The invocation was given by Councilman Daniels. The pledge of allegiance to the flag was led by Councilman Browning. Roll Call: Mayor Troy Piland, present Attorney Newman Brock, present Deputy Mayor Donald Browning, present Councilman: Irwin Hunter, present Ernest Hendrix, present John Daniels, present Irene Van Eepoel, present Motion was made by Councilman Van Eepoe1 to approve the minutes of July 14, 1975 with the following correction: Page 3, paragraph 6, correct the spelling of the word "that". Seconded by Councilman Browning. D:t.scussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carries. Mayor Piland recessed the Council Meeting and opened the Public Hearing to consider a conditional use application for Jehovah Witness. Attorney Brock read the notice of public hearing that was published in the newspaper. Mr. Larry Grimn spoke for the request. Mrs. Canton, 235 Hayes Road, Hr. and Hrs. Bradshaw, 240 Hayes Road, spoke for the conditional use application. Walt Parkhurst, Tradewinds Road, Mr. Hunt, Hawthorne Circle, Hrs. Rossider, Moss Road, and Hr. Pellerin, Moss Road spoke against the request. f' Hayor Piland closed the public hearing and reconvened the Regular Session. Motion was made by Councilman Van Eepoe1 to adhere to the Zoning Board who are the duly appointed zoning officials of this City, recomendation that for their stated reasons, teat are namely the roads and the incompatibility of the surrounded area, ect., that the zoning request be denied as recoamended by the Planning and Zoning Board. Motion dies to lack of a second. Motion was made by Councilman Browning to approve the couditional use application of Jehovah Witness. Seconded by Councilman Hendrix. Discussiou. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, no; Councilman Van Eepoel, no; Councilman Browning, aye; motion carries. Mr.Crabtree, Bennett Street, Mrs. Clark, Murphy Road, spoke for the conditional use application. Mr. Walt Parkhurst, Tradewinds Road, Mrs. Daniels, Antelope Trail, Mr. Pellerin, Moss Road, and Mrs. Newsome, Edgemond Avenue, spoke against the conditional use application. Mayor Piland closed the Public Hearing and reconvened the Regular Session. Motion was made by Councilman Browning to approve the conditional use application of Seminole Babtist Temple. Seconded by CouncibDan Hendrix. Discussion. CiI r Mayor Piland recessed the Council Meeting and opened the Public Hearing for Ordinance 123., providing for the establishment of a Zoning Map. Attorney Brock read the ordinance in its entirely. Mr. John Newsome spoke in favor and no one spoke against the proposed ordinance. Mayor Piland closed the Public Hearing and reconvened the Regular Session. Motion was made by Councilman Hunter to approve Ordinance 123 on the first reading. Seconded by Councilman Hendrix. Discussion. Vote on the motion: CouncibDan Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; Motion carries. Motion was made by Councilman Daniels that the Attorney be instructed to draft an Ordinance to adapt the Seminole County Mechanical Code for the City, and the set up a public hearing on this ordinance for the earliest practicable date. Seconded by Councilman Van Eepoel. Discussion: Councilman Daniels commented the Seminole County MeChanical Code adapts in substance the Standard Mechanical Code with a few ammendments to be adapted to our local areas. Vote-on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; CounciLman Van Eepoel, yes; CounciLman Browning, aye; motion carries. r Councilman Daniels discussed False Arrest Liability Insurance Coverage. This past week I had several inquiries concerning the City being liable to pay damages in the on-going false arrest case. Two questions in particular were asked: Why are we <the City) being subjected to a charge of false arrest? Is the City not covered against such damages by insurance? In response to the second question, there apparently was not a complete liability coverage in the previous insurance package and therefore the City was not covered against false arrest in 1974 when the incident occurred. When we established the specifications for the current insurance package I made sure that it included complete liability coverage. To be doubly sure I confirmed it last Thursday with the City's ~nsurance agent. t6 the first question, my only response is that I hope that our police officers actions are responsible enough to preclude further false arrest actions against the City or its wmployees. Mrs. Carl Mitchell awarded the Council Members with a Certificate of Appreciation for their tUBe and effort with the Winter Springs Bazaar. The Council thanked Mr. and Mrs. Mitchell for their effort on behalf of the City of Winter Springs. Councilman Hendrix presented to the Council the Revised Proposed Budget Summary for the year 1975-76. He co.aented the 1975 certification of millage would be 2.43 mills. r- Councilman Daniels commented on Ad Valorem Taxes. Due to the County's reappraisal of property in the County this year, the assessed value of property in Winter Springs increased considerably. The County Property Appraiser has certified that Winter Springs will get the same amount of monies as last year using a 2.43 mills ad valorem tax rate, plus collect an additional $12,509.68 from new construction added to the tax rolls this year. Any millage rate above 2.43 mills levied for 1975 by the City Council of the City of Winter Springs will represent an increase in ad valorem taxes. I oppose any increase in ad valorem taxes this year. With careful budgetting of funds to provide only required services for the taxpayers and the careful, responsible management of these funds through- out the next fiscal year we can operate the City without any increase in ad valorem taxes for 1975. Retention of an ad valorem tax rate of 3.5 mills <as levied for 1974) represents a $46,341.28 increase in ad valorem taxes, or a 1.07 mills increase in tax rate. --- I"""' r r r ~ RegUlar Session, City Council, July 21, 1975 Page 3 74-75-35 Mayor Piland brought to the attention of the Council several complaints he recieved about the drainage ditch which runs from Edgemond Avenue to Moss Road. Councilman Daniels stated Mr. Paul Smith <managing director of Tuscawilla) advised me on Thursday that Gulfstream Land Development Corporation has approved their building the permanent fire station now and that he has authority to proceed with the planning and construction. Councilman Daniels brought to the attention of the Citizens and Council that Mrs. Camella Bruce, County Supervisor of Elections, has informed me that the Board of County Commissioners established a new voting precinct, which includes those Winter Springs residents that previously were required to vote in Oviedo. The new precinct is number 50 and the place of voting will be the Information Center in Tuscawilla. Voters should receive official notification before the next election. Our thanks to the County Commissioners for this action. Motion was made by Councilman Van Eepoel to adjourn. Seconded by Councilman Hunter. Motion carries.
