All Aye. Motion carried. REQUEST OF CFIUCK SCHMITZ FOR APPROVAL OF PRELIMINARY PLAN FOR PIN~vOOD TERRACE ON SOUT~ MOSS ROAD. The City Planner described this proposed quadruplex development. Chuck Schmitz and Chris Derato, the developers, were present to speak for the application. Hr. Schmitz presented a diagram of the property and pointed out the green area they hoped to leave. Kaehler inquired about the parking areas and if there were provisions for overflow parking. Questions from the Board. Discussion on the development and the mobile home park. Discussion on Staff recommendation in favor of waiving dedication of land for park, since recreation facilities will be provided. ~azio made the m~tion to approve the project, for discussion. Seconded by Smedley. Discussion on parking. Kaehler offered amendment to motion to include the recommendations of Staff and also to include stabilized additional parking spaces, three per building if possible. Seconded by Joshi. Vote: All Aye. Amendment carried. Vote on original motion as amended: All Aye. Motion carried. FURTHER BUSI~LSS Board asked for clarification on approval of final engineering for Church of New Covenant without review by board of changes made to the preliminary plan. The Chairman commented that we hope that action of th~s nature will be used very discreetly because it sets a precedent to by.pass the Board. Regular meeting was adjourned at 8:51 PM. HORKSHOP REVISION OF' COMt.1ERCIAL ZONING CODE Smedley distributed some proposed changes to the draft of the proposed zoning code written by the City Planner, which were agreed to be incorporated. Board discussed the timetable for their review of the balance of the draft and when it will be submitted to the Commission and forwarded to the property owners. FLORIDA 32708 Telephone (305) 327-1800 April 29, 1983 TO: Planning and Zoning Board S~~ECT: Preliminary Plan for Pinewood Terrace A Staff Review was held on Thursday, April 28, 1983, at 9:00 M~. to consider the preliminary plan for Pinewood Terrace, a quadruplex development to be built on the east side ofiSouth Moss Road, adjacent to Hacienda Village. Located in Zone C-l, the project was given condit- ional use approval by the Board of Adjustment with the condition that (1) it be limited to eight quadruplexes, that (2) an on-site playground with facilities be provided, and that (3) a 6-foot fence be constructed around all three sides abutting other properties. Pinewood Terrace will con~rise 32 townhouse units on fee-simple lots with coro~on areas for access and parking, recreation and stormwater management. The one street to be built will be public. A record plat will be filed, along with deed restrictions creating a homeowners' association. The engineering aspects of the preliminary development plan are approved by the City Engineer with the provisos in his memo of April 25, 1983. The Fire Chief requires that the single hydrant be relocated more 'centrally on the cul-de-sac than now shown. Police and Fire Depart- ments. fin~ the design satisfactory for emergency access. Planning and Building Departments suggest additional sidewalks, leading to the units themselves, in addition to the one shown along the street. The preliminary~lan for Pinewood Terrace is reco~~ended for approval subject to the following conditions: (1) The final plan shall include details of the natural landscaping,to be left as well as landscaping to be added adjacent to buildings and parking areas. (2) A lighting plan be submitted both for the public street and for the . common areas. (3) Details shall be provided regarding development of the playground area. . . . ~,. continuation - Pinewood Terrace April 29, 1983 E'lanning and Zoning Board (4) The final plat shall include cross-access easements to all lot owners who will need to utilize common driveways and shall preclude direct access from Lots 1, 7 and 8 to Moss Road. (5) The deed restrictions shall include provisions for regular maintenance of the wood fence around the periphery of the property, the playground facilities, and the co~mon area lighting. (6) All provisos of the Engineer's memo of April 25, 198}, and the Fire Chief's requirement to relocate the hydrant shall be fulfilled. (7) Sidewalks shall be added from the street to the individual Q~its and from each unit to its parking spaces. Since Section 14-62 provides for a waiver of dedication of five percent of the land in a subdivision to the public for recreation where less than 20 acres is to be developed and since Pinewood Terrace will have its own on-site recreation facilities for children, the Staff recommends the Commission waive the dedication of five percent of the land to the public. The modification, as shown on the map provided you with t~e minutes of their April 20, 1983 meeting, provides for a buffer of duplexes along the boundary with the patio home area of Wildtvood, with a strip of commercial lots in the center and industrial lots on the western edge of the 30 acres that had been designated for multi-family. . The Board found the request consistent and therefore approvable. By Code, this would effect approval of the amendment. Clarification by Hatfield on the motion. Second for discussion by Ha'cfield. Discussion. Smedley' withdrew his motion and Hatfield withdrew the second. Discussion. Motion by Smedley to table the matter until such time as !~. Dittmer can provide the Board written specific restrictions as he has discussed. Seconded by Kaehler. Discussion. Motion by Hatfield to approve Mr. Dittmer's application contingent upon or modified by the restrictions of his March 4th letter: (1) Total square'footage of building not to exceed 35% of the property area. (2) Front setback to offer sufficent capacity ~ water retention accomplished by undulating landscaping(as opposed to fence~ off ~cavation as often used).(3) Building plans to be submitted to owners' revieri board for approval prior to construction. (7) Owners will be subject to maintenance fee required to maintain all common areas. Another.area of concern is that the whole new road from Shepard Road to Florida Avenue be developed expediently so that the traffic impact can be handled(dispersed). Contingent upon County approval, Mr. Dittmer "rill participate in the surfacing of Florida Avenue from the property to the main highway (US 17-92). The five.lots (1 to 5) that back up to the duplexes be changed to POD COm2ercial, and the others to.PUD In~ustrial. Since then we have not been in a position to proceed with the final engineering for this subdivision. When requested by the city, typical cross sections of the proposed grading, roadway and sidewalk, preliminary plans of proposed potable water and fire-fighting systems, sanitary sewage system, storm water management systems. I request you allow me to " shop around " for an acceptable grader. I am convinced as is the City Engineer, that we will find what we are looking for in the price range we are willing to pay. .
