REQUEST: The Community Development Department -Planning Division is Seeking Advisability from the Mayor and City Commission Regarding the City Commission's Active Participation in the Review of the Comprehensive Plan Evaluation and Appraisal Report (EAR)- Based Amendments. PURPOSE: For Staff to receive direction from the City Commission regarding their desired level of active participation in the review of the draft Comprehensive Plan Elements. APPLICABLE LAW AND PUBLIC POLICY Chapter 163, Florida Statutes 9J-5 Florida Administrative Code Winter Springs 2008 Evaluation and Appraisal Report (EAR) Winter Springs 2001 Comprehensive Plan BACKGROUND: • The Comprehensive Plan is the guiding document that identifies the future development patterns in the City and the services that will be necessary to meet the demands of future growth. • There are nine (9) elements of the Comprehensive Plan. These include: o Future Land Use o Transportation o Housing o Infrastructure ^ Sanitary Sewer Sub-element ^ Potable Water Sub-element ^ Solid Waste Sub-element ^ Drainage Sub-element ^ Natural Groundwater Aquifer Recharge o Conservation o Recreation and Open Space o Intergovernmental Coordination Element o Capital Improvements Element o Public School Facilities Element January 12, 2009 City Commission Regular Agenda Item 600 A total re-write of the Comprehensive Plan was adopted in 2002, based upon the direction of the 1998 Evaluation and Appraisal Report (EAR) which indicated that the entire document was poorly written and should be completely re-written as part of the EAR-Based Amendments. This re-write was an enormous undertaking. Six (6) Joint City Commission/LocalPlarming Agency (CC/LPA) Workshops/Special Meetings were held over a two-month period to review each draft Element. These meetings required 17-hours in joint CC/LPA meetings for review and comment, in addition to and prior to the Public Hearings. • During the 2008 EAR process, it was the desire of the City Commission for the Joint Workshop/Special Meeting to not occur until after the LPA had completed their review of the draft document. As a result, the LPA presented their recommendations at a 3.5-hour Joint CC/LPA Workshop/Special Meeting, after which time the LPA Public Hearing and CC Public Hearing were scheduled and held. • The 2008 EAR was determined sufficient by the Florida Department of Community Affairs in June 2008. The City has until December 20, 2009 to complete the EAR update of the entire Comprehensive Plan (EAR-Based Amendments). • ls` drafts of the various comprehensive plan elements have been completed by the City's consultant and are beginning to be distributed to the LPA. The LPA has identified four (4) workshop dates in January and February for the review of the draft elements. SUGGESTED TIMELINE: Jan-Feb 2009 - LPA Workshops for the review of the 15` draft of each of the Elements March 2009 - Production of 2°d draft Apri12009- Joint LPA/CC Workshops for the review of the recommended draft of each Element April 2009- Revisions based on Joint LPA/CC Workshops May 3, 2009 - LPA Public Hearing on EAR-Based Amendments May 26, 2009- City Commission Transmittal Public Hearing on EAR-Based Amendments August 2009 - Receive ORC Report from DCA Revise and produce final EAR-Based Amendments for Adoption Nov. 23, 2009- City Commission Adoption Public Hearing on EAR-Based Amendments STAFF RECOMMENDATION: The Community Development Department -Planning Division is seeking advisability from the Mayor and City Commission regarding the City Commission's active participation in the review of the Comprehensive Plan Evaluation and Appraisal Report (EAR)-Based Amendments (Update to the Comprehensive Plan). Please give direction related as to the Commission's desired level of involvement in the review of the draft Comprehensive Plan Elements and specifically the following items: • Do you wish to participate in Joint Workshops/Special Meetings with the LPA and if so, how many? • When do you want to receive drafts of each Element? o At 1 S` draft or after LPA review and recommendation? o How much lead time would you like to have for reviewing the document, before a scheduled workshop or meeting? -2- January 12, 2009 City Commission Regular Agenda Item 600 ATTACHMENTS: None CITY COMMISSION ACTION: -~-
