The invocation was given by Mayor Troy Piland. The pledge of allegiance to the flag was led by Councilman Don Sines. Roll Call: Mayor Troy Piland, present City Attorney Gary Massey, present Deputy Mayor John Daniels, present CounciLmen: Don Sines, present Ernest Hendrix, present Claude Ash, late John Sabatini, present Motion was made by Councilman Sines to approve the minutes of June 6, 1977. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, absent; Councilman Sabatini, aye; motion carried. Motion was made by Councilman Sabatini to approve the minutes of the Special Session of June 9, 1977. There was one correction: change 90 stencils to 12 Choir-L90 stencils. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, absent; Councilman Sabatini, aye; motion carried. Mayor Piland recessed the Regular Session and opened the Public Hearing for Ordinance No. 152 the re-zoning of certain lands from RU to RC-l. Motion was made by Councilman Daniels to read Ordinance No. 152 by title only. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. Attorney Massey read the first reading of Ordinance No. 152 by title only. Mr. Jack Glatting spoke for the ordinance and for the re-zoning. Mrs. Mary Williamson was concerned about Tradewinds road being extended into their project; however she was informed that only the change of zoning was being considered at this time. It was asked of Attorney Massey to add to ordinances with legal descriptions a general description so the average layman would know where the property is located. No one spoke against the ordinance. Mayor Piland closed the public hearing and reconvened the Regular Session. Motion was made by CounciLman Daniels to adopt Ordinance No. 152 on the first reading by title only. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. There was discussion of the ordinance adopting a policy for pits, quarries, etc. It was suggested that we find out how man y borrow pits there are in the city, public and private. . . . e e Regular Session, June 20, 1977, City Council Corrected 76-77 -26 Page 2 Motion was made by Councilman Daniels to set a public hearing for this ordinance and that concurrently we have a city employee research and provide to each of the Council members a listing and location of all the current holes of water that fall within this. Seconded by Councilman Sines. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, no; Councilman Daniels, aye; Councilman Ash, no; Councilman Sabatini, no; motion failed. This ordinance will be on the agenda for the next meeting for more discussion. Recommendations to alter the sign Ordinance were discussed. Mayor Piland said after talking with Mr. Bradshaw, there are two items that could alleviate the problem we are having with the sign ordinance. One is "Outdoor Advertising Signs", Section 5-113. When we apply that to Sec. 5-114, item 3, "On all state, county and municipal roads, outdoor advertising signs shall be no closer than 1500 ft. from any other outdoor advertising sign and on the same side of the highway, not closer than 300 ft. from any point of sale sign." Mr. Bradshaw's recommendation is we can make a very simple change - we can go to an outdoor advertising sign and specify the square footage. In other words we go to: "shall mean a sign over 64 sq. ft. in that definition. In ot~er words if we have a large billboard you would put the restriction that they should not be any closer than 1500 ft. to one another and that releases the smaller signs to be controlled. The enforcement part is that we can't permit them because they are too close together. You would eliminate about 50% of the signs in the City. The Mayor is to have the exact wording on the changes, and this will be discussed at the next meeting. The Police Department Reserves were discussed. Each Councilman was given a copy of the Police Department Reserve Policy. Councilman Ash said we need to get this into effect and this won't cost the City any money and you will qualify your policemen. You will have a backlog of policemen to fall back on when you need them. They are fully trained and fully qualified to do the work of any police officer you have. Mayor Piland said right now we have no auxiliary or reserve force officially existing - we have a couple of people that are official because they have been made official in past years and continue to be carried on our force, but right now what we are running into - there's occasion when we need more than our paid officers and what we need to do is to establish some procedures and rules that this group will go by if this Council adopts this. If and when this Council adopts a Personnel Policy and they get into adopting those policies by resolution, this could also be adopted by resolution to insure that these people are operating under the guidance and approval of the City Council and otherwise I don't think its legal for them to operate. I don't think its legal for auxiliary police officers or a reserve officer to ride with one of our policemen without the consent of our City Council. This program should cost the City zero. It would require the individual to be a certified police officer and they must serve a certain number of hours each week. Councilman Daniels said when he has a problem he wants a paid Winter Springs police man to respond to it and I believe the other citizens do to. I have no objections of having a reserve officer come with him but as far as taking over the police car and filling in a shift unless we have some dire emergency, I would be opposed to it. A reserve will ride along with a paid police officer and it also allows in an emergency situation you have the additional force if you need them. They do this to maintain their status. Councilman Ash said if something happens to one of our officers we have to hunt someone up and train him, but with the reserves we have someone to fill his place. Motion was made by Councilman Ash that we adopt the reserves for the Police Depart- ment. Seconded by Councilman Hendrix. In discussion, Councilman Daniels said our insurance coverage provides for no more than one at anyone time of our reserve police force. We would have to make sure that our insurance coverage would guide the program and Councilman Daniels said he would vote for this with the addition of 8A -Reserve officers will not patrol alone except in cases of emergency as determined by the Police Chief or senior officer on duty. Mayor Piland said that when the Personnel Policy is adopted, this should become part of it. We have never had anything in writing that officially