REGULAR SESSION CITY COUNCIL CITY OF WINTER SPRINGS MAY 17, 1976 The Regular Session of the City Council of the City of Winter Springs, Florida was called to order by Deputy Mayor Donald Browning. The invocation was given by Councilman Irwin Hunter. The pledge of allegiance to the flag was led by City Attorney Gary Massey. Roll Call: Mayor Troy Piland, present City Attorney Gary Massey, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Claude Ash, present Motion was made by Councilman Daniels to approve the minutes of May 10, 1976. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, aye; motion carried. Councilman Daniels discussed the Finance Report. A copy has been distributed to all Councilmen. Councilman Daniels said we are seven months through the year and are 52% expensed and 60% of the revenues have been collected. Councilman Daniels said we are on firm ground. There was a discussion of Attorney fees. The question was asked if we have to have the Attorney present at all Council meetings, and Mayor Piland said he would ask around to the other cities to see what their procedures are and report back to Council. . In discussion of the Public Service Lawsuit, Attorney Massey said the costs to appeal the case would be approximately $1500 to $2000, and that we had a 20-25% chance of winning. Mayor Piland asked Council to wait until next Monday to make a decision in order to get some response from the public on whether or not to appeal the case. Attorney Massey read Resolution No. 162 for the purpose of vacating and abandoning a certain portion of an easement in Foxmoor Unit 1. Motion was made by Councilman Hendrix to adopt Resolution No. 162. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, aye; motion carried. In discussion of animal control, Mayor Piland reported that he had gone to the department that handles the calls and apparently there is a communication problem. Mayor Piland said he would approach the County Commissioners and ask for the services that we are entitled to. In discussion of the Supreme Court Decision which says that Counties are not allowed to charge taxes of city residents for services that are provided to people living in unincorporated areas. After a discussion, Councilman Daniels suggested that a letter go to the County Commission from the Mayor's office telling them . e e Page 2 75-76-33 Regular Session, City Council, May 17, 1976 . that we are aware of this decision and we are expecting them to do something about it. It was suggested that a committee be formed to review the County budget, take their services and break them down line by line to determine if we received any substantial benefits. Mr. Conklin, City Engineer, was present to discuss the 201 Facility Planning with the Council. The 201 Planning facility is a preliminary step in the construction of a wastewater collection and treatment facility on an area-wide basis. Mr. Conklin stressed the tmportance of this project and urged the Council to get in- volved with it. Mr. Conklin also discussed the Burgos Road tmprovements. He said since the east- westerly ditch was an existing ditch, there is not much the City can do about it because it is so big we could not ask this gentleman (Dennis R. Unroe) to do anything about it or the City does not have the money to pipe it; but the back of the lots would have to be fenced with an appropriate fence at least four feet. Mr. Conklin said they did offer to pipe those areas that border their lots on the north-south ditch and Mr. Conklin said he would try to get htm to pipe up to the next street. Motion was made by Councilman Daniels that the matter of procedures for annexation be placed on the agenda for action. Seconded by Councilman Hendrix. Discussion. Motion was made by Councilman Daniels that the Planning & Zoning Board be requested to present at its earliest possible convenience a draft ordinance dealing with annexation of additional property to the city. Seconded by Councilman Ash. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that we advise the Planning & Zoning Board that they are to receive and process all requests for annexation to the City and that they are to make recommendations to the City Council concerning each annexa- tion request. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye;Councilman Ash,aye; Councilman Browning, aye; motion carried. Mayor Piland read the letter from Mr. Sawyer, principal of the Winter Springs Elementary School, and passed it on to Councilman Ash who is to work up a proposal for our summer recreation program. We also need to discuss the recreation program with the County. We will have to look at all the aspects before we decide what we are going to do. A committee of Councilman Daniels, Councilman Hendrix, and Councilman Ash was formed to study the restructuring of the Public Works Department. This will be on the agenda next week for action. A meeting was set for Saturday morning at 8:00 A. M. at the City Hall. Mayor Piland read the resignation from Councilman Irwin Hunter. Motion was made by Councilman Hendrix to accept the resignation of Irwin Hunter with extreme regrets. Seconded by Councilman Ash. Discussion. Motion was made by Councilman Browning that the City furnish Mr. Hunter with a resolution of appreciation for the many hours that he spent helping the City and has put his heart into it. Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Browning, aye; motion carried. Mayor Piland read the letter from John Newsome regarding the vacancy on Council. Councilman Daniels also recommended that Mr. Don Sines name be considered to fill the vacancy left by the resignation of Irwin Hunter. This will be on the agenda next week. Mr. James Ray reported on a bad water problem at Cedarwood Court and Alderwood Street_ South in the Terraces. Cal Conklin is to look into the drainage problem and he said all the pipes would have to be inspected to see that they are open. The meeting was adjourned. Respectfully submitted, . ?-~;. ~ Hary T.
