Section 20-358(b) of the Code requires that the Commission hold a Public Hearing on the matter. This is the purpose of the meeting on this date. A public hearing may be held on January 14, 1991 if the Commission is in agreement on this date. Florida Land Company's project is highlighted in yellow on the aerial. The Shepard Road Connection was approved by the City Council on August 29. 1977 and the connection is to be made as development occurs. Please see attached Staff comments on this request. The Engineering Department takes a neutral position as to whether the road should be constructed or not. Please note that the engineering drawings with paving and drainage, sanitary sewer and water distribution, was submitted to the City for approval on September 11, 1973. I personally measured certain distances of travel between significant points in the Highlands from Fire Station One or. Moss Road. There is a signif- icant difference in distances of up to a full mile between points depending on whether or not Shepard Road is allowed to go through. Proposed New Project .1 Mile MacGregor In addition to the above, the fire department response area includes Wild- wood and other locations in that vicinity which includes the intersection of Shepard Road and US Highways 17 and 92. Travel distances range from 2.7 miles via SR 434 and US 17 and 92 to 2.4 miles via Sheoah Boulevard as opposed to 2.1 miles by way of the proposed Shepard Road route. e e e Land Development Coordinator Deletion of Shepard Road - Highlands PUD Page Two While the differences in distances may not seem to be great it must be considered that heavy equipment, i.e., fire trucks and rescue units will be making these trips and do not travel as fast nor are as maneuverable as a sedan or other lighter and smaller vehicles. The measurable distances are extremely valuable for two reasons: Travel time and alternate routes. Presently there is only one route for emergency vehicles to reach the interior of the Highlands. The response time to the far reaches of the Highlands PUD is as much as seven (7) minutes while the average response time city wide is three and one half (3.5) minutes. To permanently delete Shepard Road from the Highlands PUD is detrimental to the safety and well being of the current and future citizens of that commun- ity. Such deletion will create another IIdeep pocketll in the city that isolates citizens from each other and creates delays in responding to emergency situations. As the Chief of a department which is responsible to provide fire suppress- ion and emergency medical services to citizens, the deletion of Shepard Road from the Highlands PUD is considered to jeopardize those citizens. CLH/pjs e e e October 30, 1990 TO: Planning and Zoning Board SUBJECT: Shepard Road in the Highlands Shepard Road is an important link in the limited collector road system of the western area of Winter Springs. As one of ~ collector roads planned to support a 641-acre developnent, it functions to carry traffic from the local streets in the Highlands to and from arterial highways that form a triangle around the PUD and allow easy access for residents to travel in all four directions of the metropolitan area. It is a well-conceived design. Winter Springs needs to complete all planned collector roads and construct additional ones to ensure adequate traffic circulation for its citizens in the future. To eliminate one would be a self-defeating action. If Shepard Road were not completed through to Edgemon Avenue as a full-fledged collector road with no residential driveways, this would repeat the mistakes made south of S.R. 434 where three collector roads deadend short of any direct connection to other collector or arterial roads to the south. The City plans to correct this situation by completing two or more paved connections down to Seminola Boulevard and Lake Drive so that those residents may have a convenient alternative to always using S.R. 434. The people who live in the Highlands at large deserve the same efficient traffic circulation options. The City's transportation consultant, in his study of our existing traffic circulation (1989), forewarns us that as growth continues we are facing serious traffic congestion problems due to our minimal collector road system. To consider deleting Shepard Road then would be detrimental to the residents and beneficial only to the developer, whose construction costs would be reduced. Further, if the Shepard Road right-of-way were diverted to connect only to MacGregor Road to the south, an unsound traffic design would result. This connection would direct collector road traffic down a local street with 72 residential driveway cuts. And even beyond that hazard, traffic moving between MacGregor Road and S. R. 434 would necessar 11 y use either Sheoah Boulevard or one of the local streets in the North Orlando area, neither of which routes should be impacted by additional traffic: the Sheoah - S.R. 434 intersection at the Elementary School is not a proper place to dump traffic designed to travel eastward to Edgemon Avenue; neither would it be acceptable to load Banbay Avenue with that traffic. Shepard Road is designed and so far has been bull t to proper collector road standards, with no residential driveway cuts, and should be completed as such. e e e Planning and Zoning Board October 30, 1990 Page 2 To redirect Shepard Road to avoid connection with its intended outlet arrl instead create hazardous situations on local residential streets arrl at a school crossing is