Hoss Road winter Springs, Florida 32707 In re: Good Driver Incentive Fund Dear Chief Govoruhk: Enclosed please find a copy of an Administrative Order entered September 8, 1977, by the undersigned relative to the Good Driver Incentive Fund. The effect of the enclosed order is to direct the Clerk of the Court to no longer collect the $30.00 on payable moving traffic infractions. The civil penalty for payable infractions will now be $25.00 plus the 5% surcharge for the Crimes Compen- sation Trust Fund, for a total of $26.25 instead of $57.75. It having e,e to the attention of tht Court by the nc""s - -- - - - - - m0dia that the Supreme Court of Florida has declared S 42 of Chapter 77-468, Laws of Florida, uncoIlstitutional on September 7, 1977, and this court having erltered an order dated this date nunc pro tunc August 4, 1977, ordering the Clerk of this Court to place In escrow or in all separate identifiable account all monies collec- ted pursuant to said law until further order of this court, and this court having not yet received a copy of the order of the Supreme Court of Florida, and it appearing necessary to enter an interim order relative to fUIlds collected by the Clerk of this Court pursuant to 5 42 of Chapter 77-468, Laws of Florida, it is, upon consideration: ORDERED and ADJUDGED: 1. That the Clerk of this Court continue to hold all monies heretofore collected pursuant to S 42 of Chapter 77-468, Laws of Florida, until further order of this court. 2. The Clerk of this Court is hereby directed to no longer collect the $30.00 additional civil penalty pursuant to S 42 of Chapter 77-468, Laws of Florida, from those persons who are not required by law to make a court appearance. 3. That any additional civil penalty hereafter paid to the Clerk of this Court be retained in escrow or in a separate identi- fiable account pursuant to the administrative order dated September 8, 1977, nunc pro tunc August 4, 1977.
