The removal of this earth at the edge of the property is presently at a grade of 1 to 1. This is both unsightly and a safety problem. The Building Official~ The City Engineer~ and I have met with Jay Alpert on the matter and are working toward a solution with these problems in mind: 1. The stability of the property; the lots and the easement. It seems that Florida Power has been aware of the removal and has reset the polls. A letter should be forthcoming to that effect. 2. The safety; at a grade greater than 3 to 1 this property must be fenced by Code; however~ after having destroyed the natural lay of the land~ to put in a fence will place the top in some places as high as 16 feet. 3. All topo lines in Oak Forest Unit 5 are incorrect and the property needs to be resurveyed to insure that the improvements have been to design. At present this would be impossible. Between the safety, the fence, and the certification all of which are in question~ I think the City Attorney needs to look at this entire issue before Unit 5 comes to final plat and before anymore finals are given on Unit 4. An Irrevocable Letter of Credit has been drafted to ensure completion of the unfinished improvements and approved by the City Attorney. He has also reviewed the DCCR's for this unit and found them acceptable. The Police Chief and Fire Chief have made inspections and found the improvements to be satisfactory. The City Engineer has noted the regrading of the swale between units 4 and 5 along the power easement. To insure the proper grading and sodding (stabilization) of the easement, no houses along that section of Unit 4 will be given certificates of occupancy until the work is completed. All six (6) hydrants in that unit meet code requirements in their present state. After discussing this with the Building Official, sodding and staking or seeding was going to be done. Please respond on which method is going to be utilized. The City Engineer has inspected the improvements and finds them acceptable; however, there is a problem presently being corrected in regard to a swale along the power easement between Oak Forest Units 4 and 5. The Police Chief states that the street signs are also not ready at this time. The Fire Chief states that the inspection on hydrants will not be available until Monday January 14, 1985.
