The invocation was given by CounciLman John Daniels. The pledge of allegiance to the flag was led by Councilman Donald Browning. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present Motion was made by Councilman Van Eepoe1 to approve the minutes of October 13, 1975. Seconded by Councilman Hendrix, discussion; vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoe1, yes; Councilman Browning, aye; motion carried. City Attorney Newman Brock read the second reading of Ordinance No. 128 by title only. Motion was made by Councilman Van Eepoe1 to approve the second reading of Ordinance No. 128 by title only. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. r There was a discussion of 609 David Street and Mrs. Smith was present. Chief Govoruhk stated they had cleaned up the front yard and the drainage problem was not a health problem. Councilman Daniels cautioned that the City should be very careful in what it instructs the Smith's to do regarding their yard. Councilman Van Eepoel asked Chief Govoruhk to give the Smith's some written instructions they could use as guidelines. Councilman Browning read the letter from Mr. William A. Barker, Sanitarian, which was written to Chief Govoruhk in reference to the drainage problem in the back of the Cumberland Farms Store. Motion was made by Councilman Daniels that we instruct the Building Official to determine the exact location of the sewer line down there and that he ascertain if according to the law this property should not be hooked to the sewer line rather than the septic tank; and if so, he initiate the necessary action to have it accomplished post haste, and if not that he continue action with the County to make sure that any septic tank that is there, provided it can legally be there, adhere to all established state standards. Seconded by Councilman Browning. Discussion. I"'" Motion was made by Councilman Daniels that the Mayor's office forward a letter tomorrow to the proper officials of Cumberland Farms instructing them that they will correct the drainage problem ~ediately and further advise them in this communication that necessary corrective actions will be commenced not later than seven days from the date of the letter and further advising them that if either deadline is not met that they will be issued a summons for violation of the appropriate chapter of the City Code and each day of non-compliance is another violation. The installation of the two culverts on Stoner Road were discussed. Motion was made by Councilman Daniels that both our Building Department Official and the Firm that owns the land out there be admonished in writing for the actions that they have taken with this respect and that they both be apprised of the fact that we do have laws governing this type of action and that they are both expected to comply to the fullest. Seconded by Councilman Van Eepoel. Discussion. Motion was amended by Councilman Hunter to comply with the City Code. Seconded by Councilman Daniels. Discussion. Vote on the amendment to the motion: Councilman Hunter, aye;qualified - due to the fact that he is the administrative head of the Department and he gave the instruction to handle the permits by letter while the forms were being printed that he accepts the admonishment personally for the Building Department; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Brown ing, aye; motion carried. r Motion was amended by Councilman Daniels that we send a lettertQ-the.ownersof the ,property thatw.-e appreciate your efforts to improve the roads and rights of way in the. City and accept the two installed culverts on Stoner Road which will be left there permanently. We would appreciate your compliance with city codes when future improvements to city roads or rights of way are contemplated."lSeconded by Councilman Van Eepoel. Discussion. In discussion of repairs to the building, a letter is to be sent to Mr. Juergenson giving him the go ahead. Another meeting is to be set tentatively for November 17, at 6:30 with Council, Mr. Conklin, Mr. Juergenson and the paving sub-contractor to inspect the asphalt. Two bids were received for police cars, but as advertising had not been authorized by Council the bids are to be returned. Motion was made by Councilman Van Eepoel that the bids be returned with the notation on the envelope that they were opened but the contents were unread. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels to accept the specifications for the police cars as modified. Seconded by Councilman Hunter. Discussion. Seconded by Councilman Hunter. Discussion. 'Regular Session, City Council, Oct. 20, 1975 Page 3 75-76 -3 r Mr. Nelson Whittaker, resident of the Terraces, asked for an amendment to the sWUDming pool ordinance. Councilman Daniels presented a proposed amendment. Motion was made by Councilman Daniels that the Attorney be instructed to set up a public hearing for an amendment to the sWUDming pool ordinance No. 125 to correct the specified errors presented by the Central Florida Chapter of the National SWUDning Pool Institute as presented in the rough draft. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoe1, yes; Councilman Browning, aye; motion carried. There was a discussion of the proposed amendment to Ordinance 119 which Attorney Brock presented and read. It was suggested that this proposed ordinance should also include that in every case where a sign is to be approved, a time specific is to be determined and not more than six months; also, that the fee be based on $15.00 per square foot of sign. and then to proceed with a public hearing. Motion was made by Councilman Browning that we deny the use of the tractor for the Fall Festival at the Winter Springs Elementary School based on our City Attorney's opinion. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman Browning, aye; motion carried. r Motion was made by Councilman Daniels that the Fire Department be authorized to place the Pirsch Fire truck on static display at the Fall Festival conducted by the P.T.O. To be displayed at the discretion of the Fire Chief; this discretion to include the allowing of children to climb on the running board and the back board under close supervision. Seconded by Counci1man Browning. Discussion. Vote on the motion: Counci1man Hunter, aye; Councilman HendriX, no; Councilman Daniels, no; Councilman Van Eepoe1, no; Councilman Browning, aye; motion failed. Motion was made by Councilman Browning to extend the meeting for ten minutes. Seconded by Councilman Hunter. Discussion. Vote on the motion: Counci1man Hunter, aye; Councilman Hendrix, aye; Counci1man Daniels, aye; Councilman Van Eepoe1, yes; Councilman Browning, aye; motion carried. There was a discussion of the six months residency requirement in order to qualify for city election. Attorney Brock said it was his legal opinion that provision is unconstitutional. Motion was made by Counci1man Daniels to extend the meeting to 10:30 p.m. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman VanEepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that we put the Volunteer Fire Dept. Turkey shoot on the agenda. Seconded by Counci1man Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman HendriX, no; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. II"""', Motion was made by Councilman Daniels that the Volunteer Fire Dept. be allowed to conduct their annual turkey shoot on the three week-ends UDnediately preceding ThanksgiVing, Nov. 8 and 9th, Nov. 15th and 16th and Nov. 22nd and 23rd in the field here which belongs to Florida Land Co. which they have obtained permission to use from the owners and their line of fire will not be toward the City Hall, and they will take the necessary precautions in conjunction with the Police Dept. -/' {'. Motion was made by Councilman Hendrix to cancel the meeting Tuesday evening and postpone it until next Tuesday for the continued investigation of ' the building official-department. Seconded by Councilman Browning. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoe1, yes; Councilman Browning, aye; motion carried.
