SYNOPSIS: This agenda item is for the City Commission to review the Final Engineering/Site Plan for the enclosure of an existing covered basketball court and various associated improvements. The site plan, aesthetic review, and development agreement for up -grade to entire the site were approved on May 12, 2008, but the economy has forced the church and many other entities to scale back on plans. The approved plans depicted the covered basketball court to be enclosed, but the details were not provided in the aesthetic review. In light of the current economic situation, the church is proposing to do what it can, to implement the plan in increments. Converting the basketball court into an assembly structure, providing the sidewalks in the adjacent Hayes Road and East Bahama Road rights -of -way, providing a dumpster enclosure, and providing a stabilized bus parking area comprise the first phase of this implementation. The church representatives have expressed a desire to also move forward with a scaled back version of the 30,167 SF building (new sanctuary, Sunday- school classrooms, and offices) before the end of the year. This development would comprise Phase two of the implementation and will be subject to separate review. Development Agreement CHRONOLOGY: July 10, 2006 - Conditional Use to expand the Church in the R -1AA Zoning District July 10, 2006 — Variance to allow stabilized grass parking April 2, 2008 — P &Z recommend final engineering /site plan be approved May 12, 2008 — Commission approved site plan, aesthetic review, and development agreement BACKGROUND AND OVERVIEW: This 4.28 acre upland site is largely developed and has been used as a church for years. It abuts paved Hayes Road to the east and presently unpaved Bahama Road to the south. It abuts other R1 -AA properties to the north, east, and west; a portion of the Mount Greenwood [residential] PUD to the northwest; large stormwater ponds to the west; and RC -I property (with a power line) to the south. The 2008 plan approval included a new 30,167 SF building (with a 783 seat sanctuary, classrooms, and offices) and provide additional parking for the expanded facility and generally bring the site into conformance with Code. The existing structures were proposed to remain, with the covered basketball court eventually being enclosed. No plan was provided at that time to demonstrate the aesthetics of the future enclosure. A development agreement (DA) addressed such issues as limiting future expansion, hours of operation, scheduling a sidewalk along E. Bahama Road (requires a sidewalk when the roadway is paved — paving should begin in May or June), steeple height, positive light spillage onto Hayes Road at the site ingress /egress, parking setbacks, screening the bus parking, overnight accommodation for visiting pastors and/or visiting singing groups, and maintenance of grassed parking and landscaping The 2008 plan has a total of 233 parking spaces: 22 of which are paved (includes 7 handicap accessible spaces) and 201 of which are stabilized grass parking. A variance to allow stabilized grass parking was approved by the City Commission on July 10, 2006. The 2008 plan also provides spaces for the church's busses behind the church. The Commission has stated that it wants the parking screened with adequate vegetation and does not want parking in the adjacent rights -of -way. REVISED INCREMENTAL PLAN: The plan being considered with this agenda item can be considered the first step toward achieving what was approved in 2008. The plan depicts enclosing the existing covered basketball court into an assembly building, use of existing parking (including handicap spaces), providing a dumpster enclosure, providing a new stabilized area for bus parking, perimeter landscaping, connecting the site to City sanitary sewer, and constructing sidewalks within the two (2) abutting road rights -of -way. Staff believes these improvements are commensurate with the limited scope of this increment of development. 2 April 26, 2010 Regular Item 600 Page 3 of 4 LANDSCAPING: The 2008 final engineering /site plan contains a landscape plan to screen the parking and noise from the adjacent neighborhood. The current plan provides perimeter landscaping along the Hayes Road and East Bahama Road rights -of -way. The interior landscaping, beyond what is currently there, is not provided, since it would subsequently be damaged or destroyed when the 2008 plan is further implemented. UTILITIES: The site will be serviced by the City's water and sewer system. The City has adequate capacity to serve the site. Dumpsters, transformers, backflow preventers, the irrigation well equipment, HVAC equipment, and other utility items, as well as