Raymond Construction Remove Block Wall Sidewalk Jesup's ReserveCOMMISSION AGENDA ITEM 601 March 24, 2008 Meeting CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X MGR /DEPT ,~/ i~ Authorization REQUEST: Public Works Department requesting the City Commission's authorization to enter into an agreement with J. Raymond Construction to remove a portion of an existing block wall from the public sidewalk along SR 434 at Jesup's Reserve PURPOSE: The purpose of this agenda item is to request the City Commission's authorization to enter into an agreement with J. Raymond Construction for $9,500 to remove a portion of an existing block wall from the public sidewalk along SR 434 at Jesup's Reserve. CONSIDERATIONS: • Levitt & Sons, the builder for Jesup's Reserve, was required by Developer's Agreement to construct a 6-foot screen wall along the western property line of the subdivision, immediately adjacent to the recently constructed West End Center office building property. • Levitt & Sons obtained a building permit for the 6-foot screen wall, and the wall has been constructed but not accepted by the City (see Exhibit A). The wall was not constructed in accordance with the building permit or the approved final engineering plans for Jesup's Reserve. As constructed, the wall encroaches into the 10-foot wide sidewalk easement along SR 434 frontage, an area that was to be reserved for the public sidewalk. • The 10-foot wide public sidewalk along the Jesup's Reserve and West End Center SR 434 frontage is located within the first 10-feet of each property, outside of the FDOT right-of--way. • The City notified Levitt & Sons in August 2007 that the end of the wall was built approximately 10-feet closer to SR 434 than was shown on the approved plans. Levitt's field representative acknowledged the error and agreed to modify the wall at Levitt's 032408_COMM_Regular_601_Remove Wall from Public Sidewalk at Jesups Reserve Agenda Item 601 March 24, 2008 Page 2 expense per the approved plans. However, in October 2007, Levitt & Sons abandoned Jesup's Reserve and the wall has not been modified as required. • In October 2007, the City prepared a punchlist of incomplete and/or incorrectly constructed items and initiated the legal process to have these items completed under the performance bond on file at the City. As of March 17, 2008, the extent and timing of the work that can be completed under the performance bond claim is unknown. • As currently constructed, the wall encroaches into and significantly obstructs the 10-foot wide public sidewalk (see Exhibit A). The wall conflict has prevented the West End Center contractor from completing the 10-foot wide sidewalk connection between Jesup's Reserve and West End Center as planned. The continuity of the 10-foot wide sidewalk and the planned double row of trees is an essential component of the design for both Jesup's Reserve and West End Center. Since this is the public sidewalk, Staff recommends removing the wall at the City's expense and pursuing reimbursement through the performance bond claim or through direct reimbursement from the Jesup's Reserve developer. • Staff requested and received a price of $9,500 from J. Raymond Construction to repair the wall and bring it into compliance with the approved Jesup's Reserve plans. J. Raymond is the current general contractor for the West End Center. The work generally consists of demolishing the final 10-feet of the existing wall and constructing a stone column at the new end of the wall. Construction necessary to complete the sidewalk connection and make up the grade differential between Jesup's Reserve and West End Center is entirely the responsibility of the West End Center development and is not being funded through this request. • The wall is located in a sidewalk easement dedicated to the City by the Jesup's Reserve plat. All work will be performed within the sidewalk easement. FUNDING: The funding source for this repair to the public sidewalk is the Roadway Improvement Fund, #115. Staff intends to pursue reimbursement for the full $9,500 through the performance bond claim for Jesup's Reserve or through direct reimbursement from the Jesup's Reserve developer. RECOMMENDATION: Staff recommends approving $9,500 to remove the portion of the wall interfering with the public sidewalk. ATTACHMENTS: 1.