not a valid option. Besides traffic efficiency and safety, the planned Shepard Road connection to Edgemon Avenue serves two civic functions. By this route, young people and seniors will benefit fran a shorter trip to Sunshine Park arrl City emergency vehicles will have a faster response time to the northern area of the Highlands. As to the conjecture that the Edgemon Avenue connection will draw additional outside traffic through the Highlands, study of the map of this area of Winter Springs demonstrates this concern is not valid. In the event an Officer is on 17-92 and receives emergency (burglar- prowler-fire-rescue) 9-1-1 calls on the North section of 434 thru 419, then there is a long delay for response, which has and will happen more frequently due to population, and traffic growth. This alternate route, will decrease response considerably which can mean saving a life, be it a citizen or Officer in need of help and/or may result in the apprehension of criminals. The extension would also mean more effective patroling of the area. Concern of traffic problems that this could cause would be monitored by the Traffic Division of Winter Springs Police Department and a few well placed speed limit stop signs. Because of the density of this project it is imperative in the interest of public safety thut all four access points be open, i.e., S.R. 434, Alton Road, Sailfish Road, and Trotwood Boulevard for entry and egress. The current and foreseeable future of the excess traffic flow, tie ups, and frequent blockage of S.R. 434 will cause residents as well as public safety and service units to be blocked from entry or egress from the project. This City is already plagued with too many IIdeep pocketll communities with limited access points. Eagle Ridge is entirely too large for such limit- ed access. I cannot, in good conscience vote in favor of this project until all available access points, as indicated, are open. The Fire Marshal IS comments are also attached for your information. It is our recommendation that the following streets be through streets into and out of the project; Trotwood Boulevard Sailfish Road Alton Road State Road 434 With only one entrance/egress route in the project, a great many people could become trapped therein should a major incident take place which blocked the one escape route. Not only does the possibility exist of people being trapped within the project, but the fire department apparatus could also be blocked from entrance. December 6, 1990 TO: Land Development Coordinator FROM: Director of Administrative Services/Comprehensive Plannin~ SUBJECT: Final Engineering for Eagle Ridge Thennal engineering for Eagle Ridge includes all the requirements noted on the approval of the preliminary plan regarding road configuration and open space. e The fact that the developer is presenting the engineering for the entire subdivision, rather than Phase I alone, raises some issues at this time: (1) The plans and plats presented include all of the park and conservation land to be dedicated to the public. When asked whether these areas could be dedicated at one time rather than piecemeal as each phase is platted, the representative committed to dedication of all public lands concurrent with platting of Phase I. However, no timetable for actual development is certain, so when the City will acquire the property (especially the 20 acres at Alton Road for an active park) is unknown. It was stated that prededication now is impossible because of the complicated status of ownership of the land. (2). The developer's agreement, paragraphs (h) and (i), stipulate that decisions on the potential Trotwood and Alton Road connections will be made "at such time as that particular phase....is presented to the City". Since final engineering approval constitutes a development permit, these roads should be discussed now, not at platting. (3) Approval of all the final engineering at this time would vest the development with respect to concurrency as long as construction proceeds in accordance with the time limitation prescribed in the land development code. If no construction occurs prior to expiration of the engineering approval, which would fall after the effective date of the concurrency management program in the new comprehensive plan, any authorization of an extension would have to be in compliance with concurrency requirements. . /crn --- . PlanninR & Zonin2 Board Recommendations of Nov. 23. lqRR. 434 Partnership-Preliminary Engineering: The Land Development Coordinator, Don LeBlanc, explained the Planning & Zoning Board recommended approval with the stipulation that the Trotwood Boulevard connection be deleted from the City's Comprehensive Plan and _recommended that only lots 394 thru 400 be granted outlets onto Trotwood Boulevard. Mr. Donald McIntosh, of Donald W. McIntosh & Associates, a professional engineering planning and surveying firm gave a brief overview of the project. The project is presently proposed for 400 lots on the less than 400 acres with over 200 dedicated to conservation and parks with a collector road proposed through the center of the property north south consistent with Staff's direction and recommendation for provision of access to the site with external road connections provided for in addition to which right of way has been dedicated either in the form of parks, conservation areas or right of way dedication, specifically at the Alton Road, Trotwood Boulevard, Shore, Bahama and Alton areas. The environmental issues regarding the project have