HomeMy WebLinkAbout_1998 07 16 City Commission Special Minutes SPECIAL MEETING CITY COMMISSION JULY 16, 1998 The Special Meeting of the City Commission was called to order by Deputy Mayor Cindy Gennell at 3:00 p.m. ROLL CALL: Mayor Paul P. Partyka, absent Deputy Mayor Cindy Gennell, present City Manager Ronald W. McLemore, present Attorney Robert Guthrie, present COMMISSIONERS: Robert S. Miller, present Michael S. Blake, absent Ed Martinez, Jr., present David McLeod, present The Special Meeting was moved from the Commission Chambers to the City Hall Conference Room as there was work being done in the Chambers. The receptionist was notified of the change in location to direct the public to the correct room. Deputy Mayor Gennell convened the Special Meeting at 3:05 p.m. Commission went into closed executive session. Attorney Guthrie announced the attendance at the Closed Executive Session in the case of Partyka vs. Blake, Gennell, et. al. and the City of Winter Springs, and those being: Deputy Mayor Cindy Gennell, Commissioners Miller, Martinez, and McLeod, Attorney Guthrie, a court reporter. Deputy Mayor Gennell reconvened the Special Meeting at 4:07 p.m. Deputy Mayor Gennell called a recess at 4:08 p.m. Deputy Mayor Gennell reconvened the Special Meeting at 4: 19 p.m. Attorney Guthrie stated that the Commission has to decide to appeal the decision rendered by the trial Judge in the case styled Partyka vs. City and Commissioners. Attorney Guthrie stated that the Commission would need to determine if it was in the public interest to pursue this appeal. Attorney Guthrie recommended that if the Commission determines to pursue the appeal and that he recommends the City hire Attorney Arthur England from the law firm of Greenburg Traurig. Attorney Guthrie stated that he has spoken with Attorney England and said Attorney England would be glad to represent the City at a sum of $20,500 plus out of pocket expenses. An agreement would be presented to the City. Discussion. '. Motion was made by Commissioner McLeod that the Commission finds it is the public interest to expend the funds in the amount of $20,500 plus out of pocket expenses and hire the law firm of Greenburg Traurig to appeal the Judge's decision. Seconded by Commissioner Martinez. Discussion. Vote: All aye. Motion passes. The Commission decided to give a courtesy call to Holland Knight informing them that the City is using another law firm. It was decided that the Deputy Mayor will sign the contract with Greenburg Traurig The Commission said they wanted to be kept "posted" on the activity of this issue and to use their home addresses. III. Parks and Recreation Department Request the Commission to approve the date of September 5, 1998 for the rescheduling of July4th Holiday at Home at Central Winds Park: Discussion on rescheduling the July 4th Holiday at Home at Central Winds Park. Motion was made by Commissioner McLeod to cancel the fire works for this year. Seconded by Commissioner Miller. Discussion. Vote: All aye. Motion passes.
