GREEM\OJD TRACKS 3 & 4: The City Engineer's letter dated January 22, 1986 was reviewed. 1. Depa.rt::Irent of Envirorurental legulations penni ts. Rey M:ilane stated that the DER pennit applications will be submitted today. Ien Kozlov said that he would like to get a <X>py of the approved signed pennit once it has been issued. He also asked that Bowyer-Singleton respond to his letter in writing. 2. Len Kozlov stated that he was oonfused because sone things were put on the drawing saying there were existing and sane were not existing yet there is nothing there. Dave - Snead stated that he added a note saying that the features showing as existing are in- tended to be existing by the tine Tracks 3 & 4 get started; and the infrastructure will be in place at that tirre. 3. Dave Snead stated that they will fumish seven (7) sets of signed, sealed, and dated plans. 4. Concerns about calculations for post-peak storrrwater discharges. ReyM:ilane stated that this will probably answer #6 & #7 also. He stated that there is a rraster lake system which was built under the infrastructure. ~st of the baseball field is a natural depression wlrich will be left in its existing oondition and used for storrnNater detention, and it will be oonsidered the naster lake system. ley Malane said that these are retention detention ponds. They have been approved by St. Johns Water Managerrent District for oonstruction and operation. In the design of the lake systems the CN that was used for post developrent land uses. When the naster lake system is built it is already designed to take into oonsideration that there will be patio hones on Tract 7. So, all they need to do in the developnent for each parcel will be just to connect into the lake system. 7. Cbncem on the irrpacts that it nay have off site to No Narre Creek. ley Malane stated that they have inoorporated a wall which is the oontrol structure in Tract 10. The system has been designed to irrprove or equal the cx:nditions that occur downstream. Len Kozlov stated that the nain ooncem is the oonoentration of a lot of water going into the No Narre Creek not knowing ~ther all this water that is going to be carried off from detention 10 historically went into NO Narre Creek. This is going to be a problem because a lot of water is being funneled into one area, and there are people living in the imrediate area, oone probably living below the 100 year flood. ley Malane stated that they \Ere cxmoeD1ed about the house on the oomer next to the culvert. He stated that they did not want to increase flood stages, they analyzed the 100 year stonn, and what- ever was going to Tract 10 would be cnly the predeveloprrent base. The predeveloprrent area is equal to the post developnent area. '!hey will increase the total runoff because to irrprove the area. And he is willing to put this staterrent in writing. 8. !en Kozlov stated that this would be a lot better to get fire engines and a little larger vehicle in. Dave Snead stated that they have no problems with this. 9. Dave Snead stated that the di.rrensions are on the two sheets showing the two 12' lanes to be built. 10. Dave Snead stated that the sidewalks fran the units to the parking areas will be constructed by the builcer. The preliminary plans that was su1:mitted they proposed bringing the sidewalks to individual tmits from the parking areas. Sidewalks will go along the roads just on the infrastructures. Sidewalks will be provided as expected on all the public streetsin the right-of-way. '!he snaller streets are going to be private roads. CX1ly the infrastructure will be dedicated to the City. The streets serving the single-family in 1 and 2 will be public, the main road is public, and tb= street serving the patio lots. Tracts 3, 4 and 5 are private roads. Tracts 1, 2 and 7 will have sicewalks. 11. CX1 the typical fire hydrant detail, Dave Snead stated that they added a thrust block for the retaining gland. 12 . '!he concern over the 4' water main. Dave Snead stated that they do have calculations to prove that it does rreet the flaw demands. - Len Kozlov stated that he will review the respcnses and if everything seems to be fine, he will s1..ll:::lnit a letter to Bowyer-Singleton indicating that what he finds for 3 and 4 to be satisfacto:ry if it is. If there are any additional glEstions, he will contact by letter. Gil Artm3.n stated that as a result of demucking and a few other problems, there has been SOnE thinning in SOnE of the forested areas plus the buffer zone along Hayes !bad. With the heavy demucking there will be additional tree damage in that area and serre considera- tion soould be put into the point system in the Al:bor Ordinance that soould be corrplied with. John Cbvoruhk stated that he has not seen the drawing for the striping of the lanes on M:>ss !bad. Len Kozlov e~1ained that the next procedure after his review of the final engineering of Mt. Greenwood Tract 3 & 4 is the approval by the City Cbmnission. L------ \, SUBJECT: Tuscawilla Unit 14-B The revised final engineering was received on February 20, 1986. The review of this engineering resolved all issues except one and another item of note. Item 14 of my letter dated January 28, 1986 to Charles True P.E. and my second letter to Jay Alpert Item 11 dated February 7, 1986 requested that the retention pond have a slope of 4:1 or shallower. The revised final engineering dated February 20, 1986 ignored this request. The City of Winter Springs has adopted DER rulel7-25 Florida Administrative Code by reference via Section 14-122i Land Development Code. The DER did issue a general permit for the stormwater system, but due to an oversight of the permit reviewer, allowed a 3:1 slope to remain in the design. This conversation was confirmed by Mrs. Juanita Clem, DER office in Orlando. The following are recommendations that can be evaluated with regard to this issue: 1. Require the developers of Unit 14-B, Mr. Jay Alpert, Winter Springs Development Co. to install slopes at 4:1 or shallower. 