Mayor Piland opened the Workshop Session at 7:30 p. m. for the purpose of discussing the telephone system. Mr. John Sabatini, representing the Florida Interconnect Telephone Company, was present to discuss this new system. Mr. Sabatini distributed copies of a proposal to the Councilmen. After a discussion Mr. Sabatini asked the Councilmen to come to his office to see this system in operation. Mayor Piland closed the Workshop Session and opened the Regular Session. The invocation was given by Councilman Hendrix. The pledge of allegiance to the flag was led by Mr. Don Sines, Chairman of the Zoning Board. Roll Call: Mayor Troy Piland, present City Attorney Gary Massey, present Deputy Mayor Donald Browning, absent Councilmen: John Booth, present Ernest Hendrix, present John Daniels, present Claude Ash, present Motion was made by Councilman Daniels to approve the minutes of June 14, 1976. Seconded by Councilman Booth. In discussion, Councilman Booth asked that a correction be made on page 2, second paragraph from the bottom, change the second to the motion from Councilman Booth to Councilman Ash. Vote on the motion: Councilman Booth, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, absent; motion carried. . Mr. Bill Holmes of Clark, Dietz and Associates, City Engineers, was present to discuss the proposed conceptual layout of the Wildwood Subdivision. We are to invite National Homes to a Workshop Session and notify them that our engineers have come up with a layout and if they are willing to accept this, we will go on farther to work with them on developing the engineering that is necessary to carry out the total project. Attorney Massey read the second reading of Ordinance No. 134 (Planned Unit Development ordinance) by title only. Motion was made by Councilman Hendrix to adopt Ordinance No. 134 on the second reading by title only. Seconded by Councilman Booth. Discussion. Councilman Daniels pointed out there was no mention of a requirement for the developer as to when he must get underway and when he must accomplish certain phases. Attorney Massey is to include something that would have the requirement of substantial development in there as well as that it has to be done within one year's time and to allow this Council to have the flexibility of either rescinding the final approved plan or giving them an extension to develop at the end of one year and the same thing on the preliminary, at the end of another year. Notion vlas made by Councilman Daniels to table the above motion for one ~veek. Seconded by Councibnan Booth. Discussion. Mayor Piland recessed the Regular Session and opened the public hearing for Ordinance No. 137, annexation of property of George St. Laurent. Attorney Massey read the first reading of Ordinance No. 137. No one spoke against the ordinance. Councilman Hendrix spoke for the annexation. Mayor Piland closed the public hearing and re- convened the Regular Session. Motion was made by Councilman Booth to adopt Ordinance No. 137 as read on the first reading. Seconded by Councilman Hendrix. Discussion.' Vote on the motion: Councilman Booth, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, absent; motion carried. Mayor Piland recessed the Regular Session and opened the public hearing for Ordinance No. 138, annexation of property of the ~~inter Springs Development Corporation. Attorney Massey read Ordinance No. 138 in its entirety. Mr. Charles True was present, representing the Winter Springs Development Corporation. No one spoke against the ordinance. Mayor Piland closed the public hearing and reconvened the Regular Session. Councilman Daniels asked Attorney Massey if we can approve the zoning on the first reading and also approve the preliminary plat during this action? Attorney Massey answered yes we can. Motion was made by Councilman Daniels that we approve Ordinance No. 138 as read with the following amendment: Section 2, add - and hereby make this property a part of the Planned Unit Development now known as Tuscawilla. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Booth, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, absent; motion carried. . Motion was made by /Councilman Daniels that we approve the preliminary plat of the parcel of property depicted on this piece of paper (property of the Winter C3prings Development Corporation to be known as Tuscawilla Unit 5). Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Booth, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, absent; motion carried. Councilman Daniels asked that this property be known as Tuscawilla, Unit 5 rather than Tuscawilla Estates and Mr. Charles True had no objection to that. Motion was made by Councilman Daniels that the plat just approved was approved with a private dirt road with a full understanding that the owners of the six lots that front on it have the full and absolute responsibility for the maintenance from this date forward for maintenance and upkeep of this road. Seconded by Councilman Booth. Discussion. Vote on the motion: Councilman Booth, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, absent; motion carried. There was a discussion with residents of Hacienda Village about the electrical problems. Next week Attorney Massey is to furnish a report of what legal recourse the City can take. Attorney Massey explained that the proposed public hearing for the annexation of Tract A, North Orlando Ranches Section 3 was not held because it was determined that that property is in the City of Casselberry. . . .. e e Regular Session, City Council, June 21, 1976 Page 3 7 5 -7 6 -37 . Attorney Massey reported that he had received a letter from the Attorneys for Southern States that they would be willing to refund Winter Springs customers from May 1, 1975 through September 23, 1975, and if this was not acceptable they would be willing to discuss this with Council. Mr. Kravitz is to be invited to attend the next Council Meeting to discuss this with Council and residents involved. Attorney Massey was asked for the procedures for updating the Zoning Map. The official opening of the Tuscawi11a Fire Suation will be next Saturday, June 26, at 11 A. M. Motion was made by Councilman Daniels to adjourn. Respectfully submitted, /YZ-tZtr r ~.~~ Mary T.
