SPECIAL SESSION CITY COUNCIL CITY OF WINTER SPRINGS t""'\ NOVEMBER 4, 1975 ) The Special Session of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The pledge of allegiance to the flag was led by Councilman Irene Van Eepoel. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present The purpose of the meeting was to review Affidavit No. 1 Mayor Piland read the letter from Mr. Bradshaw's Attorney, Terrence Ackert. Mr. Gary Hunt was sworn in and was questioned by Council. Mr. David Moreland was sworn in and questioned by Mr. T. Ackert. Mrs. Marlene Rossiter was sworn in and asked questions by Mr. Ackert. Mr. Bradshaw was sworn in. Mr. Ackert asked him several questions and then he was questioned by Council. r Motion was made by Councilman Daniels with respect to Affidavit No.1, that we acknowledge that errors were made in the Building Department in that the Building Department did not ascertain prior to the issuance of the permit for the Seminole Baptist Temple that the Council had approved variances in set back requirements for this conditional use, recognize the basis for the Building Department's issuance of the permit and that there was apparently no malicious intent on its part, still recognize that unacceptable administrative errors were made in this permit issuance. Recognize that the administrative errors were primarily the result of a lack of administrative procedures and policies in the Building Department. Further, that this whole issue of administrative procedures for the building, sub-division and zoning sections of our code are given priority for correction by the Council, the Planning and Zoning Commissioners and Building:Department. Further, dismiss this affidavit at this time. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that we review the remainder of the affidavits next week. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman Browning, aye; motion carried. Motion was made by Councilman Van Eepoel that the following people be issued sub- poenas for next week's meeting: Mr. & Mrs. Robert Andersohn, Newman Brock, Mr. Justice, Mrs. Janice Mullins, Mrs. Karen Raley, Troy Piland, Mrs. John Daniels. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, no; Councilman Hendrix, aye; Councilman Daniels, no; Councilman Van Eepoel, yes; Councilman Browning, no; motion failed. Motion was made by Councilman Daniels to subpoena the following witnesses for next week's meeting: Mr. Robert Andersohn, Mr. J. T. Justice, Mrs. Janice Mullins, the contracto% mentioned in Affidavit No. 10. Seconded by Councilman Browning. Discussion. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, no; Councilman Hendrix, no; Councilman Daniels, no; Councilman Van Eepoel, yes; Councilman Browning, no; motion failed. Motion was made by Councilman Browning to subpoena the person mentioned in Complaint No.5, requested by Terrence Ackert. Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that in the future sessionsof this hearing that we do allow the person whose affidavit is under consideration to speak before final action is taken. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. MOtion was made by Councilman Daniels that we subpoena Mrs. Karen Raley. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, no; motion carried. Meetingwas adjourned.
