(', SPECIAL SESSION CITY COUNCIL CITY OF WINTER SPRINGS OCTOBER l4, 1975 The Special Meeting of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The pledge of allegiance to the flag was led by Councilman Donald Browning. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present Attorney Marsee was present to advise Council the date had been changed for the depositions~to Monday, October 20. Mayor Piland stated the purpose of this meeting is actually as an investigative body to see what charges Council feels must be investigated. The affidavits were numbered as follows: No. 1 submitted by Gary Hunt; No. 2 submitted by Irene Van Eepoel, "Rules of State of Florida Dept. of Health & Rehabilitative Service"; No.3 submitted by Irene Van Eepoel, BuildingDept. Investigation "Mr. Ken Hester"; No.4 submitted by Irene Van Eepoel, Building Dept. Investigation 'rwinter Springs City Council gave final approval, etc."; No.5 submitted by Robert O. Andersohn and also signed by Mr. J. T. Justice; No.6 submitted by Robert O. Andersohn; No.7 submitted by John H. Van Eepoel; No.8 submitted by Walter Parkhurst, liOn July 19, 1973,etc.lI; No.9 submitted by Walter Parkhurst, "In 1973 1 bought, etc."; No. 10 submitted by Janie. Mullins. r Attorney Brock read Affidavit No. I in its entirety. Motion was made by Councilman Hendrix that we approach eac h individual application in its entirety alone on its own merit rather than tear each one apart. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that we ilefine what the function of the building department is and more specifically define what the current occupant of the building official position was told his job was and what type of instruction he received when he was hired and what type of subsequent instruction he has received directing the performance of his duty. Seconded by Councilman Browning. Discussion. Vomon the mo,ionz Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that we accept Affidavit No. 1 as a valid complaint. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Counci1man Hunter, aye; Councilman Hendrix, aye; Counci1man Daniels, aye; Counc.ilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Attorney Brock read Affidavit No. 2 in its entirety. Motion was made by Councilman Hendrix to accept this as a valid complaint. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, no; Councilman Hendrix, aye; Councilman Daniels, aye; Counci1man Van Eepoel, yes; Councilman Browning, no; motion carried. (' ----- /'\ .1""""\ .. Special Meeting, City Council, Oct. 14, 1975 Page 2 ~ Motion was made by Councilman Daniels that Affidavit No. 2 submitted by Mrs. Irene Van Eepoel be acknowledged as requiring definitive procedures in the Building Department and that a violation did occur in the issuance of four building permits for installation of septic tanks, such violation chargeable to a lack of administrative procedure on the part of the City Council and the building official and that we dispose of this Affidavit. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman Browning, aye; motion carried. r. Attorney Brock read Affidavit No. 3 in its entirety. Motion was made by Councilman Daniels to accept Affidavit No. 3 as a valid complaint. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Attorney Brock read Affidavit No. 4 in its entirety. Motion was made by Councilman Daniels that we accept Affidavit No. 4 as a valid complaint. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels to move on to Affidavit No.5. Seconded by Councilman Van EEpoel. Discussion. Vote on the motion: Councilman Hunter, no; Councilman Hendrix, no; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, no; motion failed. Motion was made by Councilman Browning that we dispose of Affidavit No. 4 on the basis that it is an administrative error. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, no; Councilman Van Eepoel, no; Councilman Browning,a aye; motion carried. Attorney Brock read Affidavit No. 5 in its entirety. Motion was made by Councilman Van Eepoel to take Affidavit No. 5 and have it reevaluated after Statement No. 10 which would give us sufficient tUne to think of the contents and to arrive at a consideration. Motion died for lack of a second. Motion was made by Councilman Daniels that we accept Affidavit No. 5 as a valid complaint. Seconded by Councilman Hendrix. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Hendrix to adjourn and to meet again on Tuesday, Oct. 21 at 7:30 p. m. Seconded by Councilman Van Eepoel. Discussion.
