HomeMy WebLinkAbout2009 02 09 Consent 200 Amendment 1 Agreement with NRCS Restoration of City Waterways T.S.FayCOMMISSION AGENDA ITEM 200 February 9, 2009 Meeting CONSENT X INFORMATIONAL PUBLIC HEARING REGULAR MGR /DEPT ~~'' Authorization REQUEST: Public Works Department - Stormwater Division requests approval to execute Amendment No. 1 to the Project Agreement with the Natural Resources Conservation Service (MRCS) for the restoration of City waterways damaged during Tropical Storm Fay PURPOSE: The purpose of this agenda item is to request approval to execute Amendment No. 1 to the Project Agreement with the Natural Resources Conservation Service (MRCS) for the restoration of City waterways damaged during Tropical Storm Fay CONSIDERATIONS: • At the January 12, 2009 City Commission meeting, the Commission provided authorization to enter into a Project Agreement with the Natural Resources Conservation Service (MRCS) for restoration of City waterways damaged during Tropical Storm Fay. The Project Agreement has been executed and Staff is proceeding with the project with a target completion date of June 18, 2009. • This agenda item requests approval of Amendment #1 to the NRCS Project Agreement, which increases the maximum construction cost by $87,500 from $312,500 to a new total of $400,000. The increase was requested by Staff based on a recommendation from NRCS at the project's pre-design meeting. • The following projects are approved for funding under the NRCS Project Agreement: 1. Bear Creek at Winter Springs Boulevard -repair erosion at north bridge abutments; remove sediment islands and storm debris 020909_COMM_Consent 200 NRCS Project_Agreement Amendment 1 February 9, 2009 Consent Item 200 Page 2 of 2 2. Howell Creek at Northern Way (south bridge) -remove sediment islands and storm debris 3. No Name Creek at Power Easement -remove sediment islands and storm debris at 48-inch culvert crossing; install new concrete headwall on upstream side 4. Gee Creek at Moss Road -remove sediment islands and repair erosion damage at four bridge corners 5. Gee Creek at S. Edgemon Avenue -remove sediment islands and repair erosion damage at southeast bridge corner PROJECT COSTS AND FUNDING: No funding is being requested at this time. After Amendment #1, the total construction cost for the five projects listed above is up to $400,000. NRCS will fund 75% of the construction cost, or $300,000, and the City will be responsible for the remaining 25%, or $100,000. The City portion will be funded by the Stormwater Utility Fund under a separate agenda item for the award of the construction contract after bidding. This amends the Project Agreement 69-4209-9-1705 between the above parties relative to the Tropical Storm Fay Emergency Watershed Protection Project. Clause A is amended to increase funding by $87,500.00 and to read as follows: A. It is agreed that the following-described work is to be constructed. The actual total cost of the works of improvement to be cost shared by NRCS shall not exceed $400,000.00. Location Description DSR No. Bear Creek Stabilize eroded areas to prevent erosion and WS-SEM-OOIFAY remove debris to prevent flooding. Gee Creek Stabilize eroded areas to prevent erosion and WS-SEM-002FAY remove debris to prevent flooding. All other provisions of the Agreement remain unchanged.