2. Require the developer to install fences around the ponds with the present slope design. 3. Give a variance to allow a 3:1 on all retention ponds. The slope issue deals with safety. The shallower the slope, the easier it is for someone to get out of the pond. The other item of note is in regard to the location of the large retention pond in the wetlands of Bear Creek. If the ownership of the retention ponds are going to be transferred now or in the future to the City, it will be necessary for the developer of Unit 14-B to obtain a letter, dredge fill permit or other document of approval or a statement of no jurisdiction from the DER for installing retention pond berms in the Wetland areas of Bear Creek so as to allievate or remove any potential liability for the City. cc: City Manager Public Works Director Building Department , 1f . --- , '", -- Regular Meeting, City Commission, April 24, 1984 Page 3 83-84-14 Recommendation of the Planning/Zoning Board: Preliminary Plan (existing Tusc. PUD), Tuscawil1a Unit 14: Manager Rozansky said this has been discussed at length; the Applicant is present. The City Planner discussed the eight conditions from the Staff Report dated Feb. 24, 1984. Commissioner Grove said she would like to clarify a statement the Mayor made. He said of the residents of Tuscawi1la that were here, 99% were against and 1% in favor of. She said she would give the residents of Tuscawilla that were in attendance, maybe 99% against and 1% in favor of, but Commissioner Grove said she did not think that is representative of the population of Tuscawilla. Motion was made by Commissioner Linville to approve the residential portion of Tuscawi1la Unit 14 only, and hold off again on the road going through to Oviedo. Motion failed for lack of a second. Mr. Jay Alpert, Winter Springs Development Corp., spoke in reference to the road and their traffic study. Motion was made by Commissioner Hartman to approve the preliminary plan of Tuscawilla Unit 14 as submitted with the recommendations of Staff and the Planning & Zoning Board with the exception of Staff Recommendation No.4, seconded by Commissioner Grove for discussion. There was discussion of Condition No. 5 of the Staff Report, dated 2/24/84. ,.-, Motion was amended by Commissioner Hartman, seconded by Commissioner Jacobs, that Winter Springs Development Corp. would put in a dirt road (Vistawilla Drive) northward to S. R. 419 within 90 days after receipt of their railroad crossing permit and pave the road after two years of receipt of their permit. Discussion. There was discussion of repairs to Winter Springs Boulevard. Mr. Charles True and Roy Dye of Winter Springs Development Corp., spoke about repairs to the Boulevard and said if the deficiency in the road was caused by the Utility Company, they would go in and repair it. Mr. Troy Piland spoke in discussion. 1 Mr. Jay Alpert of Winter Springs Development Corp. said they had a long standing committement that when a signal is needed at Tuscawilla Road and Winter Springs Boulevard, that signal would be provided by the Development Company. He said they are also certain that when they go through to SR 426 that DOT will require a signal there. Vote on the motion as amended: Commissioner Jacobs, aye; Commissioner Grove, aye; Commissioner Hartman, aye; Commissioner Adkins, aye; Commissioner Linville, no; motion carried. After reviewing these drawings, it has been found satisfactory. ,- There is one issue that must be noted. The large retention pond behind lots 129 through 133 is located in the wetlands of Bear Creek. The lowest of the three bids to resurfacing certain City streets and replace the base material on a section of Mockingbird Lane is Mac Asphalt, a Division of APAC of Florida, Inc. with a total bid sum of $89,482.50. I recommend that the City Commission accept that low bid of $89,482.50 from Mac Asphalt, Inc. to do the designated resurfacing road work. All three bids are attached. 1l> '. Generally, a City does not provide lighting of the nature requested by the petition. Special landscape lighting is certainly above the level of lighting normally provided by municipalities and is handled by private land owners and/or homeowners associations. I do not believe that the City can install special lighting and then place it on a tax roll (like a special lighting district). Consequently the City would have to pay for the lighting or the homeowners association make some special arrangement with a near by property owner. Approximately two to three feet of fill material have been placed on the properties. Standing water was noted to exist behind these lots and the adjacent lots. Inspection of the area noted that there was no relief for this water. One possible solution would be for Mr. Hartman to install an 8" PVC pipe from the backside of his property to the corner catch basin to provide a relief for water, but due to the fact that the catch basin is on about 18 to 24 " deep, a head of water at the property backside will be able to relieve this water. Bear in mind the rear area will not be drained, but will provide a relief outlet. Mr. George Weigle's statement in regards to Greenbriar signs: ..