SUBJECT: COMMENTS ON PRELIMINARY ENGINEERING FOR TRACTS 5 & 7,
MT. GREENWOOD PUB

Generally the conceptual plan is satisfactory with the following
exceptions of the drawings that were provided.
1. Tract 5, sheet 2 of 2, dated 1/2/86, there is no potable water
line connection shown to the existing water line on Mt. Greenwood
Blvd. This issue was brought up at a preliminary meeting. The
engineer claimed that there was an updated drawing providing this
information. It will be necessary to have the corrected drawing.
2. It will be necessary for the engineer to re-evaluate the direction
of slope of the gravity mains in both tracts 5 and 7. It appears
that the gravity sanitary mains are sloped in a direction where
the topographic elevations rise. The results of such a design
would be deep manholes which would create maintenance and safety
problems for staff members in the utility department.
3. On the drawing typical road section, Tract 7, dated 1/2/86,
the sidewalk is noted to be immediately adjacent to the edge of
the right-of-way line. Section 14-126, Land Development Code requires
a one (1) foot separation between the edge of the sidewalk and
the right-of-way line. However, I will accept this modification.

fire hydrant positioning and distant placerrent rreets our code requirerrents.
Further coordination is needed, however, to insure that utilities
corrpanies do not place power/light poles, transforrrers, and/or telephone con-
trol boxes wi thin the restricted limits of fire hydrants.

Dear Ms. Koch:
The referenced tracts within the Mount Greewood PUD are proposed
for development as fee simple attached townhouses. These sub-
divisions will have private streets with adjacent off street
parking facilities as shown on the engineering plans for these
tracts. These streets and parking facilities will be a part
of the limited common properties in these subdivisions and
will be owned and maintained by the appropriate homeowners
associations.
AmeriFirst Development Corporation, therefore, respectfully,
requests a waiver of the right-of-way requirements under the
design/construction standards per Section 14-95 (private
streets) of the City of Winter Springs, Florida Land Development
Regulations.
Should you have any questions on this matter or need additional
information, please advise.

Motion was made by Commissioner Jacobs to approve the final engineering for Tuscawilla
Unit l4-B with the exception of the slopes of the ponds to be determined at a later
date after consultation with the former counsel of D.E.R. in the Tallahassee office
of our City Attorney, Mr. Richard Lee. Seconded by Commissioner Trencher. Discussion.
In discussion Commissioner Trencher asked to amend the motion to have that clarified
in writing. The City Engineer said the same concerns we have in 14-A be also carried
over to 14-B. Vote on the motion: Commissioner Hoffmann, aye; Commissioner Ku1bes,
aye; Commissioner Jacobs, aye; Commissioner Trencher, aye; Commissioner Kaehler, aye;
motion carried.
Final Engineering of Mt. Greenwood, Tracts 3 and 4:
The City Planner explained that Tracts 3 and 4 are townhouse tracts of the northern
section of the Mt. Greenwood P.U.D. The City Engineer and Staff are recommending
approval of the final engineering. Mr. Phil Wallace from Amerifirst spoke to the
Commission.
Motion was made by Commissioner Jacobs for the approval of the final engineering of
Mt. Greenwood, Tracts 3 and 4 and a waiver of Section 14-95 as requested in the
Amerifirst letter of 'Feb. 24, 1986. Seconded by Commissioner Hoffmann for discussion.
Discussion. Vote on 'the motion: Commissioner Ku1bes, aye; Commissioner Jacobs, aye;
Commissioner Trencher, aye; Commissioner Kahe1er, no; Commissioner Hoffmann, aye;

The City Planner reported that Staff has reviewed the final engineering and recommend
approval.

