REGULAR SESSION CITY COUNCIL CITY OF WINTER SPRINGS AUGUST 8, 1977 The Regular Session of the City called to order by Deputy Mayor Mayor John Daniels. The pledge Don Sines. Council of the City of Winter Springs, Florida was John Daniels. The invocation was given by Deputy of allegiance to the flag was led by Councilman Roll Call: Mayor Troy Piland, absent Deputy Mayor John Daniels, present City Attorney Gary Massey, present Councilmen: Don Sines, present Ernest Hendrix, present Claude Ash, late John Sabatini, present Motion was made by Councilman Sines to approve the minutes of July 25, 1977. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, absent; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. Planning & Zoning Report, Councilman Sines: The Planner's report has been distributed. Councilman Sines asked Councilmen to give their comments to the City Planner on the Comprehensive Plan before the next Council meeting. Discussion of the Comprehensive Plan will be on the agenda for the next meeting. Election and Finance Reports, Councilman Daniels: Councilman Daniels reminded everyone that the qualifying period has been changed to September 1 to September 15, 1977. Councilman Sines said they will be having a registration day and that he will report on the details at a later date. Motion was made by Councilman Hendrix to have the Attorney set up a public hearing for the proposed budget. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, absent; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. There was discussion of having a referendum or a Special Election to see if the people want a full time administrator. Motion was made by Councilman Hendrix that a Special Election be held September 13, 1977 for the purpose of obtaining direction from the citizens of the City of Winter Springs as to whether or not to have the following: 1. A full time paid administrator; 2. Whether or not that administrator be a full time paid Mayor or City Manager. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Sines, no; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, no; motion carried. Mr. Kanyok asked permission from Council to have three dogs. Motion was made by Councilman Hendrix that we grant Mr. Kanyok permission to have three dogs at his residence, 901 Gazelle Trail. Seconded by Councilman Sines. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. ... . . . Reg. Session, City Council, Aug. 8, 1977 Page 2 76-77 -32 . There was discussion with Mr. Herbert Munson of lot 578, Winter Springs, Unit 4 who had a fence problem. Mr. Munson wanted to fence his back yard down to the lake portion of the drainage easement and he was told he could not. Before Deputy Mayor Daniels made a motion, he relinquished the chair to Councilman Hendrix. Motion was made by Councilman Daniels that our Building Department be directed to issue a permit for Mr. Herbert Munson, Lot 578, Winter Springs, Unit 4, to fence his property including the drainage easement on the rear side of his property so long as he complies with all recorded restrictions written and interpreted to exist within the restriction by our City Attorney. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. Police Department Report, Councilman Ash: Copies of the Police Department report have been distributed. Councilman Ash read the letter from Dr. Earl Weldon of Seminole Community College appointing Chief Govoruhk to the L. E. Advisory Council for the 1977-78 year. Public Works Department, Councilman Sabatini: The monthly report has been distributed. Councilman Sabatini discussed his memo to Council in reference to the purchase of the Southeast Metalcraft Building. There appears to be no funds available to purchase this building for a public works complex. Deputy Mayor John Daniels recessed the Council Meeting and opened the Public Hearing for Ordinance No. 156, expansion of the Planning & Zoning Board. Attorney Massey read the ordinance in its entirety. No one spoke against the ordinance. After discussion Deputy Mayor Daniels closed the public hearing and reconvened the regular session. . Motion was made by Councilman Hendrix to accept Ordinance No. 156 on the first reading with the noted corrections: Adding to Section 44.07 "Vice Chairman" after Chairman in both first and second sentences; In Section 44.10 - include after duties "upon adoption by City Council of the Comprehensive Land Plan"; In Section 44.11 - not later than March 31, 1977; In Section 44.14 - after applications "alterations in the City's Comprehensive Plan" and adding "163" as well as 166. In Section 44.16 - same correction as in 44.14; In Section 44.l6.l-a - all applications for rezoning within the City shall be presented to the Planning & Zoning Board which at the discretion of the P&Z Board may call a public hearing thereon. The City Council shall require a public hearing. In Section 44.l6.l-b - reverse 15 and 7 days; and 44.l6.l-c - change 15 to 7. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. Motion was made by Councilman Sines to read the second reading of Ordinance No. 154 by title only. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. Attorney Massey read the second reading of Ordinance No. 154 by title only. Motion was made by Councilman Sines to adopt Ordinance No. 154 by title only on the second reading. Attorney Massey read the second reading of Ordinance No. 155 by title only. Motion was made by Counci1aan Sines to accept Ordinance No. 155 on the second reading by title only. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Ash, aye; Councilman Sabatini, aye; Councilman Daniels, aye; motion carried. Deputy Mayor John Daniels recessed the Council Meeting and opened the public hearing for the alteration to the Tuscawi11a Planned Unit Development. No one was present from Winter Springs Development Corporation. The public hearing is to be continued until the next Council Meeting. Deputy Mayor Daniels closed the public hearing and reconvened the Regular Session. There was discussion with H.I.Hennan & Company in reference to water and sewer system financing project. This is to be on the next agenda for Council to set a Workshop Session with this company. A Personnel Policy Workshop session was set for August 15, 1977, 7:30 p.m. . Deputy Mayor Daniels reported that at the Council of Local Governments meeting Judge Dickey talked about traffic fines. The next meeting of the Council of Local Governments will be held on the first Wednesday in September in Sanford City Hall. Representatives from Colonial Life Insurance Co. were present and asked for payroll deductions for the employees who had wanted that program. They were asked to present a list of the employees who wanted the program and this is to be On the agenda for the next meeting to see if Council will authorize payroll deductions.
