PRELIMINARY SITE PLAN REVIEW - TUSCORA VILLAS:
Kozlov stated that his only concern was the 18 in. curb. In Section 14-95 of the
Code, it states that the developer will accomodate the requirements of the City.
Code states that a 24 in. curb is required. He stated that the developer has the
option to ask the City Council for a waiver to use the 18 in. curbs.

Koch stated that the developer will need to send a letter to the City asking for a
waiver to the Code from 24 in. curbs to 18 in. curbs. The developer can submit the
letter with the Prelimin~~Y-Pl~~that are brought to the City Commission.
There was a discussion on the drainage.
True stated that the two ponds will be controled by one structure. It will go into
one pond and when it reaches a certain elevation, it will pop off and go into the
other pond. He stated that there is an existing control structure to handle 9, 9A,
and 9B, which is located on Northernway and Howell Creek Bridge (north side of bridge).

Kozlov stated that basically these will be made into retention ponds, and stated
that the new rules state that it is 4 to 1 slope down to the controled waters edge.
True stated that he was aware of the new rule, and also stated that this area will
not have to be fenced. Kozlov agreed.
Kozlov stated that there are some lots going into the controled "natural" area
and wanted to know how this was going to be accomodated.
True stated that there has already been soil borings in those areas, they are
in the process of testing, they will fill the back of the lots to meet the
stormdrain requirements. He stated that the two ponds will be totally reshaped and
areas filled will meet all compaction requirements.
Koch asked if they are meeting the 50 ft. setback requirements, from the building
to the water line? True stated the 50 ft. setbacks will be from the lot line not
the water line. Koch stated that in the PUD Code it requires that all setbacks
will be 50 ft. from any body of water. It was determined that the developer will
ask for a waiver from the Commission for that provision as they are not looking at
these as a natural body of water.
There was discussion on the stormwater pipes, that they should not have holes. It
was determined that the developer does not use pipes with holes.
Kozlov asked about the pop over sheet flow into the swale of the street. True
stated that the drainage will go to the west in a controlled elevation, the sheet
flow to the curb then to the inlet.
Govoruhk asked about the location of the recreation area to the proposed entrance
and exit of Tuscora Villas. He was concerned about the safety factor.

1. The Staff and Planning and Zoning Board have completed their Preliminary
Review of Magnolia Service Corporations' Development Plan for Tuscora Villas. The
Staff feels strongly on several items which are in difference to Code. The developer
has requested a variance on three items.

Dear City Council:
I am requesting a ninety (90) day permit so I may park
my 32 foot recreational travel trailer in my backyard while
I finalize the paper work for its sale. My yard is
completely enclosed to neighbors and the street by a six
foot fence.
My request for this permit is based on Art. XIII, S
44.81, Par. f, Appendix A, of Zoning. It reads: No
recreational vehicle in excess of Twenty-eight (28) feet in
length overall measurement shall be parked or stored in a
residentially zoned district without a permit issued by the
City Council.
I have had my trailer up for sale for some time and
finally have a perspective buyer, but due to the fact that
part of the closing paper work has to be handled out of
state, I am requesting this 90 day permit.
If the City Council would like to talk to me before
acting on this request, I would be available for the Aug.
11. City Council Meeting.
Being new to Winter Springs, having just purchased my
home this past May, it is with my deepest appreciation that
the City Council will deal with this matter so I will not
be forced to move the trailer before its sale.

Subject project has been reviewed by both the Staff and the Planning and
Zoning Board and is deemed appropriate for approval of the Preliminary Review
of the Final Development Plan. The project developer is in agreement to re-
serve the 15f~ utility easement along the west and south boundaries of the
property. The engineer-of-record is working in close harmony with the City
Engineer in meeting all requirements of the Code on Final Engineering matters.

