Regular Meeting Authorization REQUEST: Requesting the Commission to authorize the City Manager to contract with Land Design Innovations, Inc., via joint utilization with the LDI/City of Oviedo Professional Services Agreement dated September 21, 2009, for purposes of providing of Economic Development Services to the City of Winter Springs. PURPOSE: This agenda item is needed to request the Commission's authorization for the City Manager to enter into a contract for services with Land Design Innovations, Inc. (LDI) for the purposes of providing Economic Development Services to the City of Winter Springs. CONSIDERATIONS: During the FY 2010 budget workshops, discussions ensued regarding the procurement of a consultant for the purposes of providing Economic Development Services to the City. Subsequently, further discussion ensued regarding the possibility of the City partnering with the City of Oviedo in this regard. On November 10, 2009, the Commission hosted a joint workshop with the Oviedo City Council for the purposes of discussing potential partnerships with Oviedo for a variety of services including economic development. The Oviedo Council indicated that they had recently selected LDI as the top ranked firm, through a competitive procurement process in or about August 2009, for purposes of providing economic development services to their city. Further, the Oviedo Council indicated that LDI was willing to provide similar services to the City of Winter Springs under a joint utilization arrangement. This arrangement would afford both cities an enhanced, concerted effort towards their mutually beneficial economic development efforts as well as provide cost savings via economies of scale. With this in mind, the Winter Springs City Commission, by consensus, directed the City Manager to meet with LDI for purposes of discussion regarding the potential procurement of LDI for economic development services for the City. Accordingly, the City Manager met with representatives from LDI on Friday, November 13, 2009 to discuss this matter. Those meetings were very positive and productive. LDI offered to provide economic development services to the City of Winter Springs, per the attached scope of services, a portion of which are proposed to be performed in concert with the City of Oviedo. In this regard, the two cities will be able to increase their regional economic development efforts and enjoy a reduction in costs via economies of scale. Relevant to this request, section 2 -151, Winter Springs Code provides that competitive bids and proposals may be obtained by the City of Winter Springs through: (1) cooperating with other governmental agencies; and (2) using competitive bids and proposals received by other governmental agencies, provided they were made within one year of the date that the City proposes to use them. The City Attorney has opined that this contract request complies with the City's bidding procedure set forth in section 2 -151, Winter Spring Code if the City Commission determines that it is in the City's best interests to use the city of Oviedo RFP process to select LDI for this contract task. Representatives from LDI will be in attendance at the November 23, 2009 Commission meeting to discuss their proposal. FUNDING: Fee for services is $83,356 plus reimbursable expenses not to exceed $4,167.80, through the period ended September 30, 2010. Funds in the amount of $50,000 are available in the FY 2010 budget for this purpose. Thus, a General Fund supplemental appropriation of $37,524 would be needed to cover the balance of contract costs. RECOMMENDATION: The City Manager recommends that the City Commission: 1. Declare that it is the City of Winter Springs best interest to use the city of Oviedo RFP process mentioned above and authorize the City Manager to contract with Land Design Innovations, Inc. for purposes of providing economic development services, per the attached scope of services, to the City of Winter Springs and authorize the City Manager and City Attorney to prepare and execute associated documents with Land Design Innovations, Inc. 2. Approve a supplemental appropriation from the General Fund in the amount of $37,524 for this purpose. Here we are highlighting some of the cost savings Winter Springs will receive as a result of the joint effort with Oviedo: $6,003 in Meeting Attendance Costs $1,760 for the Shared Survey (Business Retention) $7,232 will be saved the Focus on the Business Forum at the Seminole Chamber of Commerce (Winter Springs can decide later if they want to do one of these also) Total Savings is nearly $15,000 for the nine month period. The work order allows flexibility to accommodate special projects, such as assistance with preparing grant applications or focusing on a specific new development and preparing a tailored incentive package for that project. Due to the unique and unpredictable nature of these development opportunities, these services can be provided hourly with written approval and authorization from the City Manager. Both myself and John Jones would be available to represent the City and present City programs at regularly scheduled meetings related to business growth.
