REQUEST: The Community Development Department requests the Commission consider the aesthetic review for a 8,464 square foot (SF) single story child care facility. PURPOSE: The purpose of this Agenda Item is for the Commission to consider the aesthetic review for an 8,464 SF on a 1.756 acre site along the north side of SR 434, south of Barrington and east of the South Seminole Christian Church. The applicant has completed the staff review process for combined aesthetic review and final engineering/site plan review and requests that the Commission consider the aesthetic review package. The final engineering and associated development agreement/notice of zoning restriction modification for this project is the subject of a separate, regular agenda item for tonight's meeting. APPLICABLE ZONING & FUTURE LAND USE DESIGNATION: Zoning: C-1; SR 434 New Development Overlay Zoning District Future Land Use: Commercial APPLICABLE REGULATIONS: Chapter 163, Florida Statutes Chapter 166, Florida Statutes Comprehensive Plan Chapter 9, City Code Chapter 20, City Code Development Agreement/Notice of Zoning Restriction CONSIDERATIONS: Overview The 1.756 acre site currently contains an existinig residential structure and a mature tree canopy. It is located on the north side of S.R. 434 and is south of Barrington Estates. The South Seminole Christian Church is located immediately to the west. The unimproved 20 foot wide Beacon Street ROW is located immediately to the east of the site. The site is scheduled for final August 10, 2009 Public Hearing Agenda Item 501 Page 2 of 4 engineering/site plan review and a development agreement/notice of zoning restriction modification (separate agenda item) at tonight's City Commission. The development agreement/notice of zoning restriction modification is associated with both the site plan and aesthetic review. Inconsistencies with Code All Code inconsistencies must be identified and addressed through variances, waivers, or a development agreement. The building-mounted sign design, although favored by staff, does not meet the overall 14 foot above grade height requirement or the 24 inch symbol/logo/letter height requirement. Staff believes the proposal is a tasteful improvement over and beyond what the sign would look like on this building, if it (the sign) were designed to code. Therefore staff supports these minor deviations from Section 20-470 of the City Code. Aesthetic Review The submittal requirements for aesthetic review are set forth in Section 9-605 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9-603. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The proposed building is to be constructed of concrete block covered primarily with stucco. The building has a brown colored architectural fiberglass asphalt fungus resistant shingle roof at a 4 in 12 pitch (4 inches vertical for 12 inches horizontal), a prominent expression line and water table, as well as a Porte cochere. (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. No other more recent site plans have been submitted in this immediate area. The proposed project represents a very positive addition to the surrounding area. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within 2 August 10, 2009 Public Hearing Agenda Item 501 Page 3 of 4 five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: (A)Front or side elevations, (B)Size and arrangement of elevation facing the street, including reverse arrangement, (C)Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed buildings do not appear excessively similar or dissimilar to the other structures in the immediate area. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. There are no other buildings or structures of the same type in the immediate area, although the structure is compatible with the nearby attached and detached residential structures. It should be viewed positively, in comparison to the metal building at the adjacent church site. The addition of this building will enhance this segment of SR 434. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Towne Center guidelines, SR 434 design specifications) and other applicable federal state or local laws. The Ladybird Academy is consistent and compatible with the intent and purpose of the Comprehensive Plan and the Development Agreement/Notice of Zoning Restriction. The overall height of the building-mounted sign and height of the symbol and the letter "y" are, however, inconsistent with Section 20-470 of the City Code and are included in the associated Development Agreement/Notice of Zoning Restriction modification. Staff believes the proposed sign is tasteful, fits appropriately onto the porte cochere, and, on this building, the sign actually functions more harmoniously than if it were provided to code specifications, and therefore supports this minor deviation from the code. (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. The project has incorporated a number of these features in an appropriate manner. FINDINGS: 1. Staff believes that the aesthetic review package meets the pertinent aesthetic review criteria. 2. The proposed development is located within the City of Winter Springs, along SR 434: it has a Commercial Future Land Use designation and is zoned Neighborhood Commercial (C-1) and is located within the SR 434 New Development Overlay Zoning District. It is subject to a 3 August 10, 2009 Public Hearing Agenda Item 501 Page 4 of 4 Development Agreement/Notice of Zoning Restriction, limiting the building height to 35 feet (building height is defined for various roof types in Section 20-1 of the City Code). Any deviations from the Code must be addressed through a development agreement, variance, waiver, or some other appropriate mechanism. 