REQUEST: The Community Development Department requests the City Commission hold a Public Hearing for the Aesthetic Review of the proposed wall, located generally along the north and much of the east perimeter of property owned by Bart and Cynthia Phillips, north of SR 419 and west of Layer Elementary School. PURPOSE: The purpose of this agenda item is for the Commission to consider, provide comment on, and approve, approve with conditions and/or modifications, or disapprove the Aesthetic Review. The purpose of the Aesthetic Review process is to encourage creative, effective, and flexible architectural standards and cohesive community development consistent with the intent and purpose of Article XI -Minimum Community Appearance and Aesthetic Review Standards. APPLICABLE REGULATIONS: Section 9-601. Approval prerequisite for permits. Section 9-603. Procedures. Section 9-605. Submittal requirements. Section 20-256. No. 2008-13) Ordinance No. 2008-11 "Consent to Zoning Restrictions" document Florida Power & Light easement agreement CONSIDERATIONS: The applicant proposes to (1) construct a 10 foot tall masonry wall, after vacation of the Ginger Lane right-of--way (ROW), along the eastern boundary of their properties, abutting the Layer Elementary School site and (2) to construct a 10 foot masonry wall along the SR 419 frontage, adjacent to the portion of the site that is proposed for inclusion in the Cross Seminole Trail. The properties north of the existing Florida Power and Light (FPL) easement have an Industrial Future Land Use (FLU) designation and I-1 Light Industrial zoning. The properties south of the FPL easement January 26, 2009 Public Hearing Item 501 Page 2 of 4 have a Commercial FLU designation and presently have C-1 Neighborhood Commercial zoning (the restricted C-2 zoning is contingent upon the applicant signing the "Consent to Zoning Restrictions" document -this has not occurred). A 10 foot masonry wall is allowed in the I-1 and C-2 zoning districts, but not in the C-1 zoning district. Therefore, staff believes that either the applicant needs to sign the "Consent to Zoning Restrictions" document or to request the Commission reconsider the restricted rezoning. At the present, approving aesthetic review of the wall could only result in a permit for the wall along that portion of the properties which are zoned I-1 (subject to the Ginger Lane ROW vacation, north of Old Sanford-Oviedo Road). It is unclear as to what FPL will and will not allow in the easement. Staff has requested the applicant provide documentation. A November 14, 2008 letter from FPL states they will not allow construction within their easement, but does not provide further details such as, for example, regarding parking, storage, allowable heights, distances from poles, anchors, or towers, what is allowed or prohibited under wires, or conductors, grade changes, storm-water facilities, underground utilities, landscaping, fences, walls, or gates. The applicant proposes to plant creeping fig vines along the outside of an unpainted wall (the creeping fig vine is to cover a large expanse of the exterior of the wall) and maintain responsibility for the wall and plantings. Agate is proposed across a portion of the FPL easement. Staff believes, at minimum, that (1) the wall exterior side needs to have a concrete stain and that (2) drip irrigation must be provided and maintained for the vines, to ensure their survival, growth, and viability. Staff also believes that provisions need to be made for the timely removal of any graffiti or other damage or vandalism that occurs on the wall as well as the care and possible replacement of the vines. The submittal requirements for aesthetic review are set forth in Section 9-605 and include the following: (a) a site plan; (b) elevations illustrating all sides of structures facing public streets or spaces; (c) illustrations of all walls, fences, and other accessory structures and the indication of height and their associated materials; (d) elevation of proposed exterior permanent signs or other constructed elements other than habitable space, if any; (e) illustrations of materials, texture, and colors to be used on all buildings, accessory structures, exterior signs; and (f) other architectural and engineering data as may be required. The procedures for review and approval are set forth in Section 9-603. Staff has requested the applicant provide a written statement describing how the wall will meet the criteria set forth in sections 20-603 and 20-605. The City Commission may approve, approve with conditions, or disapprove the application only after consideration of whether the following criteria have been satisfied: (1) The plans and specifications of the proposed project indicate that the setting, landscaping, proportions, materials, colors, textures, scale, unity, balance, rhythm, contrast, and simplicity are coordinated in a harmonious manner relevant to the particular proposal, surrounding area and cultural character of the community. The applicant's proposal is to provide an unpainted 10 foot-tall cast concrete wall upon which creeping fig vines are to grow and adhere. 