Ja<XJ\.Eline Koch gave her presentation. She stated that this request is to change the
designation of Tract 5 from garden apartnents to t<::Ml'1h:>uses, which \tlOuld be the sane
as Tracts 3 & 4. 'lhe original mmrer for the garden apart:Irents was 252 which would be
decreased to 187 townh:mses. Also to increase the nurrber of patio hones in Tract 7
to 171 (up from 150). She also stated that this is an inprovenent and an up-grade to
_ the area. 'Ih:! increase in patio hones \tlOuld not have a negative effect. She stated
.., that the other aspect is to delete the recreation area in Tract 7 and locate all re-

She raised the q\Estion of the relocation of all the recreation facilities to the
central location; eliminating the one' that was to have been in the patio tares section
and cx:noentrating everything in Tract 6. She stated that it would ccncentrate the

Re: Amendment to Mount Greenwood PUD
Dear Ms. Koch:
AmeriFirst Development Corporation is in the process of finalizing
development plans and initiating actual construction of the Mount
Greenwood PUD. Throughout this implementation phase, we are dis-
covering a few areas in which modification of the original plans
would be appropriate. The modifications consist of the following:
1. Overall reduction in density;
2. Transfer of density within the PUD; and,
3. Consolidation of recreational facilities plan.
4It Reduction in Density
The Mount Greenwood PUD was first conceived as a 700 unit, mixed
density PUD. During the initial public hearings, the City Council
required a reduction in the density of Tract 5 (garden apartments/
condominiums) from 11.98 dwelling units per acre (DU/AC) to 10 DU/AC.
This resulted in a total reduction of units in Tract 5 from 302 DU
to 252 DU or an overall reduction in the PUD of 50 DU to a total
of 650 DU. AmeriFirst Development is requesting a further re-
duction in the density for Tract 5 from 252 to 187 DU.
Transfer of Density
With the elimination of a total of 65 DU from Tract 5, AmeriFirst
Development requests a transfer of 21 units to Tract 7. Tract 7
was originally approved with 3500 sq. ft. patio home (zero lot
line) lots. AmeriFirst Development proposes to create 4680 sq. ft.
lots. This will result in a 33% increase in average lot size.
These changes will result in an overall net decrease in dwelling
units from 650 to 606.
Consolidation of Recreational Facilities

park area located in Tract 6 per the general layout which

I have been reviewing our mosquito program and will most likely
include another spray unit in the fiscal year 86/87 budget.
In the mean time, I am of the opinion that we would be more
effective spraying in the evening rather than during the daylight
hours. We are presently reviewing manning and salary requirements
vis-a-vis the availability of funds in the present budget.
I visited the areas which are insect prone during darkness
on two occasions and feel that we should be trying to control them
at night when they are out rather than during daylight hours.

the sellers are obviously not interested. It's apparent what position
the County has taken. Consequently, if we wholesale water to the
County so that the property may be developed while in the County,
one must ask what incentive is there for the owner, or future
owner(s), to annex into Winter Springs? If the answer is none, then
What incentive is there for Winter Springs to provide water to
a development that probably will not come into the City?
I'll review this again with the staff and attorney, provide
you with input and ask for direction at the April 14, 1986 Commission
meeting.

Dear Dick:
As you know, Cedar Resources, Inc. has an application
on file with fees paid for annexation and PUD zoning for
Sunlake PUD subject to the city having the ability to serve
the developrent all required rrnmicipal services to include
water and ~r services.
The owners of record through Ken Oswald delivered a
letter that stopped progress in negotiating such services and
ultimate consideration of annexation and zoitiJ)g.
Cedar Resources, Inc., its land planners, consultants
and engineers all agree that Winter Springs can best provide
services for the property and that this is a loc;rical extension
of the rrnmicipal lirni ts. The land lies arrong Winter Springs,
Casselberry and Longwood rrnmicipal limits. Seminole County
has no utility service within the area and does not intend to
extend services at any tine due to the fact that this land is
literally an island of Seminole County land arrong these three
cities. Officials within Seminole County govermnent in private
rreetings have indicated that this parcel is best annexed.
Please understand our desire to proceed with the intent
of our applications but at this point the owners of record
have not granted authority to proceed due to fear that this
effort will cause adverse public relations with Seminole County
officials and that the zoning status and ability to acquire
utilities may be jeopardized. We do not agree because this is
a loc;rical annexation to aa;IUire rrnmicipal services wherein the
county has no services. This is the sole reason for the theory
of city govermnent--to provide nore intense services than cOlmty
governrrent which is established to govern and serve nore rural
areas. Also, we feel that should we aa;IUire sewer fran your
city the county will ultimately be happy because they can then
give this capacity to those who really lie within areas that are
best served by Seminole County qovermnent. F'urt:henrore, should

County into a posture of maintaining a neighborhood water
plant which is against all good utilities planning and
operations conduct. Utilities sbJuld be regional in nature
for efficient operations on behalf of the custarer--the citizen.
As you know, ~ intend to request zoning which is exactly
that \Yhich the county approved and details will be the sane,
thus, the creditability of that which the county granted will
be upheld and moored by the city and the new owner/developer.