4. The proposed aesthetic review package (as well as the site plan) is consistent with the Comprehensive Plan. 5. The proposed aesthetic review (as well as the site plan) is consistent with the City Code of Ordinances except as noted -inconsistencies are addressed in the associated development agreement/notice of zoning restriction. RECOMMENDATION: Staff recommends that the City Commission approve the aesthetic review for the proposed project, subject to the proposed development agreement. State Road 434, Winter Springs, Florida 32708, and Jambar, LLC, a Florida limited liability company ("Jambar"), whose mailing address is P.O. Box 195098, Winter Springs, Florida 32719. WITNESSETH: WHEREAS, this Modification to Development Agreement / Notice of Zoning Restrictions ("Modification") is related to certain real property generally located at 282 West State Road 434 in the City of Winter Springs ("Property"); and WHEREAS, the Property is subj ect to and bound by that Development Agreement /Notice of Zoning Restrictions dated Apri19, 2007 and recorded in Seminole County Official Record Book 6659, Page 1449 ("Agreement"); and WHEREAS, Jambar desires to design, permit and constntct apre-school /daycare on the Property known as "Ladybird Academy;" and WHEREAS, the proposed engineering and site plan for the Property require variances from certain applicable toning standards contained in the City's State Road 434 Corridor Vision Plan, set forth in Article VI. of Chapter 20 of the City Code; and WHEREAS, section 20-474 of the City Code authorizes the City to vary certain zoning standards by development agreement; and WHEREAS, the parties hereto desire to amend the A~eement as set forth herein to address the parties' mutual agreement and understanding of the development of the Property. NOW THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties mutually agree as follows: MODIFICATION TO DEVELOPMENT AGREEMENT City of Winter Springs /Jambar, LLC Page 1 of 4 1.0 Recitals. The foregoing recitals are true and correct and are hereby incorporated herein by this reference. 2.0 Modification to Agreement. Pursuant to the authority set forth in section 20-474, City Code, the City and Jambar hereby agree as follows: 2.1 Masonfy tivall. Jambar shall not be required to construct an opaque wall along the northern boundary of the Properly adjacent to the single-family development, as required by 20-469(b), City Code. 2.2 Sign. Jambar shall be permitted to construct one (1) buildinb mounted sign. The sign shall not project above the roof and shall not exceed a height of eighteen feet nine inches (18'9") when measured from ground level to the top of the sign. The sign shall substantially conform to the design and measurements depicted on Exhibit "A," attached hereto and incorporated herein by this reference. 2.3 Ti-ee survey. Jambar's tree survey may be submitted to the City depicting all trees measuring over four (4) inches in DBH (instead of measured in caliper inches as required by section 20-468(20), City Code). Jambar shall satisfy any other requirements of section 20-468(20) not expressly modified by this subsection 2.3. 2.4 Sod. Jambar shall not be required to landscape the property using St. Augustine solid sodas required by section 20-468(22), City Code. Prior to landscaping the Property, Jambar shall propose to the City Urban Beautification Manager a suitable alternative to St. Augustine sod. The Urban Beautification Manager's written approval of the alternate landscaping material shall be required prior to Jambar commencing landscaping. 3.0 Joint Access Driveway. Consistent with section 20-472(d), City Code, Jambar shall provide an access easement for ingress and egress to and from the real property directly to the east of the Property, which easement shall include Jambar's driveway to and from State Road 434. 4.0 Miscellaneous. All other terms, conditions and restrictions contained in the Agreement and all requirements of the City Code not expressly modified pursuant to this Modification shali remain in full force and effect. 5.0 Recordation. This Modification shall be recorded in the Seminole County Official Records and shall run with the land. We will cut rolls to exact size for local deliveries and pick-ups only. Deliveries made out of state will receive full rolls. We recommend ordering a few extra feet than needed. When more than 50' of fence is needed for a stretch, rolls can be woven together easily. Chain link is easily cut to size by removing one link. Hoover Fence Company carries two types of vinyl coated chain link fabric. One has 2" mesh, the other has a tight 1-1/4" mesh. The 1-1/4" mesh fabric is specified frequently for pool safety reasons and to help prevent climbing of the fence. 1-1/4" Mesh Vinyl Coated Chain Link Fabric: This fabric is black in a 48" height only. 2" Mesh Vinyl Coated Chain Link Fabric: This fabric is available in heights of 36", 42", 48", 60", 72", 84", 96", 120", and 144". It comes in green, black, brown, and white. About gauges: The smaller the number, the heavier the fabric; henceforth 9ga. is heavier than 11ga.. We recommend 11ga. for residential jobs and 9ga. for commercial jobs. Heavier gauges are not only stronger, but have a better finish; The heavier the gauge the longer it may be 'hot-dip galvanized' to prevent rust and corrosion. Vnyl coated chain link is sold by the finish gauge. 9ga. chain link vinyl coated actually has a thinner inner steel wire. It is considered 9 gauge once it has been coated, although the inner steel wire is nearest 11 ga. What is extruded vinyl? In layman's terms, extruded vinyl. when cut with a knife, can be peeled off like a banana. However, it does not peel easily. That is what makes extruded different then bonded vinyl, which would have to be cut off completely, much like peeling a potato. Bonded costs more than extruded. We do not sell bonded vinyl fabrics. About knuckles and barbs: Fence fabric is available two ways. Chain link fabric under 72" high is available with knuckles on both ends. Chain link fabric 72" and taller comes with knuckles on one end and barbs on the other end. (two barbs are formed when the chain link is twisted at one end, see illustration). About mesh size: The galvanized fabric mesh for 11-1/2 gauge measures 2-1/4". The 11 and 9 gauge galvanized mesh meaures 2". This lens should be used in typical offices or rooms where occupants work for extended periods of time. The Vandal Resistant lens should be used in high abuse or public areas, where oocupartts simply come and go and make larger types of motions.