storage facilities must be adequately screened from public ROWs. The current plan will connect the site to City sanitary sewer. Storm -water management is proposed in the 2008 plan, largely through an underground system, with two (2) dry retention ponds. No new storm -water facilities are needed for enclosing the existing covered basketball court. LISTED SPECIES: The northern (currently undeveloped) portion of the site and adjacent property contains gopher tortoise burrows. The applicant must relocate the on -site gopher tortoises located within the area to be cleared and protect other on -site as well as any off -site population from wandering onto the construction site before any site work may commence. SIDEWALKS: As required by the Comprehensive Plan and the development agreement, the applicant is providing 5 foot wide concrete sidewalks in the adjacent Hayes Road and East Bahama rights -of -way. FINDINGS: 1. The approximately 4.28 acre site has a Public /Semi - Public Future Land Use designation and is located within the R -1AA zoning district. 2. The site will connect to City water and sanitary sewer service. The City system has capacity (both water and sewer) to serve the site. 3. No off -site traffic improvements, other than curb -cuts to the existing Hayes Road and East Bahama Road ROWs, are necessary to accommodate the proposed project. 4. At its July 10, 2006 meeting, the City Commission approved a conditional use to allow the church to expand, subject to conditions, and also granted a variance to allow stabilized grass parking for spaces other than those used on a daily basis or handicap accessible spaces. 5. A site plan, aesthetic review, and development agreement were approved for the property on May 12, 2008. 6. Staff believes this site plan and the associated aesthetic review are largely incremental steps toward achieving the 2008 approvals. 3 April 26, 2010 Regular Item 600 Page 4 of 4 FISCAL IMPACT: No property taxes are assessed on the site. Permit, utility connection, and impact fees will be collected. COMMUNICATION EFFORTS: The Planning and Zoning Board agenda of April 2, 2010 was advertised in accordance with City Clerk policy including posting on the City's web site and Laser Fiche. No further efforts have been made for the final engineering/site plan, beyond those routinely done by the City Clerk's office. RECOMMENDATION: Staff recommends approval of the final engineering/site plan for the Starlight Baptist Church. WHERE DAMAGE DOES OCCUR, THE CONTRACTOR SHALL REMOVE DAMAGED TREE AND REPLACE IT WITH THE APPROPRIATE KIND AND SIZE RECOMMENDED BY THE LANDSCAPE ARCHITECT, AT NO ADDITIONAL COST TO THE OWNER. D. GRADES: IT SHALL BE THE RESPONSIBILITY OF THE LANDSCAPE CONTRACTOR TO FINISH (FINE) GRADE ALL LANDSCAPE AREAS ELIMINATING ALL SURFACE IRREGULARITIES, DEPRESSIONS, STICKS, STONES AND OTHER DEBRIS TO THE SATISFACTION OF THE LANDSCAPE ARCHITECT. AT THE TIME PRUNING IS COMPLETED, ALL REMAINING WOOD SHALL BE ALIVE. ALL CUT SURFACES OF ONE (1) INCH OR MORE IN DIAMETER, ABOVE THE GROUND, SHALL BE TREATED WITH AN APPROVED COMMERCIAL TREE PAINT. MAINTENANCE SHALL BEGIN IMMEDIATELY AFTER EACH PLANT IS PLANTED AND SHALL CONTINUE UNTIL FINAL ACCEPTANCE AT THE END OF THE GUARANTEE PERIOD. PLANTS SHALL BE WATERED, MULCHED, WEEDED, PRUNED, SPRAYED, FERTILIZED, CULTIVATED AND OTHERWISE MAINTAINED AND PROTECTED FOR THE PERIOD OF TIME STATED ABOVE. SOD SHALL BE MOWED ON A REGULAR BASIS, ONCE PER WEEK IN THE SUMMER (MAY -OCT) AND ONCE A MONTH IN THE WINTER. A SEPARATE CONTRACT FOR THIS CAN BE LET BY THE OWNER, BUT IT IS THE CONTRACTORS RESPONSIBILITY TO MAKE SURE THE MATERIALS ARE PROPERLY MAINTAINED. 2. SETTLED PLANTS SHALL BE RESET TO PROPER GRADE POSITION. PLANTING SAUCERS MUST BE CONTINUOUSLY MAINTAINED. 3. DEFECTIVE WORK SHALL BE CORRECTED AS SOON AS POSSIBLE AFTER IT BECOMES APPARENT. UPON COMPLETION OF PLANTING THE LANDSCAPE CONTRACTOR SHALL REMOVE FROM THE SITE EXCESS SOIL AND DEBRIS, AND REPAIR ANY DAMAGE TO STRUCTURES, ETC. RESULTING FROM PLANTING OPERATIONS. IN A MOISTENED CONDITION FOR THE INITIAL TWO WEEKS AFTER PLANTING. 4. THE LANDSCAPE CONTRACTOR IS RESPONSIBLE FOR PROTECTION AGAINST MECHANICAL DAMAGE INCLUDING PROTECTION FROM VEHICLES, BY POSTING OF APPROVED WARNING SIGNS AND /OR BARRICADES, AS MIGHT BE NECESSARY. HE SHALL REPAIR, RESTORE OR REPLACE ANY PLANTS OR PLANTING AREAS WHICH MAY BECOME DAMAGED AS A RESULT OF ANY NEGLIGENCE BY HIM IN COMPLYING WITH THESE REQUIREMENTS. AS A SPECIFIC REQUIREMENT OF THESE CONDITIONS, THE LANDSCAPE CONTRACTOR SHALL BE RESPONSIBLE FOR ASSURING THAT ALL PLANTS AT THE TIME OF FINAL INSPECTION EXHIBIT THE CHARACTERISTICS AND QUALIFICATION REQUIRED FOR THE GRADE OF PLANT AS ORIGINALLY SPECIFIED. 5.