LA PETITE ACADEMY SITE PLAN REVIEW:
Kozlov stated that he had sent a letter to the engineer-of-record stating all the
items he needed clarification on, and was satisfied with answers from project
engineer. His only concern was to check with the Fire c..'hief regarding the fire
sprinkler system.
Holzman stated that the fire sprinkler system was not necessary. He stated that
this was typical of the building design of other La Petite Academy's and every-
thing was fine in the project plans as far as he was concerned.
There was discussion on whether the Architectural Review Board of Tuscawilla has
agreed with the Site Plans. It was determined that there is a need for a letter
from the ARB stating that they agree with the proposed plans.
Koch stated that there was a need to show more landscaping on the property, and
also a need to show the elevation of the building and the easement of the road.
Mary Dozier stated that there will be landscaping in front of the building and
that the retention ponds will be bordered by shrubs.
Smith made the motion to approve the Site Plan subject to the approval of the ARB
and the approval of the Planning and Zoning Board. Seconded by Kozlov. Vote: All Aye.
LOWES LUMBER WAREHOUSE SITE PLAN REVIEW:
Powell gave his presentation. He stated that basically this is a change of use, from
R~chie's Auto to Lowes Lumber Warehouse. They need to add rest rooms in the ware-
house. This was one operation and now they are dividing it into two operations.
It was uncertain on what exactly will be done to the property.
It was determined that there will be a continuation on this item until more
clarification can be made on the subject property.

Preliminary Site Plan Review - Tuscora Villas

On August 1, 1986, Jay Alpert, Lt. Butler and I toured the proposed site.
There appears to be no problem with the planned intersection of "D" street
onto Winter Springs Boulevard, or the proposed cut of the median at this location.
However, there is an existing median cut just to the west of this proposed cut,
approximately 1/2Oth of a mile from the new intersection (approximately 270 ft.).
Per D.O.T. guidelines, median cuts should be spaced at a minimum of 600-660ft'.
Prior to any additional development to this immediate area, the developer /
builder of the future project will be responsible to close the existing median
cut which would not be allowed, due to its proximity to the proposed cut re-
quired and approved for Tuscora Villas.
The entrance at "A" street should be moved to the intersections of Trotwood
Boulevard and Northern Way. This intersection will at the present time only be
a two way stop; off of Trotwood Boulevard as exists and coming out of Tuscora
Villas. Through traffic on Northern Way will be controlled by a speed limit of
25 miles per hour.
Winter Springs Development Corporation has been requested to provide the
City with a map of Winter Springs Boulevard, from Tuscawilla Road to the
eastern City limit. This map will indicate all future proposed project areas
along Winter Springs Boulevard and the number of cuts proposed, in order that
the City can monitor and determine the effect the cuts will have on traffic flow
and/or problems if any.

Based on the Preliminary review of the plans of this project, the issue of
18 inch miami curbs was brought up. I objected that eighteen inch miami curbs
are to be used in the project. The Land Development Code requires 24 inch miami
curbs; Section 14-126 (f) via Section 14-95.
The developer had not provided a satisfactory rational to reduce the size
of the curb other than to save money. Such logic could be applied to all code
criteria.
The developer plans on requesting a variance from the City Commission to
Section l4-l26(f) Land Development Code to allow an eighteen inch miami curb in
lieu of the required 24 inch curb.
I recommend that the variance be rejected for lack of a rational to reduce
the width of the curb.

REQUEST of MAGNOLIA SERVICE CORPORATION of their PRELIMINARY DEVELOPMENT PLAN for a

Powell gave his presentation. He stated that this property was changed from commercial
to pat io homes, and at the t ir.1C' of tht.: change it was noted in the Commiss ion minute'S
t hat the Home Owners Associat iun be included in any development planning that was :)(:ing
done for this property. A meeting had taken place with the developers and the
Tuscawilla Home Owners Association Board members.
George Nader was there to represent the developer Don Greer. Charles True, the pro-
jects engineer was also there to represent the developer.
lrue stated that this project would be similar to the Wedgewood Tennis Villas, located
in Tuscawilla. The homes would be single family detached units.
There was discussion on the entrance to the project off of Northern Way.
There was discussion on the recreation area. It was determined that the size of the
pool would be to the State regulations.

