Thomas, Esquire Rowland & Thomas, P.A. 308 North Magnolia Avenue Orlando, Florida 32802 Dear Drew: This letter represents our proposal, on behalf of our client, Imara Construction Company, to modify the final development plan for Fairways Club and, accordingly, to amicably resolve our dispute with the City of Winter Springs. e Our proposal seeks to address the concerns of neighboring residents, while at the same time to continue to ensure full compliance with all applicable provisions of the Winter Springs Code. The proposed modification consists primarily of the following elements: 1. The lowering to one story in height of those buildings closest to and paralleling Northern Way which, in conjunction with the dense natural vegetation and with the construction of a wall further described below, will virtually remove all such buildings from the view of those neighbors in closest proximity to the development; 2. An overall reduction in density of development by a full sixteen units. This includes the removal of twelve second story units as described above, plus the lowering to one story of that portion of the model complex closest to Fairway Oaks and a similar removal of the second story end units of the building adjacent to Fairway Oaks and the golf course; 3. Relocation of the recreation building and swimming pool from the site originally planned next to the main entrance to an area adjacent to the tennis court. In addition, the developer has deleted from the plan the installation of lights on the tennis court; e 4. The construction of a stucco wall, at least five feet in height, along the property line fronting on Northern Way and connecting with the gatehouse structure at the main entry. The e e e 'r Andrew B. Thomas, Esquire Page Two April 12, 1985 construction of the wall will further enhance the natural buffer provided by trees and thick natural vegetation in the self-imposed fifty foot setback area from the property line, and will assist in creating the luxurious estate-like setting sought by the developer. In support of this proposal, and in order to graphically illustrate its merits, we have enclosed several folders containing color photographs depicting the following: Photograph number 1 is a view of the proposed entranceway to Fairways Club. A gatehouse structure will be built among the live oaks, preserving the largest and vast majority of such trees and thereby contributing to the estate-like atmosphere. Photograph number 2 illustrates the lush vegetation bordering Northern Way. This will provide a natural buffer of a full ninety feet from the center line of Northern Way to the nearest building. Photographs numbers 3 and 4 show the fine quality, attractive homes directly across Northern Way from the subject property. Imara's proposed modifications, as set forth above, are designed to provide a stepped density approach, with one story buildings opposite the pictured homes. It is Imara's desire and intent to develop Fairways Club in a manner fully consistent with the high standard of neighboring residences. Photographs numbers 5 and 6, showing portions of Fairways Oaks, are a fair representation of how Fairways Club will appear to neighbors across Northern Way. The density of vegetation is similar, as will be the effect of the proposed wall at Fairways Club. In summary, the developer and its professional team earnestly believe that Fairways Club will be a welcome addition to its community and a source of great pride and satisfaction to its residents. We also believe that this proposal fully responds to the concerns voiced by neighboring residents, while maintaining its viability from the developer's standpoint.
