Torcaso at 7:30 p. m. Roll Call: Mayor Philip A. Kulbes, absent Deputy Mayor John V. Torcaso, present City Manager John Govoruhk, present City Attorney Frank Kruppenbacher, present Commissioners: Don Jonas, present John Langellotti, present Terri Donnelly, present Cindy Kaehler, present For the invocation Commissioner Langellotti asked for a moment of special prayer, especially for our Mayor Philip A. Kulbes. The pledge of allegiance to the flag was led by Commissioner Cindy Kaehler. Motion was made by Commissioner Jonas for approval of the minutes of August 9, 1993. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Kaehler, aye; Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; motion carried. Public Comment: Paul Partyka, Oswego Court, Tom Brown, Adidas Road and Richard Coniff, Royal Oak Drive, spoke to the Commission. Mr. Partyka said he provided the Commissioners a copy of all the current data on the Tuscawilla area maintenance issue. He said they are asking the Commission to review this new information and pass the assessment ordinance. Deputy Mayor Torcaso said he wanted to be on record that he is against taxing people that do not want to be taxed and he said he cannot see the Commission taxing people for the maintenance of private property. Dick Denny, Pebble Beach Circle West, commended Officer Flanagan of the Winter Springs Police Department for his assistance to the widow of a neighbor who just recently died. Mel Glickman, Aberdeen Court, asked about the blue reflectors that point to water connections. Chief Lallathin was asked to look into the cost of this. Parking of RV on Residential Property-K.D. Edelen (letter dated 8/4/93): Motion was made by Commissioner Kaehler to approve the permit to park an RV on residential property for Mr. Edelen for one year. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; Commissioner Kaehler, aye; motion carried. Commissioner Kaehler pointed out that Mr. Edelen asked if the request could be approved for an indefinite time, but that cannot be done according to the Code. Resolution No. 713, Lot Split-Lot 11, N. Orlando Ranches Sec. lB, etc.: Attorney Kruppenbacher read Resolution No. 713 by title only. Motion was made by Commissioner Langellotti to approve Resolution No. 713 having been read by title only. Chelsea Parc at Tuscawilla Phase II - Approval/Disapproval of Covenants and Plat: Motion was made by Commissioner Donnelly to approve the covenants and plat of Chelsea Parco Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Kaehler, aye; Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; motion carried. Second Reading of Ord. No. 547, creating a new Chapter of "Codes Enforcement Citations", providing for a supplemental method of enforcing City codes and ordinances; providing intent; providing definitions, etc.: Attorney Kruppenbacher read Ord. No. 547 by title only on second reading. Commissioner Kaehler asked what is Sec. 943.085, and on page 4, last paragraph, the words "has a right or" were deleted. On the Sections Commissioner Kaehler asked the titles be clarified on cast periodicals (16-27(b); Grass Neat and Trim (13-2(c), Failure to notify Fire (7-1). She also pointed out we have site plan violations as Class I and Class III and she explained they both should not have the same title. On page 8 Section e Commissioner Kaehler suggested the person receiving the citation should be given that information verbally or in writing so when they do get fined they cannot come back and say they were not told. This ordinance will be set for public hearing for 9/27/93 and Attorney Kruppenbacher will make those changes. Motion was made by Commissioner Jonas to approve Ord. No. 547. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, no; Commissioner Kaehler, aye; motion carried. Discussion of Ord. No. 548, proposing an amendment to the Charter of the City to amend the article of the Charter pertaining to election terms, etc. Two different ordinances: Attorney Kruppenbacher recommended Commission accept the ordinance with the three term consecutive and allowing the voters to maintain the right. Commission was in agreement for the Attorney to read Ord. No. 548 by title only. Attorney Kruppenbacher read Ord. No. 548 by title only as follows: An Ordinance of the City of Winter Springs, FL proposing an amendment to the charter of the City of Winter Springs to amend the Article of the Charter pertaining to Election terms to provide for a term limitation for the Mayor and each City Commissioner to three consecutive terms; providing for severability and conflicts; providing for an effective date. On Page 1, Ballot date would be November 2, 1993 and second page, effective date would take effect in accordance with Florida Law as soon as it can take effect once its been adopted by the electorate. Motion was made by, Commissioner Donnelly to accept Ord. No. 548. Seconded by Commissioner Jonas. Discussion. No. 549, adopting the Municipal Budget for the Fiscal Year 1993-1994, etc.: Motion was made by Commissioner Kaehler to read Ord. No. 549 by title only. