HomeMy WebLinkAbout2010 02 22 Regular 600 Preliminary And Final Engineering Site Plan Approval For Park Manor Academy Daycare Facility CITY COMMISSION AGENDA Consent Informational ITEM 600 Public Hearing Regular X February 22, 2010 /- Meeting Mgr. / Authorization REQUEST: The Community Development Department presents to the City Commission a request for combined preliminary and final engineering /site plan approval for an approximately 3,500 square foot (SF) daycare facility within the R -3 (Multiple Family Dwelling) zoning district. SYNOPSIS: In 2008 the Park Manor Academy received a conditional use to construct and operate a daycare facility at lot 5 of the Excelsior Business Park (135 Excelsior Parkway) and subsequently received a building setback waiver to "fit" the facility onto the site. The 0.49 acre site at the east end of the privately owned cul -de -sac is presently vacant. An aesthetic review of the building, site, wall, and signage (which has proceeded concurrently with the site plan) is scheduled to be heard at the City Commission with this site plan and is required before building plans may be submitted or a building permit issued. CONSIDERATIONS: FUTURE LAND USE & ZONING DESIGNATION: Future Land Use Designation: Medium Density Residential (3.6 — 9.0 D.U. /acre) Zoning District: R -3 Multiple Family Dwelling District APPLICABLE CODE: Chapter 9 of City Code Chapter 20 of City Code CHRONOLOGY: January 11, 1990 — Excelsior Business Park plat was recorded with Excelsior Parkway as a private cul -de -sac roadway. July 9, 2007 — Ordinance No. 2007 -20 was adopted, allowing day nurseries, kindergartens, and daycare as a conditional use in the R -3 zoning district. February 25, 2008 — Conditional use for daycare was approved. February 22, 2010 Regular Item 600 Page 2 September 19, 2008 — City receives site plan application package. October 27, 2008 — Setback waiver (allows 15' front setback, in lieu of 25') was approved. February 3, 2010 — Final engineering /site plan receive recommendation for approval from P &Z. DISCUSSION: Section 20 -207 of the City Code lists the permitted uses for the R -3 zoning district, which includes apartments, town homes, patio homes, or other multi - family dwelling structures; boarding or lodging homes; guest or tourist homes; and general office, including medical, dental, legal, architectural /engineering, real estate, financial, information technology, and administrative headquarters. Section 20 -208 lists the uses that are permitted in the R -3 zoning district only as a conditional use. These include day nurseries, kindergartens, and day care (excluding "family day care," as defined by Florida law). The 0.493 acre undeveloped site is located on the south side of the east end of the Excelsior Parkway private right -of -way, adjacent to a storm -water pond (master planned to accommodate Excelsior Park). A daycare facility is a free - standing facility where care for pre- school children is provided, normally during the daytime hours. Daycare facilities generally include classrooms, offices, eating areas, and playgrounds. Some daycare facilities provide after - school care for school -age children, as well. These issues were taken into consideration with the conditional use. The Institute of Traffic Engineers (ITE) has summarized traffic data from daycare sites surveyed from the mid -1980s into the 2000s. The weekday a.m. and p.m. peak hours of the daycare traffic generator typically coincide with the peak hours of the adjacent street traffic (highest hourly volumes of traffic on the adjacent streets during the morning and evening, respectively). According to the ITE's Trip Generation, 7` Edition, daycare facility typically generates 79.26 weekday trip ends per 1,000 square feet of gross floor area (12.79 average vehicle trip ends during the peak hour of adjacent street traffic between 7 a.m. and 9 a.m. and 13.18 average vehicle trip ends during the peak hour of adjacent street traffic between 4 p.m. and 6 p.m. on those weekdays). A trip or trip end is a single or one - directional vehicle movement with either the origin or the destination (exiting or entering) inside the study site. The total trip ends for a land use over a given period of time are the total of all trips entering plus all trips exiting the site during a designated time period. Saturday and Sunday vehicular trip generation rates are typically very low (6.21 and 5.83 average vehicular trips, respectively) for those facilities that are open on weekends. The applicant proposes