been dealt with extensively in conjunction with all the agencies having jurisdiction over this site for almost two years. e Mr. McIntosh said consistent with the Settlement Agreement, the Developer has provided for the dedication of at least a 20 acre park site, as was mentioned earlier, there are almost 55 acres of land set aside for park, in addition to which there are an additional 150 acres set aside for conservation. There are 400 units planned consistent with R-lA zoning category classifications. Provision has bee~ made for the dedication of the Bahama Road right of way which is in the extreme south end of the property. Additionally the Developer will voluntarily contribute $25,000 to the improvements of the site's park facilities in addition to dedicating the site itself. Entrance improvements will be made during the first phase of the project to allow minimum of two outbound and one inbound entry movement, accel and decel lanes along SR 434 and west bound turning movement at the project entry as shown on the entry detail in the report that has been presented. A voluntary contribution of $35,000 to signalize the project entry to SR 434 - the actual commitment is to fund the signalization issue, and to fund and promote the reports necessary to support the warrant and request the warrant from Florida Dept. of Transportation. A voluntary contribution will be made of $500 per unit to'be paid at the time building permits are issued to be used toward the area school systems need. Mr. McIntosh said they have voluntarily incorporated all the Staff's requests for provisions of the north/south collector road through the property connection to the Oak Forest sub- division to the south and to the development to the west. , '" '" ~,........... ~ ... (g) 434 agrees to incorporate within the Preliminary Plan, the CITY staff's request for the provision of a north/ south collector road through the Property (Street A), and shall have the obligation to construct said collector road from SR 434 to a distance approximately 1,400 feet north of the property's south boundary, as shown on the approved Preliminary Plan dated November 10, 1988. (h) 434 agrees to incorporate within the Preliminary Plan, the CITY's request for a connection through the Oak Forest subdivision/Trotwood Boulevard stubout located near the Property's southeastern boundary. The decision as to how this ~ connection shall be made will be determined and decided upon by the City Commission at such time as that particular phase of the development which abuts the proposed Trotwood Boulevard connection is presented to the CITY. R. 434 Winter Springs, FL 32708 Re: Proposed Planning Study for S.R. 434/ Expressway Interchange Area Dear Mayor Kulbes: The City of Oviedo and Seminole County have each committed $15,000 to fund a joint planning study of the proposed S.R. 434/Expressway Interchange area. This future interchange will significantly impact land use and traffic patterns in the City of Winter Springs, unincorporated Seminole County, and the City of Oviedo. I believe that a specific study of the area and analysis of potential land uses could benefit all of our jurisdiction equally. Certainly, if we can jointly adopt a specific land use plan for the impact area we can accommodate, support, and protect our various concerns and interests. We are therefore asking the City of Winter Springs to also participate in the planning effort and commit an equal $15,000. The City of Oviedo will be pleased to coordinate and administer the $45,000 study, but all jurisdictions will jointly review and approve the scope of services and all work products. Historically, expres~way interchanges have generated a wide range of impacts and developmrnt pressurrs nn surroundinq bnd lwes. All jurisdictions would share equally in developing a scope of services, and also in reviewing and approving work products. The Consultant will be incorporating Winter Springs' plans - no one intends to tell your City what you can and cannot do. We simply want to evaluate the area as a whole, and support and maintain designated land uses in each jurisdiction. If we can agree on land uses, required improvements, necessary services, and jurisdictional boundaries, we will all benefit. 2) If we have a common plan \~e will be in a better bargaining position with FOOT for the nature and timing of improvements to S.R. 414. 3) The City of Oviedo and Seminole County will be doing a plan for the area within their jurisdictions whether or not the City of Winter Springs participates. It seems that it would he in the bc~~:t interest ot Winter Spring to be an equal partner in the study. Thc' land uses and dcvc'lopment stJndard~j in Oviedo and Seminole County will also impact Winter Springs. 4) If you cannot commit funds this year, we Ci1n phase the :1tudy ~o that Winter Springs' contribution can be included in the '91-'92 budget. With a commitment now that the funds will be included in your next year's budget, we can start the study i~nediately and then span the fiscal year for completion. 5) The City of Oviedo has taken the lead in this project because we have a transportation planning firm (G]atting, Lopez, Kercher & Anglin) under a continuing services contract. By agreeing to use our consultant, we will save the expense of advertisement selection. 6) The study will include a plan for financing necessary improvements. A tax increment financing district or Municipal Service Taxing Unit will be more effective if it is done as soon as possible and at one time.