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Donnelly, aye; Commissioner Kaehler, aye; Commissioner Jonas, aye; Commissioner Langellotti, aye; motion carried. Attorney Kruppenbacher read Ord. No. 549 by title only. Public Hearing will be set for September 27, 1993. First Reading of Ord. No. 550, relating to Emergency Management Powers; creating Sec. 8.1 through 8.16 to provide for the exercise of the emergency powers of the City during a state of emergency, etc.: Motion was made by Commissioner Kaehler to read Ord. No. 550 by title only. Seconded by Commissioner Langellotti. Discussion. Election Proclamation for the Municipal Election November 2, 1993: Deputy Mayor Torcaso read the Election Proclamation proclaiming November 2, 1993 Election Day for the purpose of electing a Mayor, a Commissioner Seat/District 2 and a Commissioner Seat/District 4. Attorney Kruppenbacher recommended a motion be made authorizing him to read Ord. No. 548 by title only. Motion was made by Commissioner Donnelly to authorize the Attorney to read Ord. No. 548 by title only. Seconded by Commissioner Kaehler. Discussion. Vote on the motion: Commissioner Jonas, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; Commissioner Kaehler, aye; motion carried. Attorney Kruppenbacher read Ord. No. 548 by title only as follows: proposing an amendment to the Charter of the City of Winter Springs to amend the Article of the Charter pertaining to Election Terms to provide for a term limitation for the Mayor and each City Commissioner to three consecutive terms; providing for severability, and conflicts; providing for an effective date. Additionally adopting those comments that we made in regard to the inserts of dates, the effective date previously stated by the Commission. Motion was made by Commissioner Donnelly for adoption. Seconded by Commissioner Kaehler. Discussion. Vote on the motion: Commissioner Langellotti, no; Commissioner Donnelly, aye; Commissioner Kaehler, aye; Commissioner Jonas, aye; motion carried. Discussion of Resolution providing for payment to members of the Boards of the City etc.: After discussion Commission decided to pay on a per meeting basis $15.00. It would be stated in the resolution the board members would have the right to waive their compensation. This would be for the Planning & Zoning Board, Board of Adjustment Code Enforcement Board and Beautification of Winter Springs Board. The Commerce . Deputy Mayor Torcaso called a recess at 8:45 p.m. and called the meeting back to order at 8:50 p. m. City Manager John Govoruhk: Monthly reports have been distributed. cutoffs.Manager Govoruhk said he would next meeting. Commissioner Kaehler asked about the 90 speak about the garbage complaint at the Manager Govoruhk explained that Fire Station No.2 has been added to CPH's Continuing Contract and they have sub-contracted with the architect who designed the Altamonte Fire Station. We received permission from Altamonte Springs to utilize their design, with modifications. Using this method will save approximately six to ten thousand dollars. This is subject to legal review. Commission Seat IV - Terri Donnelly: Commissioner Donnelly asked for the road maintenance costs in the Ranchlands. Commission Seat V - Cindy Kaehler: Commissioner Kaehler said the Commerce & Industry Board needs to be congratulated on their excellent brochure. . Commission Seat II - Don Jonas: Commissioner Jonas asked that the City Manager applications be put on the next agenda for discussion. Commission Seat III - John Langellotti: No report. Norton . . 4 August 1993 City Commission City of winter Springs 1126 East State Road 434 winter Springs, FL 32708 On August 10, 1992, the Commission approved my permit to park my RV on my residential property for another year. The request was in accordance with the City Code which requires the permit be renewed annually. In keeping with the requirement of the City Code, I hereby request my permit to park my RV on my residential property be renewed for another year. Additionally, I ask the Commission to renew my permit for an indefinite period so it will not be necessary to request a renewal each year. . The situation has not changed that existed a year ago when the Commission approved my permit. My neighbors are the same;, my RV is parked in my back yard behind a 6-foot privacy fence; it is not readily visible from the front of the house; does not detract from the appearance of the neighborhood; and does not interfere with any of my neighbors while parked, being removed from or being backed into my backyard.
