HomeMy WebLinkAbout1975 11 12 City Council Special Minutes . ,.. .-.. .~ ~ BUILDING l......_'ARTMENT INVESTIGATION SPECIAL SESSION CITY COUNCIL CITY OF WINTER SPRINGS NOVEMBER l2, 1975 The Special Meeting of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The peldge of allegiance to the flag was led by Councilman Browning. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present Attorney Brock answered Councilman Daniels question whether or not the Mayor could ask questions and the answer was that there was nothing in the charter that would prohibit it. Mrs. Janice Mullins was questioned by Council. The test~ony of Elder Williams from the meeting of November 11 was played for Mrs. Mullins. Attorney Ackert questioned Mrs. Mullins. Motion was made by Councilman Browning that Affidavit No. 10 be dismissed on the basis thattbere is conflicting testimony in the real heart of the subject, and I think it has been brought out by investigation that it does cost to make re- inspections and that was the information that was being related in this conversation as cited. Motion died for lack of a second. r Mr. Bradshaw was questioned by Council. Councilman Daniels said that he conferred with the Attorney, and having been advised among other things, that it is only proper that some action be taken on this particular subject this evening. He said he recognizes that the testimony on the part of Mrs. Mullins and Elder Williams in his mind have related what they heard. They have interpreted what they heard said to be what they related to us that they heard said. Mr. Bradshaw has been questioned and we have heard his interpretation of what he says he said. We have the report of a polygraph test which Mr~ Daniels requested a copy be sent to the City for their official records. Mr. Daniels said that everyone that has appeared here and spoken has done so in the best interest of this investigation, the City and good government. r Motion was made by Councilman Daniels that the Building Inspector, in the methodology of his conversations with Mrs. Janice Mullins in the presence of Elder Williams, possibly ~part the impression that money was being asked for in renumeration for his services, reocgnizing however, that as described by Mr. Ray Bradshaw, that he could have s~ply been relating the fact that the City has authority to charge additional fees for reinspect ion. Accordingly, Mr. Bradshaw is instructed that in the future that references to any additional fees for inspections/reinspections be either completely refrained from or officially stated as a "City charge for inspection/ reinspect ion" and collected, not threatened; further that he is instructed to refrain from non-essential conversations during the conduct of his official function as City Building Inspector. Further that he (Mr. Ray Bradshaw) is instructed to assure that all further actions on his part be conducted in such manner to preclude even possibly bnparting wrong ~pressions and that affidavit No. lO be dismissed. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter. no; Councilman Hendrix. no; Councilman Daniels. yes; Councilman Van Eepoel. yes; Councilman Browning. no; motion failed. Motion was made by Councilman Daniels to set 11 P.M. as adjour~ent time for this evening. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter. no; Councilman Hendrix. aye; Councilman Daniels. aye; Councilman Van Eepoel. yes; Councilman Browning. no; motion carried. Motion was made by Councilman Hunter to recognize that all individuals presenting testbnony on Affidavit No. 10 gave their honest interpretation and that the entire situation is subject to each individual's own interpretation that there is no concrete evidence that an actual solicitation for remuneration was made and that we also recognize that a further definition is needed in the Building Department - administrative out- line. Therefore. I move we dismiss Affidavit No. 10. Seconded by Councilman Hendrix. Discussion. r Motion was made by Councilman Browning to amend the motion that we acknowledge that testbnony has been accepted as in all the affidavits and that there was no evidence of wrong doing on the part of Mr. Bradshaw and therefore the affidavit is dismissed; and that this is further evidence of citizen displeasure with the procedures in the building department and that this further points out the need for administrative structure to be developed within the Building Department. Seconded by Councilman Hendrix. Discussion. Vote on the amendment to the motion: Councilman Hunter, aye; Councilman Hendrix. aye; Councilman Daniels, no; Councilman Van Eepoel. no; Councilman Browning. aye; motion carried.{Qualify "All Affidavits" as to Affidavits Received) Vote on the amended motion: Councilman Hunter, aye; Councilman Hendrix. aye; Councilman Daniels. no; Councilman Van Eepoel, no; Councilman Browning. aye; motion carried. Motion was made by Councilman Daniels that a copy of the polygraph test that was referred to by both Mr. Bradshaw and his attorney. Mr. Ackert. be provided direct from the official administering the test. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels. aye; Councilman Van Eepoel, no; Councilman Browning. aye; motion carried. Meeting was adjourned.