The issue at hand is utilities for water and sewer services
and who can best serve the property. Also, your police and
fire services can provide quicker response t:i.ne for law, fire
and rredica1 errergencies.
In that ~ are held up for the m:nent I ~uld request that
Winter Springs consider the wholesale of water through an
inter-local govennrental agreatent with seminole County who
will then serve the property and bill the custarers. we ~uld
extend lines and do all necessary construction to provide
facilities for this system.
Again, the best approach is to armex as to all areas of
human services for the retail and residential developrent but
this approach provides an alternative to consider for the m:::rrent.
Please consider this with your city officials and advise.

This is to advise that my firm represents Elizabeth L. Bush,
Nancy J. Freeman, Harold R. Jackson, Jr., Kenneth M. Leffler,
Mary W. Leffler and Lila L. Walling who are the owners of a 56
acre tract of real property located in Seminole County, Florida,
adjacent and contiguous to the boundaries of the City of Winter
Springs.
Cedar Resources, Inc. has contracted to purchase my clients'
property. We understand that annexation and rezoning
applications have recently been filed with your office by Cedar
Resources.
The purpose of this letter is to advise you as City of Manager of
winter Springs that such annexation and rezoning applications
were filed without my clients' knowledge, consent or approval and
we hereby request that such applications be withdrawn from

Please accept the attached revised plan for South Bear Creek Park. The
plan includes the following additions to the existing Dark facility:

all major trees, ground to be grassed or mulched
3. Volley Ball Court
4. 321X241 picnic shelter with tables

Tuscawilla Park Site Plan At Sewer Plant - Additions to Park Facilities and Approval
of M:uunade lake Excavation to acquire soil for use in PUn Developrrent.
Winter Springs Developnent CoIpOration is reqtEsting approval to dig a lake on the
sewer plant recreation site, a oorrow pit operation. They are proposing to put in
additional recreation facilities, in the passive park area in exchange for the approval
to excavate the lake to use the fill in developrrent of the remainder of Tuscawilla.
Mr. Alpert gave his presentation. Their intention is to keep a park surrounding the
waste water treatnent plant as a buffer. He said what they are asking to do is based
on the City Ordinance #64. Winter Springs Developrent CbIpOration needs to m:rre
_ before the City Cbnmission to get approval to dig a lake on property within the
City of Winter Springs. He stated that this property is owned by the Winter Springs
Developrrent CoIpOration and maintained by the Utility Cbrrpany as fer City Ordinance
#64; that allor.vs us to have park facilities in Tuscawilla as long as there is non-
discriminatory use of all residents of Tuscawilla. They would expand the park facility
that currently exists by putting in a picnic shelter of the sane size and nature as
those picnic shelters nor.v that are recently placed in Lake Tuscawilla Park. They
would be putting in a playground that would be sized and a type of playground for
older chilCken; where right nor.v they have a playground for younger children. He stated
that they haven't specifically laid out the equiprrent and location, but intend to
have a large, older childrens' aparatus such as swingsets, climbing aparatus and
other aparatus judged for older children. He also stated that in this aced cileY are
plarming bJ put in a professional jogging trail with e:xercise stations and equip-
rrent along a mulch path around the lake. South of the lake they will put nature
trails and l:oardwalks and a path, and a raised walkway and also a gazebo and leave
it natural for people to walk and mnmune with nature. The current entrance to the
wastewater plant \\Quld be closed and a parking area created With 28 spaces, stablized
with clay or linerock mvered with mulch or pine straw~ A new access into the sew:!r
treatnent plant to the west of the active park area will be mnstructed so vehicles
gOing into the sewer treatnent plant would not interfere with the people using the
park .
Koch asked whether or not the Staff finds this remrrr.endable to the O:>rrmission be-
fore the developers are required to <b anyrrore elal:orate engineering since there will
be plans required for the developrrent. She stated that this cbes not mnstitute an
anendnent to the final developrrent plan, but it cbes need to go to ~ City Conmission.
Kozlov asked if the developers were going to discharge any sto:rnwater into the lake,
and if there was anything related to the sew:!r plant that is going to be associated
with this lake, for the remrd. Alpert answered no, ti)at tilis park is basically
unusable woods, and that this is a way for Winter Springs I:evelopnent CoIpOration
and the residents both to get sorre benefit from this property.

