The pledge of allegiance to the flag was led by Councilman Donald nro'lftting. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, late John Daniels, present Irene Van Eepoel, present Motion was made by Councilman Browning on the basis of explanation by Mr. Bradshaw of the allegation in complaint No.5, 1 move that it be dismissed. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, no; Councilman Daniels, no; Councilman Van Eepoel, no; Councilman Browning, aye; motion failed. Attorney Brock read Affidavit No. 6 in its entirety. Motion was made by Councilman Hunter that this be accepted as a valid complaint. Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. (' Motion was made by Councilman Hunter to dispose by the fact that the worst problem has been previously handled by a letter from the Mayor. Seconded by Councilman Browning. Discussion. Attorney Brock read Affidavit No. 7 in its entirety. Motion was made by Councilman Daniels that complaint No. 7 be accepted as a valid complaint. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;/Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; moti~n carried. Motion was made by Councilman Daniels that Affidavit No. 9 be disposed of. Seconded by Councilman Browning. Discussion. Attorney Brock read Affidavit No. lO in its entirety. Motion was made by Councilman Hunter that we accept Affidavit No. lO as a valid complaint. Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Hunter, aye; CounciLman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Affidavits Nos. l, 3, 5 , 6 and 10 have been accepted as valid complaints. Motion was made by Councilman Daniels that the next investigative meeting be devoted to Affidavit No. 1 and that the necessary city records that are involved in the issue, that is the permit for that particular building and the site plans for the site; everything that was submitted initially and anything that was sub- mitted subsequently be presented, the record of issuance of the permit of the Seminole Baptist Temple which will reflect the date and time of the initial request as well as the issuance and any other pertinent city data concerning the issuance of the permit in question in this particular affidavit. Seconded by Councilman Hendrix. r Motion was made by Councilman Hunter to amend the motion that this investigation of Affidavit No. 1 be carried on by issuing subpoenas to Mr. Hunt and Mr. Bradshaw. Seconded by Councilman Hendrix. Discussion. Vote on the amendment: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, no; motion carried. Vote on the main motion as amended: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye;Councilman Van Eepoel, yes; Councilman Browning, no; motion carried. Motion was made by Councilman Daniels that the next meeting be set for 7:30 p. m. next Tuesday, November 4, 1975. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman HendriX, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that the Clerk be directed to act as the Council's agent in swearing in the witnesses as they are called. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Hunter that at the request of Mr. Bradshaw's Attorney, subpoenas be issued to the Planning & Zoning Board Members for next Tuesday, November 4, 1975. Seconded by Councilman Hendrix. Discussion. Attorney Newman Brock submitted an oral resignation to City Council. Reason given was undue harassment and embarrasment. Motion was made by Councilman Hunter that an apology from the Council be issued Mr. Brock and that Mrs. Van Eepoel be censured for her actions and be admonished strongly for her continued attack upon Mr. Brock. He is representing the City - he was hired by the majority of the City and 1 feel that he has done a fair job under considerable pressure. Seconded by Councilman Browning. In discussion of the motion, Councilman Daniels asked that no one act in haste - the motion on the floor is inappropriate at this meeting, and that Mr. Brock reconsider, and if he feell he must go through with this, then do that at a Regular Session. Vote on the motion: Councilman Hunter, aye; qualified, that it is the wrong forum, but it still stands as a good motion; Councilman Hendrix, aye; Councilman Daniels, aye; same qualification and add to it "it had to be said"; Councilman Van Eepoel, no, qualified - this is a definite political move; Councilman Browning, aye; motion carried.