2 January 26, 2009 Public Hearing Item 501 Page 3 of 4 (2) The plans for the proposed project are in harmony with any future development which has been formally approved by the City within the surrounding area. The proposed wall is in harmony with the existing industrial character and uses north of that segment of SR 419, as well as with the prescribed uses in the restricted rezoning. (3) The plans for the proposed project are not excessively similar or dissimilar to any other building, structure or sign which is either fully constructed, permitted but not fully constructed, or included on the same permit application, and facing upon the same or intersecting street within five hundred (500) feet of the proposed site, with respect to one or more of the following features of exterior design and appearance: (A) Front or side elevations, (B) Size and arrangement of elevation facing the street, including reverse arrangement, (C) Other significant features of design such as, but not limited to: materials, roof line, hardscape improvements, and height or design elements. The proposed wall design is envisioned to buffer/screen vehicles, machinery, and materials of up to a 13.5 foot tall height on the commercial properties and the recycle/salvage operations on the industrial properties. (4) The plans for the proposed project are in harmony with, or significantly enhance, the established character of other buildings, structures or signs in the surrounding area with respect to architectural specifications and design features deemed significant based upon commonly accepted architectural principles of the local community. The proposed wall design is in harmony with the existing character of the industrial uses in the area and will set a new standard for the City. (5) The proposed project is consistent and compatible with the intent and purpose of this Article, the Comprehensive Plan for Winter Springs, design criteria adopted by the city (e.g. Town Center guidelines) and other applicable federal state or local laws. Staff believes that the aesthetic package meets the requirements of this Article for this area, provided a reasonable color stain is applied to the "outside" of the wall, drip irrigation is provided to the creeping fig vines, provisions are made for care and replacement of the irrigation system or plants, and provisions are made for the removal of graffiti from or repair of damage to the wall or its elements (e.g. gates, plantings). (6) The proposed project has incorporated significant architectural enhancements such as concrete masonry units with stucco, marble, termite-resistant wood, wrought iron, brick, columns and piers, porches, arches, fountains, planting areas, display windows, and other distinctive design detailing and promoting the character of the community. The proposed 10 foot tall concrete wall is located within the City of Winter Springs Industrial and Commercial FLU designations (I-1 and C-1 zoning, respectively -pending restricted C-2 in the presently C-1 portion). 2. As currently approved, the proposed 10 foot tall concrete wall cannot be erected within the C-1 properties until the applicant signs the "Consent to Zoning Restrictions" and that document and the restricted rezoning ordinance are recorded. 3. The applicant proposes to locate the wall within what is presently the Ginger Lane ROW and adjacent to property that is proposed to become a part of the Cross Seminole Trail. 4. Ginger Lane must be vacated before a permit may be constructed upon the applicant's portion of the vacated ROW. 5. Staff believes that provision of an acceptable concrete stain to the `exterior" side of the wall, a drip irrigation system for the creeping fig, and adequate/timely maintenance of the irrigation, plantings, gates, and wall (including graffiti removal) are key elements to this approval. 6. The applicant has not provided FPL documentation of what it will or will not allow to be built within the existing power easement. Staff did request the applicant provide such documentation. RECOMMENDATION: Staff review found the applicant's request for Aesthetic Review adequate, subject to the findings above and recommends that the City Commission approve the wall aesthetic review request subject to these findings as conditions. F, provided the warehouse building is located adjacent to a functional railroad line. The gate detail is an improvement, but a color rendering is required for any side facing a public ROW. Need utility easements recorded over Old Sanford-Oviedo Road before the ROW can be vacated. The easements should span the full width of the vacated right-of-way (the plans show only 25-feet.) Response: The utility easement has been expanded to cover the entire 50' ROW. 2. Provide a copy of the recorded easement for the access tract. Response: The access tract will consist of the 50' easement to be established Sanford Oviedo Road and the eastern 25' of Ginger Lane. 4. Provide sketches and legal descriptions for the right-of-way to be vacated. Response: Sketched and legal descriptions will be provided for staff review prior to recording. 5. The City would prefer to vacate Ginger Lane all the way to its northern terminus. Discuss at meeting. Response: We will vacate Ginger Lane to its northern terminus per staff recommendations. 6. Along Ginger Lane, the utility easement should cover the portion of the vacated right of way covering the existing power lines. The access easement can be separate from the utility easement if needed. Response; The western 25' of the ROW will be vacated and will become an access easement to its terminus to the north.
