HomeMy WebLinkAbout1989 02 20 Public Hearing Minutes . . . , PUBLIC HEARING REGARDING THE STATUS OF THE LAND USE CLASSIFICATION FOR PARCEL 61 IN TUSCAWILLA MONDAY, FEBRUARY 20, 1989 Mayor Leanne Grove opened the public hearing at 8:00 p.m. Roll Call: Mayor Leanne M. Grove, present Deputy Mayor Philip A. Kulbes, present City Manager Richard Rozansky, present City Attorney Frank Kruppenbacher, present Commissioners: Cindy Kaehler, present Arthur Hoffmann, present William A. Jacobs, present Paul P. partyka, present Mayor Grove explained the Developer and his representatives will continue with their presentation. After they have completed their presentation the Commission will have an opportunity to ask any questions;then the residents who wish to speak will be sworn in and have an opportunity to speak. Attorney David Brown and Attorney Barry Walker, attorneys for the developer, with the firm of Broad and Cassel were present. Also present was Mr. Phil Rirdsong, senior Vice President with the Gulfstream Corporation. Mr. Birdsong was questioned by Attorney Brown. Attorney Brown then submitted more documents for the record: N - Petition for Annexation o - Ordinance No. 56 P - Ordinance No.64 Q - Ordinance No. 158 R - letters from the St. of Florida, Dept. of Community Affairs addressed to A.R. Blair, Winter Springs Development Corp., dated June 5, 1986. S - letter dated Dec. 11, 1973 addressed to Irving Waserman, Winter Springs Develop- ment Corp. T - letter dated 1979 from S. L. Management, Inc. addressed to City Planner U - letter dated Jan. 30, 1980 to Planning & Zoning Board from City Planner V - letter dated Feb. 8, 1980 to City Manager from City Planner W - Regular minutes of Feb. 12, 1980 X - letter dated Aug. 14, 1980 addressed to City Planner Y - Memo - dated 9/28/88 to City Manager from Land Development Coordinator Z - cost breakdown on the Tuscawilla Commercial Tract aa - CALNO plan and map bb -photograph of future land use city map of Tuscawilla PUD cc - four maps - development maps of Tuscawilla dd - Traffic report by Kimley Horn & Associates ee - Tuscawilla Shopping Center/Commercial site-memorandum from Attorney Brown which deals with the issue of vested rights (some 53 cases) ff - final judgement entered by the Circuit Court of the 18th Judicial Circuit, Case #84-3095-CA-17-E in which the plaintiff was Imara vs. the City of Winter Springs gg -Sec. 1983 Liability and Land Use Cases Memorandum hh - survey by Henry Trotta which shows existing uses of the property-Dec. 8, 1981 ii - plans for Tuscawilla Shopping Village submitted in 1978 and 1980 . . . Publfc Hearing regarding the status of the Land Use Classification for Parcel 61, 2/20/89 Page 2 Attorney Brown then summarized their presentation. Then Mr. Charles True, Mr. Harlan Hanson and Mr. Phil Birdsong were questioned by the Commission. The next public hearing was called for March 20, 1989. At that time the Commission will finish their questioning, and then it will be turned over to the public. The hearing will start at 8:00 p.m. Meeting was adjourned at 10:30 p. m.
