Authorization The Community Development Department recommends the City Commission consider keeping decorative streetlights that were installed in error on Vistawilla Drive as part of the Tuscawilla Lighting and Beautification District (TLBD) Ph2 Beautification Project at a cost of $240 per month to the City. PURPOSE: The purpose of this agenda item is for the City Commission to consider keeping decorative streetlights installed in error by Progress Energy located outside of the TLBD Ph2 Project Boundaries on Vistawilla Drive. CONSIDERATION: On April 13,1998, the City Commission adopted the City Standard Streetlight consisting of (1) one non-decorative 30-35' concrete pole attached to (1) one basic IOOw cobra fixture. This streetlight configuration currently has a cost of $12.64 (January 14, 2008 -Consent 203) per month and is provided by the City as a minimum lighting standard along public roadways throughout the City of Winter Springs. 021108_COMM_Regular_603_Vistawilla_Deco_Streetlights_Request On February 14, 2005, the Commission approved Agenda Item 401 and adopted Resolution 2005-40, approving assessment rates and capital improvements for the TLBD PH 2 Beautification Project. The TLBD Ph2 Project, as approved, consists of installing decorative streetlights and street signs along roughly 12 miles of roadway within the Tuscawilla Subdivision under the assessment authority of TLBD. In early October 2007, Progress Energy installed decorative streetlighting along Vistawilla Drive as part of the TLBD Ph2 Project. Four (4) decorative streetlights (3 with dual globes) were installed by Progress Energy in error, located outside of the TLBD Assessment District boundaries between State Road 434 and the Tuscawilla entrance monument adjacent to Eagles Watch HOA. Due to rules and regulations under which the City must operate a Special Assessment District, payment for decorative streetlighting located outside of the scope of TLBD funding authority is not permissible. Seeing obvious benefits to keeping the new decorative streetlights on Vistawilla Drive, Staff has approached representatives of the Tuscawilla Homeowners Association, Howell Creek Reserve HOA, Eagles Watch HOA and several private businesses served by Vistawilla Drive; to potentially reach an agreement to share the ongoing costs of maintenance for the additional streetlights. In spite of strong public opinion in favor of the decorative streetlights remaining, and an enhanced safety benefit accruing to the community, no private parties have come forward to offer financial support. As a concession, Progress Energy has offered to waive two (2) years of billing (valued at approximately $5,800), if the City decides to keep the four (4) additional streetlights. After two (2) years, the streetlights would be billed at the rate in effect at the time billing begins to the City. There are several cases where the entire cost of decorative streetlighting has been paid from the City's General Fund (Streetlighting), thereby setting a precedent and potential grounds to do the same with additional decorative streetlighting on Vistawilla Drive. 021108_COMM_Regulaz 603_Vistawilla_Deco_Streetlights_Request Examples include the following public streets: Highlands HOA - Sheoah Boulevard Gary Hillery Drive Glen Eagle HOA - (All streets prior to recent upgrade by HOA) FUNDING: Arbor Glen HOA -Arbor Glen Circle Winter Springs Town Center - Tuskawilla Road - Doran Drive -Blumberg Boulevard There would be no additional funding required for the four (4) decorative streetlights installed by Progress Energy in error on Vistawilla Drive until FY 2010, at which time the cost would be approximately $240 per month from the Streetlighting Fund. STAFF RECOMMENDATION: Staff recommends the Commission decide whether to keep the four (4) decorative streetlights on Vistawilla Drive which were installed in error by Progress Energy, located outside of the boundaries of TLBD Assessment District, at a cost of $240 per month paid from the Streetlighting Fund (1526-54312) beginning in FY 2010 or if the Commission would like the streetlights removed by Progress Energy at no cost to the City. Staff also recommends the Commission consider the fact that no re-occurring revenue source has been identified for the additional (permanent) expenditure for the decorative streetlights and requests the Commission to decide on how to fund the cost.
