Proceedings at Council Meeting
Village of North Orlando, Florida
November 5, 1963
7:30 P.M.
The Village Council of the Village of North Orlando, Florida, met. in
regular session on NovEmber 5, 1963, at 7:30 P.)I. Meeting was caJ.J.ed to order by
Kayor Anderson. On roll call the following members of the council were present:
I. E. VanEepoel, R. E. Stephenson, Arthur Ferrin, W. W. Anderson, A. D. Rhodes.
The invocation was given by the Olaplain, Mrs. Lucy Fairburn.
The minutes of the Special Council Meeting on October .30, 1963, were
accepted as read.
Pursuant to action taken by the Council at the regular meeting on
October 8, 1963, Kayor Anderson offered the following ordinances: No. 28, entitled:

"An Ordinance granting to Slburban Rulane Gas Co. of N. C., Inc., its
legal representatives, successors and assigns, the right and privilege
of, and franchise for, constructing, maintaining and operating a
propane gas plan:t and distribution system in the Village of North
Orlando, County of Seminole, and state of Florida."
and Ordinance No. 30 entitled:
"An Ordinance granting to Florida Power Corporation, its legal
representatives, successors and assigns, the right and privilege of,
and franchise for, constructing, maintaining and operating an electric
power plant and distribution system in the Village of North Orlando,
County of Seminole, and state of Florida."
Upon motion by Councilwoman VanEepoel, seconded by Councilman Ferrin, that
Ordinances No. 28 and 30be placed on second reading, that the rules be waived and
said ordinances be read by title on~, motion was adopted. Said ordinances were placed
on second reading and read by title. Motion made by CotUlcilman Ferrin, seconded
by Councilman Rhodes that Ordinance No. 28 and Ordinance No. 30 be passed on second
reading. On roll call the following mEmbers of the Council voted "yes" - VanEepoel,

Upon motion by Mrs. VanEepoel, seconded by Mr. Ferrin, that Ordinance
No. 28 and Ordinance No. 30 be placed on third and final reading, motion was adopted.

Whereupon Ordinance 1128 and Ordinance 1130 were declared passed and
adopted by the Village Council, ordered executed by the members of the Village Council
and approved by the Mayor.
Motion was made by Mr. stephenson that the following standard fines for the
stated violations be adopted: Improper muffler $15; Disturbing Peace, $25.00;
Public intoxication, $25.00; No through trucks on side streets $15.00; Passing
School Bus, $50.00; Driving while under suspended license, $50.00. )lotion was seconded

)(r. stephenson made the following report of activities of the Police
Department for the months of SeptEmber and October.

Capt. Stephenson reported. that there will be no action taken on restriction
of "on streettt parking on the side streets at this time. However, the 20-mile per
hour speed limit on the side streets will be strictly enforced..
It was also pointed out that Ordinance Ill,relative to the diSCharge of
Firearms, makes hunting within the Village Limits a violation punishable by fine
and/or imprisonment.

Mrs. VanEepoel stated that the insurance for the Fire Department was
effective as of August 30th and is for the same coverage as the Police Department
:D1surace.

Unanimously approved.
Mrs. VanEepoel, in reporting on the road situation, stated that t here were
originally 5.5 miles of road requiring iDmediate repair, but that the she has been
advised the Florida Power Corporation will gr_ and do all necessary repair work
on the roads that have been used by their heavy equipment during the installation
{". of power lines. The power canpan;y right-of-wq work will soon be completed and thEIT
.; will then repair the roads.

1. Scott Construction and Paving Co. - $10.50 per hour; estimated
4 or 5 dqs work on 10 hour work dq basis. Payments to be 9($ on
completion, 10% following JDOllth. Hauling & dumping of needed clq
to be at $1.30 per cubic yard.
2. Greer Paving Co. - $700.00 on basis of 6-7 dyas work on lO-hour
work dq basis, with c1q fill extra
3. Dalrymple Paving - estimated 6 dqs at $250.00 per dq. Cla.y $4.00
cubic yard - for a toW of $1500.00. $500.00 on completion, $400

