Agreement For Solary Canal Regional Stormwater Treatment Area (ITB#010-09-BF) COMMISSION AGENDA CONSENT X INFORMATIONAL ITEM 203 PUBLIC HEARING REGULAR January 11, 2010 MGR /DEPT /rn Meetin g Authorization REQUEST: Public Works Department requesting authorization to enter into a contractual agreement with Wal -Rose, Inc. for construction of The Solary Canal Regional Stormwater Treatment Area (ITB #010- 09 -BF) PURPOSE: The purpose of this agenda item is to request authorization to enter into a contractual agreement with Wal -Rose, Inc. for construction of The Solary Canal Regional Stormwater Treatment Area (ITB #010- 09 -BF) in the amount of $1,465,739.80 plus a 10% contingency. CONSIDERATIONS: The Solary Canal project is a proposed regional Stormwater Treatment Area located on a 28.9 -acre property at 1900 DeLeon Street in the northeast corner of the City of Winter Springs (see Exhibit A). Final Engineering for the project was approved by the City Commission at the September 22, 2008 Commission meeting. At the December 14, 2009 City Commission meeting, the Commission approved an agreement with the St. Johns River Water Management District (SJRWMD) for funding construction of the project by the City of Winter Springs. The construction funding agreement provides a total maximum reimbursement of $1,700,000 from SJRWMD, consisting of an initial authorization of $1,465,739.80, plus additional funding of up to $234,260.20 to fund any required project contingencies and change orders. At the December 14, 2009 meeting, the Commission also provided authorization to execute a Quit Claim Deed from SJRWMD for the City's acquisition of the 28.9 acre property. The Solary Canal project is planned as a partnership between SJRWMD, Seminole County, the City of Oviedo, and the City of Winter Springs. SJRWMD will fund the entire cost of construction, and the three local agencies (Winter Springs, Oviedo, and Seminole County) are planning to equally share in the annual operation and maintenance costs for the project. January 11, 2010 Agenda Item #203 Page 2 of 3 An Interlocal Agreement between Winter Springs, Oviedo, and Seminole County for operation and maintenance of the project and the property is currently being finalized and is expected to be submitted for City Commission approval at the January 25, 2010 meeting. The Briar Team had previously agreed to extend their bid to October 29, 2009 while the necessary paperwork was processed with the District. However, they have declined to extend the bid an additional 90 day period and have withdrawn from the project. The second lowest base bid was from Wal -Rose, Inc. in the amount of $1.31 million. Wal -Rose has agreed to extend their bid price until at least January 31, 2010 and they are currently the lowest responsive bidder. The delay between the bid opening date of April 29, 2009 and the recommendation of contract award with this agenda item was due to SJRWMD's delay in preparing the construction funding agreement and the quit -claim deed, both of which were approved by the City Commission at the December 14, 2009 meeting. Staff was not comfortable with awarding the construction contract and proceeding with any work without having the funding agreement in place. The City would likely have been responsible for any costs incurred prior to executing the funding agreement. January 11, 2010 Agenda Item #203 Page 3 of 3 Bid Alternates #1-3 consist of sheet pile retaining walls designed to protect existing trees near the side slopes of the proposed wet detention pond. At this time Staff does not consider Bid Alternates #1 -3 to be necessary and the existing trees can be avoided by minor reshaping of the pond side slopes in the vicinity of the trees. Funding for Bid Alternates #1 -3 has been authorized by SJRWMD; however, Bid Alternates #1 -3 are not planned to be executed unless field conditions require the use of the sheet pile retaining walls. On this basis, the recommendation of contract award to Wal -Rose, Inc. is based on Wal -Rose having the lowest base bid price. FUNDING: The project construction is funded 100% by the St. Johns River Water Management District. Under the terms of the construction funding agreement, the City will invoice the District monthly during the construction period and the District will reimburse the City within 45 days of receipt of an approved invoice. RECOMMENDATION: Staff recommends that the City Commission approve Wal -Rose, Inc. for construction of The Solary Canal Regional Stormwater Treatment Area (ITB #010- 09 -BF) in the amount of $1,465,739.80 plus a 10% contingency funded by the St. Johns River Water Management District and authorize the City Manager and City Attorney to prepare and execute any and all applicable documents.
