One is that the private roads designed do not meet the public road standards in right-of-ways, sidewalks, and cul-de-sacs and another is that trees shall be removed from right-of-ways. The Staff recommends that each of these be waived in this instance to allow a 40 foot right-of-way with no sidewalks to allow trees to remain in the right-of-way including some islands in the middle of the paving and cul-de-sacs have a shorter turn around radius than would be required on a public street. There is only one additional condition that we put on this recommendation. There is a street going west which ends in multiple cul-de-sac, which did have some one way traffic and some two way traffic. The Police Chief would prefer that that all be one way and the Developers have agreed with that. Motion was made by Commissioner Hartman, seconded by Commissioner Jacobs that we re- approve final engineering for Hawk's Landing subject to the City Engineer's recommendation and the City Planner's memo. Discussion. Vote on the motion: Commissioner Linville, aye; Commissioner Jacobs, aye; Commissioner Grove, aye; Commissioner Hartman, aye; Commissioner Adkins, aye; motion carried. Planning & Zoning Board recommendations of Oct. 12, 1983: Preliminary Plan for Casa Park Villas in Tuscawilla: The City Planner explained the property is to the west and north of Phase I of Tuscany Place. This property originally was to be future phases of Tuscany Place but has been acquired by a new developer and the preliminary plan submitted is to be fhases I and II of Casa Park Villas. The development differs from Tuscany Place in 4It~that it will be rather than garden apartments as a condominium, it will be ~ee-simple >> townhouses with common areas and private roads controlled by a homeowners association. ~r. Allen Ginsburg, speaking for Casa Park Villas, the proposed development, said they are setting up a $10,000 opening budget. If the homeowners themselves decide that a tot lot is necessary or desirable by a majority vote, they can vote to do so, and there will be money available to build it. ~ ~tion was made by Commissioner Jacobs, seconded by Commissioner Hartman, to approve ~the preliminary plan for Casa Park Villas as presented with a waiver of road ease- ments as allowed under Sec. 14.95 allowing 30 foot easements with a minimum of 20 foot ~setbacks from the paving line and subject to the Engineer's memo of 10/25/83 and the condition the developer set up a $10,000.00 opening budget (as he so stated he would) ~to be governed by the homeowners association. Public Property-Moss Road Site: Commissioner Adkins said that by putting the retention area in there we are g~v~ng away city property which could and should be used for something else, either sold or developed as City property in the future when it is feasible and financially equitable to do so. Bill Holmes, Conklin, Porter and Holmes, explained that the City is going to be required to put in this retention area by DER and the St. John's River Management District. Castellano have been completed with the exception of son~ work now in orogress on the jogging exercise path. All Phase 5 amenities are scheduled to be completed for the end of this year. Currently there are 2,225 developed lots in the Tuscawilla ~.U.D. There at'e also 192 lots now under developmel:t. In January we will be starting Phase 6 amenities. Consider hiring a qualified utility director shortly after the holidays so that he/she will have the advantage of taking part in the take over/organization of NOWSCO. e (1) I have had meetings with officials of NOWSCO, other public and private utilities, our consulting engineer, and our attorney. Presently I am in the process of compiling necessary data from all of the above in order to produce necessary check lists, a take over plan, and recommendations on how I feel the take over will best be completed. It was after reviewing compiled data, meeting with various officials and attempting to compile the referenced documents that it became apparent to me that it would be beneficial to hire a utility director. c. I am concerned about the ability of NOWSCO to effectively dispose of their total committed capacity, be it .85, .70 or .95 MGD. I discussed this with our consultants and was informed that the answers to my questions should come out in the physical inspec- tion report of our consulting engineers. 2. In the mean time we have scheduled a workshop for December 20, 1983 at 7:00 P.M. Mr. Lang concurs and feels we should hold a workshop on the subject of NOWSCO. In our proposal, we state that at selected locations, we will observe excavation and exposure by either the City or NOWSCO of main water lines to verify the material of construction, general condition, and depth of cover. Please note that NOWSCO will not provide any excavation equipment and/or labor assistance for these excavations. Also, NOWSCO will require insurance certificates from the personnel or firms pertaining to these activities prior to access. Is the City of Winter Springs able to provide the required equipment, personnel and insurance for these excavations? Please advise our office of the City's response so that we may act accordingly. An alternative method for investigation may be available. Hand augering is labor intensive and does not provide information on the condition of the pipe or the materials of construction. Provide utility company field personnel to assist in locating water mains, sewer collection lines, etc., and furnish access to plant facilities and lift stations, for inspection and testing activities. It is desired that any requests you may have for field records during the course of your investigations be made in writing to Mr. John Hall at our Winter Springs office, with a copy of the request sent to me. Utility company field personnel will assist in your investigations as per #1 above, however, we will not be able to perform any physical activities for your inspectors. This would include such activities as excavation of lines, assisting in lamping or televising of sewer lines, performing fire flow testing or any electrical testing, etc. All inspections and testing activities will need to be coordinated with Mr. John Hall, (327-1641), or me. Access to plant facilities and other utility systems located in public right-of-ways and private easements will be provided by the utility company. However, access to the golf course and possibly other private properties will require the consent of the responsible parties. We would, of course, reserve the right to perform re-testing and be present during any testing/inspection activities. We would also appreciate receiving copies of all testing and inspection reports. As we discussed, the utility company is very concerned with the possible damages that may result to the utility systems due to the inspection and testing programs proposed. We will expect the City of Winter Springs and your firm to accept full responsibilities and all liabilities for these activities. In addition, the personnel and/or firms performing these activities will need to have complete and sufficient insurance coverages.