-' 1. The signs are on Greenbriar's property. ,- 2. " 85-86-10 , REGULAR MEETING CITY COMMISSION FEBRUARY 10, 1986 \ The Regular Meeting of the City Commission of the City of Winter Springs. Florida, was called to order by Mayor John V. Torcaso at 7:30 p. m. Roll Call: Mayor John V. Torcaso, present Deputy Mayor William A. Jacobs, present City Manager Richard Rozansky, present City Attorney Frank Kruppenbacher, present Commissioners: Cindy Kaehler. present Arthur Hoffmann, present Philip A. Kulbes, present Martin Trencher, present For the invocation Deputy Mayor William A. Jacobs asked for a moment of silent prayer. The pledge of allegiance to the flag was led by Commissioner Cindy Kaehler. Motion was made by Commissioner Hoffmann to approve the minutes of January 27, 1986. Seconded by Commissioner Trencher. Discussion. Vote on the motion: Commissioner Hoffmann, aye; Commissioner Kulbes, aye; Commissioner Jacobs, aye; Commissioner' Trencher, aye; Commissioner Kaehler, aye; motion carried. Public Input: Former City Commissioner Leanne Grove was presented a plaque of appreciation from the Council of Local Governments in Seminole County by Mayor Torcaso. Mr. Tom Dougherty, Chokecherry Drive, spoke about problems in the Oak Forest area. He spoke about a petition that was presented to the City and to date has not received a reply; spoke about a violation of the fence law that was brought before the Code Enforcement Board; a dedicated park area that is under water; water that is flowing into Little Lake Howell by a development that is outside the City; and he spoke about a fence problem that was brought to the Code Enforcement Board. Mayor Torcaso presented a Resolution of appreciation to Mr. Dougherty for his service on the Code Board. Mrs. Helen Powell, Hacienda Village, spoke about the Hearing for Peter Cowell. Jay Hamilton, Turkey Hollow Circle, spoke about the problems with the Jacobson wall. Philip St. Laurent, Chokecherry Drive, spoke about the property directly across the street from him that is owned by Mr. Hartman, and asked for a dead tree to be removed. Mr. William Moore, Chokecherry Drive, spoke about drainage problems. Jim Hartman, former City Commissioner, spoke about the property he purchased. Bob Gray, Chokecherry Drive, presented a petition to the Commission. George Weigle, NOrthern Way, spoke about two billboards Greenbriar has on Northern Way and asked that Greenbriar be told to relocate them onto Greenbriar property. Gene Dorman, Northern Way. inquired about the Imara lawsuit appeal. General Agenda: Public Hearing for Ord. No. 326-east 200 ft. of Lots 17 and 18. Springs Hammock Replat, according to the plat thereof as recorded in P. B. 7. Pg. 96. P.R: of Seminole Co.,FL etc. (Dittmer) Second Reading: Due to changes in the law, the ordinance will be on the Agenda for the next meeting for first reading. .-- ,.^~_...._--"~--- ^.- SPECIAL MEETING CITY COMMISSION CITY OF WINTER SPRINGS FRIDAY, FEBRUARY 21, 1986 85-86-10 The Special Meeting of the City Commission of the City of Winter Springs, Florida was called to order by Mayor John V. Torcaso. Roll Call: Mayor John V. Torcaso, present Deputy Mayor William A. Jacobs, present City Manager Richard Rozansky, present City Attorney Frank Kruppenbacher, present Attorney Marsha Lippincott, present Commissioners: Cindy Kaehler, present Arthur Hoffmann, present Philip A. Kulbes, present Martin Trencher, present Imara-Appeal: Attorney Lippincott reported that an Appeal does not give the loser in a lawsuit the opportunity to begin afresh and have the matter reviewed by different judges as if the trial judge had never ruled against you. The appellate court is not permitted to reweigh the testimony. What the appellate court does do is to consider an appellate's legal challenge to the trial court's decision, keeping in mind that the presumption is that the trial court ruled correctly. Attorney Lippincott explained she had made a preliminary review, and based upon her preliminary review her initial impression was that the City's chances of prevailing on Appeal were not good. Attorney Lippincott said she would review this matter, file the notice of appeal on Monday, (Feb. 24, 1986), and come back to the Commission and give her full opinion and advice and at that time the City could make their decision whether or not to Appeal. Motion was made by Commissioner Jacobs that the City proceed with the Appellant Attorney and have her report back in one week with her response as to the City's chances for success or not. Seconded by Commissioner Hoffmann. Discussion. Vote on the motion: Commissioner Kulbes, aye; Commissioner Jacobs, aye; Commissioner Trencher, aye;Commissioner Kaehler, aye; Commissioner Hoffmann, aye; motion carried.
