The City Engineer has problems with the project but has worked out a compromise with the developer as per the attached City Engineer Memo dated September 7, 1989. The City has a Maintenance Bond in the amount of $25,653.99 for this project. The City Attorney gave verbal acceptance of the Bond on August 23, 1989. The amount was approved by the City Engineer. DRL/gh cc: Mayor Commission City Attorney City Clerk September 7, 1989 TO: City Manager ~ FROM: City Engineer ~ (~ Subject; Carrington Woods, Tuscawilla Unit 16, Phase I Corrected as built engineering drawings were submitted for the above mentioned project at about 4:30 P.M. on Sept. 5, 1989. The corrected as built drawings reflected that the weir elevations on the control structures ranged from three to five inches below the approved design by the City. This deficiency has a significant impact of reducing the necessary retention volume required by the St Johns Water Management Rules. These concrete structures will have to be re- worked to accommodate the design. Since the control structures are not properly constructed, the engineer of record was informed of this discrepancy by phone on September 6, 1989. During the afternoon of September 6, 1989 at a meeting with Mr. D. Weaver, Jeff Garner and Michael Crist, the following items were agreed to after discussing the problem with the control structures a) the developer voluntarily present the City with performance money in the form of an escrow account or letter of credit on the entire cost of the stormwater management system b) the control structures be reworked and be recertified by the engineer-of-record within ten (10) days of acceptance of the project by the City with the necessary engineering documents which includes proper elevations with an inspection by the City Engineer c) that certificates of occupancy be issued only to those homes that are determined completed by the building department at the time the City Commission accepts this project. If the corrections are made by the engineer of record and verified by the City Engineer before the closing of the work day on Friday, a letter of satisfaction will be issued to the engineer-of-record; then the preceding items will not be necessary and the project can proceed in the normal process for approval. It is recommended that the Carrington Woods, Tuscawilla Unit 16 Phase I project be placed on the agenda with reference to the preceding comments. The amount submitted for the overall cost breakdown, regarding the maintenance bond, is agreeable to the City. Therefore, the amount (10\ of total cost) for the (2) year maintenance bond is twenty-five thousand-six hundred fifty three dollars ninety-nine cents ($25,653.99). Please respond, in writing, to each of the preceding comments.