to operate between the hours of 7 a.m. and 6 p.m., basically 5 days a week (not to exclude occasional weekend events or operation). Classes will begin at 9 a.m. and some after school programs are anticipated. The children are expected to be within the 2 — 11 years range. Section 20 -417 of the City Code requires a six (6) foot tall masonry wall be constructed along the portion of the site which abuts residential properties. Since the other commercial sites along Excelsior Parkway abutting these units have a vinyl fence separating the different uses (built before the wall requirement was adopted), the applicant desires to extend the vinyl fence. The February 22, 2010 Regular Item 600 Page 3 site plan can be approved with the six (6) foot masonry wall and the applicant may subsequently apply for a waiver of the wall requirement to extend the six (6) foot tall vinyl fence. In this way, the applicant may proceed without further slowing the process. FINDINGS: 1. The 0.49 acre site is within the Medium Density Residential future land use designation and the R -3 Multiple Family zoning district. 2. The site has received a conditional use for a daycare facility and a building setback waiver. 3. The site plan, as provided meets and is consistent with the comprehensive plan and City Code, subject to providing either a 6 foot tall masonry wall along the adjacent residential property or obtaining a waiver of the wall requirement (to extend the existing vinyl fence). The plan presently depicts the 6 foot tall masonry wall, as required by code. Such a waiver is separate from this site plan approval. FISCAL IMPACT: The Seminole County Property Appraiser's office states that, within Seminole County, the average building size for a daycare center is 5,528 S.F. (this facility will be approximately 3,500 S.F.) and that the average just value of these facilities is $110.70 per square foot. Therefore, without knowing further specifics, the estimated total just value of the facility is $387,450 (3500 SF x $110.70). The applicant projects 3 full -time and 2 part-time employees. Tax revenue projections are as follows: 3,500 square feet - assessed at $110.70 /square foot: $387,450 assessed tax value $387,450/1000 = 387.45 387.45 (2.5814) = $1,000.16 $1,000.16 (less the 4% statutory discount) = $960.16 tax revenue COMMUNICATION EFFORTS: Neighboring properties within 150 feet of the site were notified in writing and signs were placed at the site for both the conditional use and the building setback waiver. No further efforts have been made for the site plan. Further notification is required if the applicant seeks a waiver from the wall requirement (to extend the vinyl fence along the adjacent residential property). RECOMMENDATION: P &Z RECOMMENDATION: At its regularly scheduled meeting of February 3, 2010, the Planning and Zoning Board voted to approve the final engineering /site plan for the Park Manor Daycare facility. STAFF RECOMMENDATION: Staff recommends the final engineering plans be approved, subject to either providing the masonry wall, as depicted on the plans, or subsequently receiving a waiver from the wall requirement to extend the vinyl fence along the adjacent residential property to the southwest. Ms. Sahlstrom presented this Agenda Item and stated, "The Applicant has met all the requirements of the (City) Code, and the only issue that is really still outstanding is the issue of a Wall, because the (City) Code requires a six foot (6') masonry wall. However, adjacent to the property is a vinyl fence, so the Applicant desires to extend the vinyl fence. What Staff is asking is that the P & Z (Planning and Zoning Board) recommend Approval of the facility subject to either the Applicant providing the masonry wall or receiving a Waiver to extend the vinyl fence." Mr. Stevenson stated, "If I might remind the Chairman and this Board — the Waiver will be coming back to you." Board Member Robert Heatwole inquired about the property behind the fence. Mr. John Herbert, Engineer, American Civil Engineering Company, 207 North Moss Road, Suite 211, Winter Springs, Florida: addressed the Board Members and stated, "That is an existing retention pond and privately owned and currently maintained by the City of Winter Springs." Ms. Renee Hamilton, 220 Oak Road, Winter Springs, Florida: spoke briefly about the project and fence concerns. Referencing the debris behind the fence to be cleaned up, Chairman Lacey asked, "Randy (Stevenson), could you pass the message ?" Mr. Stevenson acknowledged this request.