Kozlov asked the depth of the lake. Alpert stated it will have to be deep enough
to be maintainable because shallow laJe s bec:orre slop holes. He stated that the
boring that they have done, that the bottom of the lake (at the center) will vary
because of the type of soils they will oone in oontact with but it should be 8'
to 10' depth minimum.
Kozlov asked if there will be fishing and boating. Alpert stated it WJuld just be
for fishing.
Koch stated that bascially what the developer is asking for is a trade-off; they
need fill dirt and in exchange they are offering additional park facilities. She
asked about the quality of the land, SW-aITp or a wet area. Alpert stated no, that
this area is not located in a wet or SW-aIYp area, and that there are no seasonal
creeks.
Artman asked what kind of trees are in this area. Alpert stated nostly pine and
small oak, and serre palnetto and palms. There will be a buffer of 50 feet from
the wastewater treatnent plant .
Kozlov asked are there spray fields anywhere near this property. Alpert stated no
that the spray fields are on the golf oourse.
Koch asked if there would be any odor from the treatrrent plant. Alpert stated that
the plant does not produce any oCbr and the ponds do not produce any odor. He stated
that within the treatnent plant there are sludge drying beds and there is always
sane odor. He doesn't think that this will have any effect on the park.
Koch asked about the maintenance of tffi park. Alpert stated the park facility will
be owned and maintained by the utility Cbrrpany. The utility Cbrrpany is ooncemed
that a buffer be maintained around its facility. Koch stated that the City WJuld
like to have serrething in writing oorrmitting the utility Conpany to maintain the
park facilities after Winter Springs Ieveloprrent Corporation is gone.
Alpert stated that as long as the utility Cbrrpany is in operation, the developed
park facilities will be maintained by the utility Cbnpany. He also stated that they
WJuld be nore than happy to guarantee that any resolution made oonceming owner-
ship of the other parks in Tuscawilla WJuld include this park. He also stated
that the developers WJuld love to let the City have the park.
Smith asked if the park will be lighted and have bathroom facilities. Alpert stated
that it will be a dayti.ne park, and there are no bathroom facilities plarmed.
Smith asked the acreage of the park. Alpert stated that there is approximately ~
acres in the lake area, and is about 800 feet from the street to the lake.
Koch stated that it would be a good idea to have a water fountain. Alpert stated
that this WJuld not be a problem and stated that they will do the best they can to
make a natural park, and that the parking will fit in and around the trees.
Koch asked if the Staff requires any nore information and whether they reocmrend
this or reoormend against this.

Dear Mr. Alpert:
In reference to the request of Winter Springs Development Corporation for
authorization to remove soil from a portion of the sewer plant site south
of Winter Springs Boulevard, the City Commission approved the request,
including recommendations from Staff, (attached) including all the amenities
(as listed in your letter to City Manager Richard Rozansky dated March 21,
1986) and the comments made at the meeting which include:
1. Your guarantee to provide potable water to the site.
2. A 4-1 slope from the top of the berm down as far as it
goes 20 ft. horizontally into the lake, after that it
will be a 3-1 slope.
3. The dirt is to be used to expand the wastewater treatment
facility and on Tuscawilla Unit 14B.
4. You will accept responsibility for the streets, and will
clean up any dirt that is dropped on the streets.
In addition:
1. 180 day completion time.
2. No work on Sundays.
3. No trucks on premises after 5:00 p. m.
4. Hours of work on other days will be from 7:00 a.m. to 5:00 p.m.
5. Repair and clean any damage to the roads.
