Resolution 2009-31
A RESOLUTION OF THE CITY COMMISSION OF WINTER SPRINGS,
FLORIDA PURSUANT TO SECTION 12-85 OF THE CITY CODE
AUTHORIZING THE CITY MANAGER TO COMMENCE ENFORCEMENT
OF ORDINANCE 2008-27 REGARDING RED LIGHT CIVIL SIGNAL
VIOLATIONS; PROVIDING FOR AN EFFECTIVE DATE.
Whereas, the City Commission adopted Ordinance 2008-27 which establishes an
enforcement procedure for imposing civil penalties for red light infractions on certain
roadways located within the City by using unmanned cameras; and
Whereas, on April 24, 2009, the City completed a 30 day test period regarding the
enforcement procedures during which the City issued courtesy notices for red light
signal violations; and
Whereas, upon completing the test period, the City Commission now desires to
commence enforcing the Ordinance by imposing actual civil penalties for red light
signal violations; and
Whereas, the City Commission hereby deems this Resolution is in the interests of the
public health, safety, and welfare of the citizens of Winter Springs.
NOW THEREFORE, the City Commission hereby resolves as follows:
Section 1. The City Manager is hereby instructed to commence enforcement of
Ordinance 2008-27, and Owners shall be subject to the enforcement of said Ordinance.
Section 2. This Resolution shall be effective retroactively commencing on April, 25,
2009; 12:00 A.M.
BE IT RESOLVED by the City Commission of Winter Springs on this 27th day of
April, 2009.
