Authorization REQUEST: The Community Development Department-Code Enforcement Division requests the City Commission holds a public hearing for the second reading of Ordinance #750 that amends the City Code that deals with the keeping of animals in residential areas. PURPOSE: The purpose of this agenda item is to hold a public hearing for the second reading of Ordinance #750 which repeals Section 4-2 of the City Code that deals with the keeping of animals in residential areas. APPLICABLE LAW AND PUBLIC POLICY: The current regulation prohibits a resident from keeping more than 2 dogs and 2 cats at their residence without permission from the City Commission. At the October 11, 1999 meeting, the City Commission directed staff to revise this regulation. On October 25, 1999 the City Commission held the first reading of Ordinance #750 which repeals the regulation that limits the number of pets allowed to be kept at a residence. Repeal of Section 4-2 will take effect upon a second reading and adoption of Ordinance #750. FUNDING: nJa STAFF RECOMMENDATION: Staff recommends the City Commission hold a public hearing to approve the second reading of Ordinance #750 to repeal Section 4-2 dealing with keeping animals in residential areas. Section 4-2 of the City Code COMMISSION ACTION: CDD?November 8, 1999/3: 17 PM ORDINANCE NO. 750 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, REPEALING SECTION 4-2, DEALING WITH THE KEEPING OF ANIMALS IN RESIDENTIAL AREAS. PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS: SECTION I - Section 4-2 of the City Code, attachment B, IS hereby repealed in its entirety. SECTION II - Conflicts. All Ordinances in conflict with the provisions of tins Ordinance are hereby superceded and tins Ordinance shall prevail. SECTION III- Severability. If any words, phrase, sentence or portion of tlns Ordinance is stricken by a Florida Court of competent jurisdiction, all other teons and conditions of the Ordinance not specifically stricken shall remain in full force and effect. SECTION IV- Effective Date. Tins Ordinance shall become effective upon its passage. The city hereby adopts by reference as though fully set forth herein the "Animal Control and Protection Ordinance of Seminole County, Flori- da," County Ordinance No. 74-8, and all amend- ,ments and additions thereto except as otherwise provided in this chapter. (Code 1974, ~ 4-1) Sec. 4-2. More than two dogs or cats prohib- ited; exception. No household in the city shall own or contain more than two (2) dogs and two (2) cats without the express consent of the city commission. Once _permission is obtained from the city commission, additional dogs or cats may be maintained in the same household until such time as a public com. plaint is registered against their domicile or main- tenance. The city commission shall have the right to revoke the granting of this special exemption as set forth above at any time. (Code 1974, * 4-2) Cross reference-Zoning, eh. 20.
