Torcaso, present Deputy Mayor Buck Adkins, present City Manager Richard Rozansky, present City Attorney Frank Kruppenbacher, present Commissioners: Jim Hartman, present Inez Linville, present Bill Jacobs, present Leanne Grove, present Request approval for the use of Waferwood: Sam Smith, Building Official, found waferwood installed on a house in a routine inspection without the proper identification stamp as required by the Southern Building Code Congress International, Inc. Commissioner Hartman asked the representatives why this product did not have a stamp on it. Mr. ,Hugh Jordan of Louisiana Pacific, manufacturers of this product, said that their stamp machine malfunctioned. He said they would give the city a letter stating it is their product, it is manufactured to the standards and they would stand behind it. Mr. Smith asked what happens if the product does not hold up and the roof has to be replaced. Who pays for that? Mr. Jordan said if the product does not perform as specified in the standard, we will stand behind it. Commissioner Adkins asked if they would also pay for the removal of the roof and a replacement of the roof? Mr. Jordan said that is standard procedure, if the product fails, and this actually happens from time to time, you can get a mismanufactured product, what we normally pay for is the labor to replace it. Commissioner Adkins asked would you specifically state that you would pay for the tearing off of the shingles, the hauling away and the cleaning up and the replacement of the board and a replacement of the shingles after the board was replaced? Mr. Jordan said yes, we could state that because that is standard procedure. Mr. Smith asked what the warranty is, is it the life of the shingles? Mr. Jordan said the standard warranty on the product is four years. He said they were also plywood manufacturers, and plywood manufacturers do not give any warranties. But he said we have to stand behind the product, and since this is a relatively new product, we will put it in writing and stand behind it. Motion was made by Commissioner Hartman that we accept the letter in place of the stamp stating that it is their product and that they would assume the responsibilities for it. Seconded by Commissioner Adkins. Discussion. Vote on the motion: Commissioner Jacobs, aye; Commissioner Grove, aye; Commissioner Hartman, aye; Commissioner Adkins, aye; Commissioner Linville, aye; motion carried. The easement is to be sold along with the property to the west recently redesignated to be a mixed multi-family and commercial development. The new development will not be interconnected with the previous phases of Wildwood, so that the right-of-way across the easement is unnecessary. Staff recommends the portion of Wildwood Drive over the FPC easement be vacated contingent upon reconstruction of the terminus of the existing pavement to create a cul-de-sac for safe turnaround for residents of Wildwood. The City Engineer's suggestions to accomplish this are attached. The City Attorney is modifying the standard vacation resolution we have used in the past, to abandon not only the platted right-of-way but also a small portion of paving (about 40 feet) that extends onto the easement. Since the statute on vacating public rights-of-way requires a public hearing, all we request at this time is an indication from the Commission as to whether they wish us to proceed, so we may publish legal notice of the impending public hearing. /'l /. . Therefore, we are requesting that the City of Winter Springs abandon and/or vacate that certain portion of Wildwood Drive described as follows: That portion of WILDWOOD DRIVE (appearing on the plat of WILDWOOD, recorded in Plat Book 19, Pages 7, 8, 9 and 10, Public Records of Seminole County, Florida) which extends into and is surrounded by the Florida Power Corporation Easement recorded on said Plat of WILDWOOD. The above described portion of street is surrounded entirely by real property we are conveying to Walter Dittmer, Jr. pursuant to action by the City of Winter Springs to allow him to develop a modified PUD running from Shepard Road to Florida Avenue in Winter Springs. Since Mr. Dittmer's property completely surrounds the said street we are requesting to be vacated, it would appear there are no further notice requirements. It is our understanding that City Commission approval for a vacating of street petition is required, and if this is correct, we request the same. Thank you for %ur continuing cooperation.
