As I mentioned to you, I would prefer your plans of maintaining a landscaped burm, complete with stream, on the land which is directly behind my house, as opposed to installing a fence, as was agreed upon by you and the officers of our Homeowners Association at the last City Council meeting. The homeowners who occupy the residences directly adjacent to your property have been experiencing problems with the five-foot sand burm which has been erected six feet from the rear of our homes. We are forced to keep all of the rear doors and windows closed to keep the sand out of our homes. Even so, we must sweep sand out of our patios and off the patio furniture on a daily basis. Not only is this a burden- some chore, but the fact that we cannot open our windows and doors forces us to use our air conditioning, thus causing increased electric bills. Since I am certain that you are interested in the well-being of your neighbors, I am writing you to notify you of these problems we are experiencing. Any assistance that you can give us in alleviating the problems we have been experiencing would be greatly appreciated. SW"'NN (IB95-19B4) Mr. Richard Rozansky City Manager CITY OF WINTER SPRINGS 400 North Edgemon Avenue winter Springs, FL 32708 Dear Dick: - Pursuant to our conversation of June 6th concerning the gas line which is owned by Florida Public utilities and which runs under the effluent disposal ponds, I recommend that the City enter into an agreement with Florida Public Utilities which authorizes it to continue its presence there under certain conditions. The agreement should specify that the City retains the right to use the ponds for their normal uses and the pipe may re- main in the ground for the purposes of serving the residents of Winter Springs so long as Florida Public Utilities agrees to the follm'ling: (1) To indemnify the City for any and all damages and costs associated with the existence of the pipe in its current location and during its removal and re- placement, including without limitation, any damages incurred as the result of gas leakage or explosion. This must be secured by at least an insurance policy of a minimum value of one-half million dollars and of which the City is a named insured. The City must be provided a copy of the policy and promptly noticed of any changes in the policy or cancellation of the policy and the City must agree in writing to the terms of the policy and any changes in the status of the policY1 - e . e .. _ J d~~~ Mr. Richard Rozansky June 7, 1985 Page Two (2) To notice the existence and location of the pipe. This must be accomplished by at least the place- ment and maintenance of signs at either end of the pipe as it crosses the pond and by flags or markers at specified intervals along the pipe as designated by the City; and, (3) To remove the pipe within 18 months or 90 days after the final design for relocating Shepard Road is completed whichever is later.
