vehicles should be parked; how the public could be involved with the development of this Ordinance; time frames for enforcement; and Referendums. The Commission then reviewed Section (1) of Section 20-432. of the draft Ordinance, in depth. Mr. Carrington clarified several points of the Ordinance, and then stated that the Ordinance excluded commercial vehicles as long as the vehicles are under a certain weight; not over a certain length; and that no tools and equipment were visible. CITY OF WINTER SPRINGS MINUTES CITY COMMISSION WORKSHOP - MARCH 15, 1999 Page 3 of 4 Manager McLemore stated that the main issues for the Commission to deal with at this meeting, was if they wanted to allow one commercial vehicle per residence; and for what time frame this should be permitted. The current Ordinance does not allow any commercial vehicles to be parked within the City. Tape 2/Side B The Commission further discussed these issues. The Commission agreed by consensus to allow one commercial vehicle that conforms to the Code, to be parked at a residence for three (3) years, but then the vehicle should be placed in a garage or behind a six-foot fence, (behind the building line). This length of time would allow residents to meet the Code requirements. Discussion about the issuance of permits for the parking of the commercial vehicles, for the three (3) year period was next discussed. The majority of the Commission agreed to issue permits for the three (3) year period, per the requirements that will be outlined in the Code. Discussion ensued on the length, weight and height of commercial vehicles. The Commission was in agreement to not allow a commercial vehicle to exceed twenty two (22) feet in length; to allow the height to be no more than eight (8) feet; and to allow the commercial vehicles to have a one (1) ton rated load limit or 11,000 pounds gross vehicle weight, which ever is greater. The Commission next discussed of Section 20-432. (2), pertaining to the length of trailers or semi-trailers. The Commission asked that this section distinguish the differences between commercial trailers and recreational trailers. Several Commissioners felt that the twelve (12) feet should be the "bed size" (or storage area) only and that the "tongue hitch" would not be included in the twelve (12) feet. Section 20-432. (5) was then discussed. It was suggested to change the words "hazardous waste" to "hazardous or noxious substances or materials". This was agreed to by the Commission. Regarding Section 20-432. (2), several Commissioners felt that the overall length of the trailer should not exceed twelve (12) feet, including the "tongue hitch". The majority of the Commission agreed to keep the length of the trailer twelve (12) feet, and that the twelve (12) feet would be the "bed size" (or storage area) only. Mayor Partyka opened the meeting to "Public Input". Marianne Lampone, 202 Cottonwood Drive, Winter Springs, Florida: spoke about the behavior of some of the Commissioners; and the proposed Ordinance, as it pertained to trailers. (Tape 3/Side A) The Commission next discussed Section 9-272. of the draft Ordinance, which pertained to off-street parking of commercial vehicles. Mr. Carrington stated that the intent of this section was to eliminate the parking of trailers, semi-trailers, and/or cabs on a site that is not owned by the business. The consensus of the Commission was to add the words "off site" to the section; and to note that cube vans would be eliminated. Mayor Partyka said that the Commission should receive a copy of the model Ordinance for review, and that the Commission would discuss whether or not to hold another Workshop at a future Commission Meeting. Mayor Partyka noted that there would be a Special Meeting (tomorrow) on March 16, 1999, beginning at Noon to discuss Town Center issues. III.