North Orlando Compaqy .made an offer 01~.00 per hour - ~ per hour
for sel"V'ices of lIr. Memory and .~~'-' hour for use of Comp~ equipment
including c1q for filling, to which they have access. The original
estimate, before the Power Company atatEment on repair of the roads
used }?1 them, was approximately $300.00 with follow-up maintenance at
a COSI of $SO.OO per month.
llotion was made by lIrs. VanEepoel that the Village accept the low bid of the
North Orlando Compa.ny of $5.00 per hour for work to be done, with the provision that
the roads will continue to be maintained on terms agreeable to Council, md. with work
to be started within two weeks. Motion seconded by )(r. Ferrin. On roll call vote -

voted "yes", VanEepoel, Andersen, Ferrin, stephenson, Rhodes. Voted "no" - none.
)layor Anderson read a letter dated October .30, 1963, from 1Ir. Sesnie of the
Silver Creek Precision Company, in whidlthey list the amounts they claim are owed to
the North Orlando CoIDparly, and the amount due the Village under Ordinance #10.
)(a.yor ~ders en then read a proposed letter to be sent to JIr. Seanie regarding the
alleged indebtedness and a proposed. new franchise. Letter was approved and ordered sent.
JIr. Anderson advised that he had final~ been able to talk to lIr. King and
the latter advised that he l<<>uld be in town the week of November 11th and would arrange
a meet~ with council <bring that week, at vm.ch time the many pending problems could
be discussed. After discussion, it was agreed by Council that, unless a definite
meeting is arranged with lIr. King by Tues~, November 12, immediate action will be

Mr. Anderson read a letter dated NovEmber 4th from the Board of County
Comm:i.saioners for Seminole County which states there will be a meeting on NovEmber 14th

In Orange County Court House in Orlando, relative to comprehensive transportation plans
for the area. lLayor Anderson requested that as ~ Village officials as possible attend

this important meeting.
A Resolution of tpology to Reiter Bros. and the North Orlando Company was then
read. Motion for adoption was made by Mr. Ferrin, seconded by Mr. Rhodes, and the Resolution
was unanimously approved and adopted.
)layor Anderson then presented Ordinance 1135 entitled:
:An Ordinance declaring open draining ditches unsafe, establishing a
Boundary within which ditches shall be unlawful, providing cceptions
thet'eto, providing provisions for developet's and blilders to submit
drainage plans, ordering of existing ditches closed, providing a
penal ty for failure to comp4, provid:in.g for separability, the repeal
of conflicting ordinances and establishing an effective date."
On motion of Mrs. VanEepoel, seconded by Mr. stephens~ Ordinance 1135 was placed
on first reading and this ordinance was thEn read in its entirety. Motion was made by
Mr. Ferrin, seconded by JIr. Rhodes that Ordinance 1135 be accepted for first reading,
with subsequent readings at the Dedembet' meeting. On Roll Call vote, voted yes _ VanEepoel,
Ferrin, St:.ephenson, Rhodes. Voted "no" - none. Ordinance 135 was therefore passed on first
reading.
llr. Rhodes will make a survey of the m:i.niJm.tm number of street lights, spotted
throughout the Village, that would be needed, and ascertain the cost of operating same.
JIotion was made by Mrs. VanEepoel to pcq Angevines Gun Shop $46.50 for Police
equiIDent, when the cigarette tax check is received. Motion seconded by Mr. Ferrin and
unanimously approved.

Kr. Bill Hahn" reporting for the Fire Department, stated that it is imperative
that additional hose and a fire extinguisher be secured for the Department. He has
received three bids for the fire hose, thelowest being from the A.B.C.Fire Equipment -
70; per foot for li" single jacket" which would. be adequate. Terms could be arranged.

1Ir. Hahn questioned insurance coverage of anyone assisting at a fire, who is
not a reguJ.ar member of the nlunteer Fire Department" since the fire insurance policy
covers only a given number of men. Also whether Fire Department members must be
specifically named for coverage. He will check this with the insurance agent.,
Kotion made by )Ir. Rhodes that Kike Carlo be EIlCempted from purchasing an
Occupational License. Kotion seconded by Jlr. stephenson and unani.mously approved.
JIr. Anderson advised that JIr. Homer Austin of S &. S. Utility Co. of Sanford

has solicited the Village business. The fee would be $2.00 per house for twice a week
pick-up of garbage and trash" or a 3 times a week pick-up if this is not adequate. The
Co. is also willing to operate under a franchise with a 5% retum to the Village.
)Irs. VanEepoel will check into this, since a show of hands reveal'ed very little
dissatisfaction with the present operator.
Kr. Andersoo. pointed out that refusal to pay the utility tax on utility bills
is an offense punishable by fine and that it is mandatory tor the uJ.iJ.it7 companies
to coll act this.