There was discussion on the items that will be brought to the City Commission for
waivers. Those being: 18 inch miami curbs, stub streets, and the distance of the
lot setbacks where the retention area water line to the edge of construction is by
Code interpreted to be 50 ft.
Smedley stated that he was concerned about the eastern existing retention area. It
was stated that it is a low existing natural depressed area. The 2 ponds will be
completely reshaped, and will be more than enough to handle the area. It was noted
that there will be a maintenance berm which will be 3 : 1 with a 4 ft. slope to the
water.
Smedley moved to approve the Preliminary Development Plan for Tuscora Villas subject
to the Staff recommendations and the Planning and Zoning Board will recommend to the
Commission that the 18 inch miami curbs be approved; also to approve the use of Stub
Streets except for required cul-de-sacs at east end of Street G and South end of
Street B. Seconded by DeFazio. Vote: DeFazio: aye; Dorman: absent; Joshi: absent;
Hartman: aye; Smedley: ayeo Motion carried.
REQUEST of JOEL PIPKIN TO ANNEX the EAST ~ of LOT 4, BLOCK D, D.R. MITCHELL SURVEY
(North Side of S.R. 434, One t-lile East of S.R. 419 Intersection):
Koch gave her presentation. She stated that this is ~ of a lot that is adjacent to
the property that the City annexed in three years ago. All we are dealing with now
is recommendation to proceed with the annexation.
Smedley moved to approve the annexation of the East ~ of Lot 4, Block D. D.R. Mitchell
Survey (North Side of S.R. 434, One Mile East of S.R. 419 Intersection). Seconded by
Hartman. Vote: D('rm~m: absent; Joshi: absent; DeFazio: aye; Hartman: aye; Smedley:
aye. Hotion carried.
The meeting was adjourned at 8:33 P.M.

Thank you for forwarding to us copies of the Preliminary Development
Plan for Tuscora Villas. As you are aware, a committee of the Home-
owners' Association has met with the Developer and reviewed the plans.
The Homeowners' Association of Tuscawilla is aware that the Developer
is currently processing these plans with the City of Winter Springs,
and the Developer intends to start construction as soon as all approvals
are granted. Thank you for keeping us updated on this matter.

Dear Commissioner Hoffman:
We have proposed to purchase property at Tuscawilla for
the purpose of developing a private community of 242 single
family detached homes. Tuscora Villas, if approved, will
have private streets, will be enclosed by a 5' masonry
privacy and security wall, will include a pool and cabana
with extensive landscaping. All streets and other
facilities within the community willi be maintained by a
private homeowners association.
The Site Development Standards Ordinance, Section
44.85.4.4g requires a 50' setback from any lake, stream
or body of water, unless waived. Our plan includes three
small retention ponds around which homes are designed in
close proximity to the same. We, therefore, request a waiver
allowing the building setback to be 20' from the retention
pond water surface (similar to the setbacks approved for
Casa Park Villas).
The Ordinance on private streets requires that all streets
comply with the design standards set forth for public
streets. We are requesting a waiver of the requirement
for 24- miami curbs and in its place we would like to
install 18- miami curb. It has been our experience in other
properties that the 18- curb is adequate from a hydralic
and structural standpoint. Additionally, the 18- curb
permits more flexibility in designing driveways and increases
the amount of lawns and green areas.

Tuscora Villas has been designed as a series of looped
streets without cul-de-sacs. There are five places in the
plan where short stub streets are included to provide access
to the end lots. Essentially, the short stub streets are
an extension of driveways for access purposes. We therefore,
request that these not be classified as cul-de-sacs for
purposes of pavement ~esign. In most cases, the stubs are
no more than 25-50 feet in length.
We respectfully submit the proposed plan for Tuscora Villas
with the intent of meeting the regulations for a private
street community.
