PURPOSE: This agenda item is needed for the City Commission to consider the Mayor's request to grant an additional Personal Day for employees for Fiscal Year 2010. CONSIDERATIONS: Currently, per City Personnel Policies, employees receive one (1) Personal/Floating Day annually, which is credited to eligible employees on October 1 of each year, and which must be taken prior to September 30 of the following year, with approval of the date by the supervisor. On September 14, 2009, the Mayor initiated a discussion regarding the addition of a second Personal Day for employees for FY 2010, in light of the fact that employees are not receiving merit raises in FY 2010. After some initial discussion, the Commission directed the City Manager to bring this issue back as an agenda item for the Commission to consider at its next Commission meeting (September 28, 2009). Granting this additional Personal Day would require Commission approval via resolution. If the Commission desires to approve this additional Personal Day, a resolution is attached for Commission approval to memorialize this action. FUNDING: Due to the "floating" nature of this holiday and the requirement for Supervisor approval, no additional funding would be required if this item is approved. RECOMMENDATION: The City Manager recommends the City Commission choose from one of the following options: 1. Approve Resolution 2009-52, granting an additional Personal Day, for FY 2010 only, for employees of record on September 30, 2009. 2. Deny the Mayor's request for an additional Personal Day for employees for FY 2010. 3. Any other action the Commission deems appropriate. ATTACHMENTS: • Resolution 2009-52 COMMISSION ACTION: RESOLUTION NO. 2009-52 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, GRANTING, ON A TEMPORARY BASIS, ONE ADDITIONAL PERSONAL HOLIDAY FOR FISCAL YEAR 2009/2010 TO THOSE CITY EMPLOYEES THAT WERE EMPLOYED BY THE CITY ON SEPTEMBER 30, 2009; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under § 2(b), Art. VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the current Personnel Policy recognizes one personal holiday; and WHEREAS, due to current economic conditions facing the nation, the City Commission has determined it is in the City's best fiscal interest not to increase employee salaries during the next fiscal year; and WHEREAS, in light of the City Commission's decision foregoing salary increases for City employees, the City Commission desires to afford current City employees an additional personal holiday day, on a temporary basis, for the next fiscal year under the terms and conditions set forth herein; and WHEREAS, City Commission deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by reference. Section 2. Granting An Additional Personal Holiday The City Commission of the City of Winter Springs, Florida hereby grants, on a temporary basis, an additional personal holiday for fiscal year 2009/2010 to each City employee that was employed by the City on September 30, 2009. Said personal holiday shall be subject to Section 22 of the City's Personnel Policy Manual. City of Winter Springs Resolution No. 2009-52 Page 1 of 2 Section 3. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. Section 4. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida.
