REGULAR SESSION CITY COUNCIL CITY OF WINTER SPRINGS MAY 8, 1979 The Regular Session of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The invocation was given by Councilman Bennett. The pledge of allegiance to the flag was led by Councilman Jacobs. Roll Call: Mayor Troy Piland, present Deputy Mayor Wilfred Arnold, present City Manager, Richard Rozansky, present City Attorney Wally Stalnaker, present Councilmen: William Jacobs, present John Bennett, present Laurent Pellerin, present John Torcaso, present Public Input: Laurent Pellerin, Jr. discussed the letter from Kenneth vI. McIntosh reference the change of zoning on the Binford Property on Moss Road from C-2 to C-l. Motion was made by Councilman Jacobs to approve the minutes of May 1, 1979. Seconded by Councilman Torcaso. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. Pub lic Hearings: Equalizing Board Hearing on Paving & Drainage Improvements, N. Orlando Ranches, Sec. 2 & 2A: . Mayor Piland recessed the Regular Session and opened the Equalizing Board Hearing. Mr. Gary Hunt, 659 Marlin Road; Mrs. Gail Desabrais, 653 Marlin Road; Mr. Richard Shott, 630 Sailfish Road and Mrs. Louise Poole, 642 Marlin Road all spoke in discussion; all residents of North Orlando Ranches Sec. 2 & 2A. Mr. Ned Julian, Attorney, Sanford, Florida, non-resident, spoke in discussion. Mayor Piland closed the Hearing and reconvened the Regular Session. Motion was made by Councilman Arnold that under the provision of Sec. 5 of Resolution No. 248, the City Council determine that the lineal front footage upon which the assessments are based is the longest side of the property abutting the improvements. Seconded by Councilman Jacobs. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, no; Councilman Torcaso, aye; motion carried. Motion was made by Councilman Arnold that prior to adopting a resolution under 170.08 Florida Statute, the City Council consider any properly documented individual cases of. alleged hardship or injustice that may be submitted to it during the period of 8 May through 23 May 1979. Seconded by Councilman Torcaso. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. Public Hearing for Ordinance No. 193 - rezoning from R-l to C-l along SR 434 between Sherry and Wade Streets: . 11otion was made by Councilman Bennett to read Ordinance No. 193 by title only. Seconded by Councilman Jacobs. Discussion. T acted to protect the private home owners on Moss Road from having the neighborhood plagued with a C-2 Zoning which is in fact the worst kind of "SPOT ZONING". . .3. Mayor Piland recessed the Council meeting and convened the public hearing for purposes of hearing comment on proposed Ordinance No. 193, rezoning between Sherry and \Ij'ade Streets along S. R. 434 from R-l to C-l. Hrs. Nancy Booth, Longwood-oviedo Road, Mr. Edgar Smart, 411 Long\..rood-oviedo Road and Hr. Jack Hoyt, 417 Longwood- Oviedo Road spoke in discussion. Mrs. Booth and Mr. Smart spoke against the ordinance. Mayor Piland closed the public hearing and reconvened the Regular Session. Motion was m2de by Councilman Bennett that Ordinance No. 193 be tabled until such time that an adequate determination can be made as to the tax structure that will be applied against those properties by Seminole County. Seconded by Councilman Torcaso. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, no; Councilman Bennett, aye; Councilman Pellerin, no; Councilman Torcaso, aye; motion carried. City l1anager Rozansky \VaS asked to get the information from Seminole County. Public Hearing for proposed Ordinance No. 189, rezoning request from RU to C-2 of Mr. Mike Alexatos on Lots 1 and 2, Entzminger Farms, Add #2, etc.; Motion was made by Councilman Pellerin to read proposed Ordinance No. 189 by title only. Seconded by Councilman Arnold. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. Attorney Stalnaker read Ordinance No. 189 by title only. ~ Mayor Piland recessed the Council Meeting and convened the public hearing for purposes of hearing comment on proposed Ordinance No. 189. No one spoke against:the ordinance. Mayor Piland closed the public hearing and reconvened the Regular Session. Motion was made by Councilman Bennett to approve Ordinance No. 189 on second reading by title only. Seconded by Councilman Jacobs. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. City Manager - Richard Rozansky: Mrs. Shirley Shupe, 738 Mimosa Court, asked about parks and recreation for City residents. The City Planner was asked to make a study of all lands in subdivisions deeded to the City for parks and recreational purposes and to determine the status of surrounding development in order to estimate when the land might be improved for use as a park. Manager Rozansky introduced the new City Planner, Jacqueline Koch. Manager Rozansky discussed the public works compound and his recommendations. Motion was made by Councilman Pellerin that Manager Rozansky be authorized to contact the City Engineer, draw up proper specifications and advertise for bids. Seconded by Coun~ilman Jacobs. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. ~ There was discussion of the mosquito control program. Motion was made by Councilman Pellerin that we advertise for bids for a spray machine for the mosquito control program. Seconded by Councilman Torcaso. Discussion. Manager Rozansky briefed the Council on the status of the truck for the Public Works Department. He was asked to negotiate with the Dealership for the initial bid price at the direction of City Council. Manager Rozansky briefed the Council on the budget charges for the Wastewater Transmission Authority and that he intends to write a letter to the utility companies in reference to paying their share. Manager Rozansky has sent a letter to Florida Land Company in reference to the fire hydrant problem on Moree Loop. There was discussion of the utilization of the Community Building and the damage being done. Council Seat I - William Jacobs: The monthly report has been distributed. Coucil Seat II - Wilfred Arnold: There was discussion of the monthly finance report. Council Seat III - John Bennett: There was discussion of the monthly Police Department report. ~ Council Seat IV - Laurent Pellerin: The monthly Building Department report and Public Works Department report were discussed. Councilman Pellerin discussed the problems with the fire station at Tuscawilla. Councilman Pellerin discussed the letter from Mr. McIntosh reference the rezoning of Binford property on Moss Road. Motion was made by Councilman Pellerin to place on the agenda the ordinance changing the zoning on the Binford property on Moss Road from C-Z to P.U.D. to temporarily protect the people in the neighborhood against any C-2 being constructed on the property for the time being. Seconded by Councilman Torcaso for discussion. Discussion. Vote on the motion: Councilman Jacobs, no; Councilman Arnold, no; Councilman Bennett, no; Councilman Pellerin, aye; Councilman Torcaso, no; motion failed. Motion was made by Councilman Pellerin to place on the agenda Ordinance No. 195. Seconded by Councilman Arnold. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried. Motion was made by Councilman Pellerin that Ordinance No. 195 be removed from any further action and be declared null and void due to the fact that it is contrary to the existing ordinances. Seconded by Councilman Arnold. Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
