I~ ,,^ ,,-.. 74-75 - 37 . i REGULAR SESSION CITY COUNCIL CITY OF WINTER SPRINGS JULY 28, 1975 The Reaular Session of the City Council of the City of Winter Springs, Florida was called to order by Mayor Troy Piland. The invocation was given by Councilman Irene Van Eepoel. The pledge of allegiance to the flag was led by Councilman Ernest Hendrix. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilmen: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present Motion was made by Councilman Van Eepoel to approve the minutes of July 21, 1975 as presented. Seconded by Councilman Browning. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Mr. Raley of Bayberry Court presented a petition signed by residents of the Terraces and asking that the drainage ditch running from Edgemon Avenue to Moss Road be closed, cleaned or main&ained as it is a breeding place for rats, snakes and odor. Council was in agreement that this would be cleaned. Motion was made by Councilman Hendrix that Council, by the next meeting, find money to be used in cleaning this ditch and that the monies be used to provide manual crews and equipment to clean the ditch wherever the crews come from; and to allow r the expenditure of the money right away - this to be funded out of the Mayor's Office Contingency Fund, and that the monies be replaGed after the public hearing. Seconded by Councilman Hunter. Discussion. Vote on the motion: Oouncilman Hunter, aye; Councilman HendriX, aye; Oouncilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Brownina, aye; motion carried. r Councilman Daniels asked that a meeting be held with the Mayor and City Oouncil, th~ General Oontractor, the Paving Sub-contractor and the City Engineer to discuss the black top in this City Building area. The meeting was scheduled for Monday, August 4, at 5:00 or 5:30 P. H. Motion was made by Councilman Daniels to have the City contact the County Commission and their road and engineering department to ascertain a total cost of unpaved road maintenance program for the City of Winter Springs. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Oouncilman Hendrix, aye; Oouncilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Councilman Daniels reported that the State Bicentennial Committee announced the project chosen for grant funding and our Community Building was not selected. Councilman Daniels asked that the Mayor recognize Mrs. Sheila Sines. Mrs. Sines requ4sted permission to conduct a Voter Registration on Saturday, October 11, 1975 but was told she did not have to have permission to do this. ~ r\ ~ . '" t Regular Session, City Council, July 28, 1975 Page 2 74-75 - 37 r Motion was made by Councilman Daniels that we defer discussion on the budgets until the remainder of the Council Meeting has been completed and that we move into a Workshop Session immediately after the Council Meeting to further work on the budgats. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, -aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Mr. Parkhurst, representing a group of residents, asked Council to rescind their action on July 21, 1975 pertaining to the two churches being given conditional land uses. Mrs. Helzer, Mr. DeFaziO, Mr. Helzer, Mrs. Daniels, Mr. Musgrove, Mr. Pellerin were present and objected to the Council action. Motion was made by Councilman Daniels that the two decisions concerning the conditional uses of RlAA zoned properties made on July 21, 1975 be set aside; that if the petitioners so desire an additional hearing be established at which time proper documentation be submitted and the issue readdressed by both the Zoning Board and the Council. Seconded by Councilman Van Eepoel. Discussion. Motion was made by Councilman Hunter to table this motion for one week for the advice of the Attorney. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Counc.ilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Motion was made by Councilman Daniels that the inter~ period until this issue is brought to a vote that the appropriate city departments be instructed to issue no r permits to authorize work or other activities that can create further possible liability against the City until this issue is voted upon. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Oouncilman Hunt~r, no; Councilman HendriX, no; CouncidJaan Daniels, yes; Councilman Van Eepoel, yes; Councilman Browning, no; motion failed. Based on the Attorney's advice, Councilman Hunter voted no. Councitman Browning stated the reason he voted no was because he felt that it is beyond the legal l~its and rights of this Council to restrain property owners in that nature. A committee meeting is to be held at Attorney Brock's office on August 5, 7:30 p. m. to discuss Civil Service for City Employees. Motion was made by Councilman Hendrix to pay $20,000.00 payment co cut down the interest and put the balanee in the escrow account to be paid at the tUne it is due. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman HendriX, aye; Councilman Daniels, aye; Oouncilman Van Eepoel, yes; Councilman Browning, aye; motion carried. Attorney Brock read the second reading of Ordinance No. 122. Motion was made by Councilman Daniels to approve Ordinance No. 122 on the second reading by title only. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried.
