SPECIAL SESSION CITY COUNCIL CITY OF WINTER SPRINGS September 19, 1977 The Special Session of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The pledge of allegiance to the flag was led by Councilman John Sabatini. Roll Call: Mayor Troy Piland, present Deputy Mayor John Daniels, present City Attorney Gary Massey, present Councilmen: Don Sines, present Ernest Hendrix, present Claude Ash, present John Sabatini, present The Special Session was called at the Special Session on Friday, September 16 to discuss three items; the moratorium on building permits, in-house bookkeeping and the certification of two firemen. Only one item was discussed on Friday and that was in reference to the moratorium on building permits. Councilman Ash said he has a conflict of interest on this issue and as long as he gets a letter in before 15 days, he is able to vote on the issue. . The motion that was tabled is as follows: Motion was made by Councilman Daniels that we instruct the consulting engineering firm of Clark, Dietz & Associates to proceed with utmost haste in developing a drainage and road stabilization plan for this area which will solve the drainage and bring up the roads to an acceptable dirt road standard and 2, that we instruct the City Attorney to proceed with drawing up the necessary documents to facilitate and carry out the total 100% assessment of all costs associated with this project to the adjacent property owners and 3, specifically that this City Council concurs that the total cost of making the drainage and road stabilization project plus associated engineering fees and any interest charged on loans that the City has to make to finance this project will be totally assessable to the adjacent property owners. Seconded by Councilman Sines. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, no; Councilman Daniels, aye; Councilman Ash, no; Councilman Sabatini, no; motion fails. Motion was made by Councilman Hendrix that we lift the building moratorium until we receive the engineering report from Clark, Dietz & Associates regarding possible drainage problems in the Silver Creek - Sailfish areas and in the interim that we red flag each lot with a possible drainage problem and instruct the building department to review each permit on its own merit and without delay issue a building permit or require the flood proofing of each specific lot so that there will not be a problem in the future. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, no; Councilman Hendrix, aye; Councilman Daniels, no; Councilman Ash, aye; Councilman Sabatini, aye; ul.ouion carried. The City Attorney was asked to gather all necessary information on how this assessment can be done and to develop some preliminary approaches that he can present to the Council in response to any questions such as "what is the extent of the assessment allowed by law in dealing with drainage, etc." There was discussion again of in-house bookkeeping. Councilmen are in favor of doing the bookkeeping in-house but they asked for more quotations. This will be discussed next Monday night. There was discussion of the two firemen that the state will not certify because of vision problems. Councilman Daniels asked Attorney Massey to see if their continued employment places our state revenue sharing funds in jeopardy and Mayor Piland asked Attorney Massey to look into the state statutes regarding this matter.
