Greenwood / Infrastructure Coordinator ~ Tract 3 & 4 Rev~Sed~ngineering on Master Drainage (~.6vr~ 'Y,t.,fJ FROM: Land Development On March 31, the final engineering on subject project was requested to be revised by the Developer. This revision involved the Haster Drainage Plan for Tracts 3 and 4. The revisions included: 1. Pond 4A to be eliminated. 2. Ponds 4B and 5 to be combined into a single retention pond. 3. Storm sewer previously draining into 4A is redirected into combined retention pond. 4. Storm sewer profiles were revised accordingly. Through timely interface by the City Engineer, all questions which were brought up by this revision were answered. On 29 April 1986, the City Engineer documented the proposal as satisfactory and recommended approval of the revised Engineering to the infrastructure. Purpose at this meeting is to advise the Commission of the revision and recommend they move to approve the revised Engineering. Robert Smedley, Chairman, Present Richard DeFazio, Vice-Chairman, Present Gene Dorman, Present Taru Joshi, Present Jim Hartman, Present Jacqueline Koch. City Planner/Dr.Adm. Robert Powell. Land Development Coordinator APPROVAL OF MINUTES OF MARCH 26. 1986: DeFazio moved to approve the minutes of March 26. 1986. Seconded by Joshi. Vote: All Aye. Motion Carried. 'fv1~~ OFFICIAL ZONING MAP UP-DATE: Koch stated that the City Code requires that prior to the end of May each year, the Board review the Official Zoning Map after it is permanently updated by the Staff to reflect the actions of the previous year and recommend to the Commission whether they should certify it as the correct Official Zoning Map. Koch stated that this year we are faced with some complications due to two factors: lack of continuity in planners over the past few years and a new State law which totally changes the procedures with respect to rezonings that conflict with our Adopted Land Use Map. We can amend the map only twice in a calenda~ year, from October I, 1985 onward. The annual review of our zoning map this year involves actions taken both before and after that point in time. Also, changes to the City map involve both rezonings and annexations, both with and without land use changes. In order to simplify this, we will deal with rezonings of property that was already within the City limits as of this time last year. The questions of annexations and assigning land use will be covered at the next meeting. There have been 10 rezonings since the zoning map was completely redrawn in 1982. The first four rezonings were totally in accord with the .Land Use Plan. The next three, in March and May, 1985, rezoned property that had been annexed into the City in 1983 and had been zoned R-U, with the land use rural residential (Ord. 274). Ordinances 313, 317, and 318 rezoning the properties to commercial did not concomitantly amend the City's Adopted Land Use Map. With Ordinance 321 rezoning property annexed by Ordinance 286, the identical problem is found. In ail four cases, the original land use designation of rural residential was applied because of the requirement to conform to the land use map of the previous jurisdiction. Koch stated that the City Attorney suggested that the Board recommend to the Commission that it resolve that it was the full intent of the Commission to amend the Adopted Land Use Map simultaneously. Chairman Smedley suggested that they take care of the rezonings prior to the new law and then tackle the other cases that occurred after October 1, 1985. PLANNING AND ZONING BOARD MINUTES WEDNESDAY. Chairman Smedley moved. regarding Ordinances No. 313. 317. 318, and 321, that the City Commission resolve that it was intended to modify the Adopted Land Use Map of the City of Winter Springs in accordance with the rezonings. Seconded by Hartman. Vote: All Aye. Motion carried. Koch stated that of the two rezonings made after October 1. 1985, one rezoned a house on the north side of 434 to C-l and that was in accordance with the Map. She Stated the other one is not in compliance; a part of the Highlands PUD greenspace was rezoned from PUD to commercial. for development in connection with the frontage commercial property on SR 434. An official land use modification in connection with this rezoning needs to be added to the first group of amendments to the Land Use Map under the new law. There was discussion as to the new procedures and that the underlying purpose of the new law is to see the total effect of amendments to the Map at one time rather than piecemeal. On related aspects of the Official Zoning Map. Koch advised that there still exists a moratorium on convenience stores with, sale of gas on all C-2 properties. Lastly, the "305 acres" has reverted to R-U zoning with settlement of the suit and agreement on ways to rezone portions of the property to R-3 to concentrate the ~, density at a location remote from the RC-I areas. Koch stated that the Board needs to make a formal motion regarding the status of the updated Zoning Map. Dorman moved to recommend the Official Zoning Map, subject to the actions required to amend our Land Use Map accordingly. Seconded by Joshi. Vote: All aye. Motion carried.
