Authorization REQUEST: The Community Development Department-Code Enforcement Division requests the City Commission holds a public hearing for the first reading of Ordinance No. 753 to amend the City Code that deals with trailer signs along the S.R. 434 Corridor. PURPOSE: The purpose of this agenda item is to hold a public hearing for the first reading of Ordinance No. 753 which amends Section 20-466 (n) (8) and Section 20-454 (n) (8) of the City Code that deals with trailer signs along S.R. 434. APPLICABLE LAW AND PUBLIC POLICY: Section 20-466 and Section 20-454 of City Code prohibits trailer signs along the S.R. 434 corridor. Trailer signs are allowed, with restrictions, in other areas of the city. CONSIDERA TIONS: Under the current S.R. 434 Corridor Vision Plan for Redevelopment and New Development, trailer signs are prohibited, but a provision is made to allow a temporary sign for a limited time for special circumstances, such as grand opening, or new business. The Commission expressed concern for those businesses that have limited frontage, or whose S.R. 434 frontage is set back at such a distance that a temporary banner-type sign would be ineffective. IMPLEMENTATION: The City Commission will hold a public hearing for the second reading and adoption of Ordinance No. 753 on December 13, 1999. FUNDING: n/a STAFF RECOMMENDATION: Staff recommends the City Commission hold a public hearing to approve the first reading of Ordinance No. 753 to amend Section 20-466 and Section 20-454. Section 20-466 (n) (8) and Section 454 (n) (8) COMMISSION ACTION: CDDlNovcmber 12, 1999/10:56 AM ORDINANCE NO. 753 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING THE CITY OF WINTER SPRINGS CODE OF ORDINANCES SECTION 20-466 AND SECTION 20-454; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUnONS; PROVIDING FOR INCORPORATION INTO THE CODE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission has designated the S.R. 434 Corridor as a specialized overlay zoning district, and; WHEREAS, the purpose of this overlay district is to encourage and provide for enhanced property development, and; WHEREAS, visual distraction is reduced through uniform sign criteria, and; WHEREAS, trailer signs are viewed as a temporary means of advertisement, NOW, THEREFORE THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS, Section 1. Winter Springs Code Section 20-466 (n) (8) and Section 20-454 (n) (8) are amended as follows; (n) Prohibited Signs:..... .,... ,(8) Trailer signs, except temporary signs may be permitted provided the requirements of Section 16-79 of the City Code are complied with. Section 2. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 3. Incorporation Into Code. This ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 5. Effective Date, This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida. (3) Marketing signs shall be set back a minimum of twenty-five (25) feet from the front, side and rear property lines. They shall not create a visibility obstruction to vehicular traffic. (4) For parcels in excess of five (5) acres or with frontage on more than one (1) road, one (1) additional marketing sign may be permitted. Signs must be a minimum of two hundred (200) feet apart. (5) Marketing signs may be double faced. Sign faces shall be parallel and mounted on the same poles. The total copy area shall not exceed sixty-four (64) square feet and no more than ten (10) feet in height. The total of a single face shall not exceed thirty-two (32) square feet. (6) Marketing signage may be incorporated within the construction signage, but the signage shall not exceed sixty four (64) square feet in area. (7) Marketing signs may be lit so as to illuminate the lettering on the sign. (I) Political Signs only by permit. (m) Electronic date, time and temperature informational signs are permitted. Such signs shall be counted as part of the total copy area of the overall sign. (n) Prohibited Signs: The following signs and/or devices are prohibited in the corridor. (1) Any sign or part of a sign which is designed, devised, or constructed so as to rotate, spin, gyrate, turn or move in any animated fashion. Signs shall not incorporate neon or reflective materials so as to create the appearance of motion. (2) Any sign painted directly on any exterior wall. (3) Signs projecting more than six (6) inches in depth. (4) Roof signs. (5) Bench signs. (6) Snipe signs (e.g. signs attached to trees and poles).
