Authorization The City Attorney and the City Clerk are asking the City Commission to consider the adoption of Resolution 2009-01 formally appointing five (5) members to the City's Board of Trustees. PURPOSE: Resolution Number 2009-O1 officially documents the City Commission's recent appointments to the Board of Trustees made during its special meeting on December 15, 2008. CONSIDERATIONS: Section 14-52(a) of the Winter Springs City Code requires the City Commission to appoint members to the Board of Trustees by resolution. At the City Commission's special meeting held on December 15, 2008, the Commission unanimously appointed five (5) members to the Board of Trustees. Resolution 2009-01 acts to formally document those appointments. The following individuals were appointed to the Board of Trustees: ^ Maria Fair ^ Ben McMahan ^ Vernon Rozelle ^ Maxwell Swaim ^ Barbara Watkins CITY OF WINTER SPRINGS, FLORIDA CITY COMMISS[ON REGULAR MEETING -JANUARY I2, 2009 CONSENT AGENDA ITEM "202" PAGE 2 OF 2 Each member shall serve a three (3) year term, commencing on January 2, 2009 and ending on January 1, 2012. RECOMMENDATION: The City Clerk and City Attorney recommend the City Commission approve and adopt Resolution 2009-01. ATTACHMENT: Resolution 2009-01 COMMISSION ACTION: The City Commission unanimously appointed the five (5) individuals named above to the City's Board of Trustees on December 15, 2008. RESOLUTION 2009-01 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA APPOINTING FIVE (5) MEMBERS TO THE CITY'S BOARD OF TRUSTEES PURSUANT TO SECTION 14-52 OF THE CITY CODE; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, section 14-52 of the City Code requires the appointment of members to the City's Board of Trustees by resolution of the City Commission; and WHEREAS, during its December 15, 2008 special City Commission meeting, the City Commission of the City of Winter Springs, Florida appointed five (5) members to the Board of Trustees; and WHEREAS, each appointment to the Board of Trustees is for a term of three (3) years, commencing on January 2, 2009; and WHEREAS, the City Commission deems that this Resolution is in the best interests of the public health, safety and welfare of the citizens of the City of Winter Springs. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, THAT: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated herein by this reference. Section 2. Appointments to the Board of Trustees. Pursuant to section 14-52(a) of the Winter Springs City Code, the City Commission hereby appoints Maria Fair, Ben McMahan, Vernon Rozelle, Maxwell Swaim and Barbara Watkins to the City's Board of Trustees. Each appointee shall serve a three (3) year term commencing on January 2, 2009 and terminating on January 1, 2012. Section 3. 5everability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction, whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions of this Resolution. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 5. Effective Date. This Resolution shall become effective immediately upon its adoption by the City Commission of the City of Winter Springs, Florida. ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular meeting assembled on this 12th day of January, 2009.