says that this group is sancitioned- it needs to be sanctioned by this City Council officially. Councilman Sines said he feels that this should be made a part of the Personnel Policy. There was discussion of the ordinance changing Section 6-32 of Chapter 6 of the Code of ordinances which applies to fire hydrants. Right now we have a problem that pursuant to this ordinance there have to be fire hydrants in the ranchlands in order for houses to be built. It is very clear it makes allowances for that - it puts the burden on the owner of the property to get a variance from the City Council due to a hardship exept on those cases where there are no water lines within 750 feet, and in those cases they can go ahead and build. . Motion was made by Councilman Daniels that the ordinance repealing Section 6-32 be adver.tised for public hearing. Seconded by Councilman Sines. Discussion. Attorney Massey's report on the Day Care Center at the Winter Springs Baptist Church: Attorney Massey said as long as this is part of the church's ministry it would be allowed but if it went beyond those bounds - as a completely separate commercial establishment then it would have to be looked at again. Motion was made by Councilman Daniels that the Mayor be directed to sign the rejection form removing uninsured motorist coverage from our umbrella policy. Seconded by Councilman Hendrix. Discussion. Vote on the motion:Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. The Zoning Board Recommendations from their meeting of June 9 are as follows: Three items were discussed. Item #1 - The re-zoning requested by the City from R1A to Cl. The Board voted for the change. Item 2 - The change in the Highlands PUD requested by Florida Land Company. They are requesting certain areas be changed from multi-family to single family. . e e Regular Session, June 20, 1977, City Council Page 4 Corre~ed 76-77-26 ~ This item was sent to the Attorney for determination. Item 3 - Request for a change in the preliminary plat of the Tuscawilla PUD from multi-family to single family. The Board voted to approve the changes as requested. Motion was made by Councilman Sines to set a public hearing for an ordinance to re-zone the property requested by the City from Rl-A to C-l. Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. Motion was made by Councilman Hendrix to set a public hearing for the prelUninary change in the Tuscawilla PUD. Seconded by Councilman Sines. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. Payment of the East Central Florida Regional Planning Council dues was discussed. Motion was made by Councilman Daniels to place the item of payment of the E.C.F.R. P.C. dues on the agenda for action. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. ~ Motion was made by Councilman Daniels that we pay our annual dues to the E.C.F.R. P.C. for the fiscal year 1978 as in the past, $500.00 to be paid on or about 1 July 1977 and $5GO~00 to be paid on or about 1 January 1978, to be paid from Line Code 6-331. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried. Attorney Massey is to discuss the Double Taxation lawsuit with Attorney Mize on June 21, 1977 and then report back to Council. If a decision is necessary, a special Council Meeting will be called. A representative from Colonial Life Insurance Company spoke to Council about a disability income plan. Council gave permission for the representative to talk to the Department Heads. Councilman Daniels reported that the CETA office is still asking for more projects. If anyone has a project, we will submit it. Councilman Daniels reported there was a complaint on the recreation program in the Tuscawilla area. One lady told h~ that as bad as the program was last year, it was good compared to this year. She had loaded up all of the neighborhood children and taken them down and when she got there, there was one young lady and one helper for that young lady and there were some other kids there. They were playing with a chess set, and the young lady had told her that they had sent no other equipment out, that there were no bathrooms, no drinking water. We were aware that the trailer had been pulled out of there. We agreed to contract with the "~' some $2200 to provide us with a viable recreation program, and while ~ . . . '. .. e e corrected Regular Session, June 20, 1977, City Council Page 5 76-77-26 it went off like "gangbusters" in this general area, it sure didn't go off like"gang- busters" in the otherer side of town and I am very concerned that apparently the effort was put in here and not there. We have taxpayers that live in both sides of town and I think we all realize that. This mama was mad because her kids and not only hers and the other neighborhood kids were not provided for. She was concerned that the lady told her they were going to make a three day trial and if there is not enough turn-out, we are going to cancel this program. I recall that this Council moved to provide a program at a two location rate and I don't recall that anything was said that we would cancel if it wasn't used. I think we have to provide a viable program if its going to be used. I don't know what can be done about this site. Last year when I made the arrangements, I made arrangements to have a bathroom and water. I told this lady that it was not my program and I am very concerned because I am an elected official and they called me. I think we better get with this Recreation Program and get with it fast. I prevailed on her not to be discouraged and to please take her children back tomorrow. I hope it will be a better program tomorrow. Councilman Daniels said he had talked to Nick Castellano and perhaps the area adjacent to the Country Club could be made available where there are water fountains and a shelter. The "Y" yet has not provided as good a program as we provided last year. I hope that we are not supplementing the "Y's" over-all activitt at the expense of our young people in this City. Councilman Sines reported the Planning Commission held their Public Hearing on June 11 to satisfy the rules of the Local Government Comprehensive Planning Act of 1975 and the Seminole County Comprehensive Planning Act of 1974. The Commission voted to accept the plan as written. There have been a few changes made in the Plan. Each Councilman was asked to return their copy to the City Planner and he will make the changes. Councilman Sines asked for permission to distribute copies to all the cities and the State. Permission was granted. The next Council Meeting will be June 27, 1977. Meeting was adjourned.
